Planning Board re: Menemsha:~ The Board discussed the upcoming review and update of the town’s Master Plan, starting with Menemsha, which is being initiated by the Planning Board.~ The Planning Board has requested to attend a future meeting of the Board of Health to get input on its views regarding Menemsha.~ The Board will discuss BOH considerations for Menemsha at its next meeting, and determine a date for discussion with Planning Board representatives.
Siegel, 30 Osprey Lane (25-121) Marina Lent reported that, despite having sent a letter to the property owners in spring 2015, a Bioclere operation and maintenance plan for this property is still not on file.~ The Board asked Marina to look into options to address this deficit, and to work with Katie Carroll to prepare a letter following up on this issue.
Public Hearing: 5:15pm
Chinoy, 31 Flanders Lane (26-29)~ The Board opened a public hearing to review a proposed septic system upgrade, presented by George Sourati, for a three-bedroom system.~ The plan requires the following variances from Title 5: separation between the septic tank and pump chamber and the locus well to be reduced from 50’ to 30’ and 31’, respectively; to reduce the distance from leach field to wetland from 50’ to 46’; to increase the maximum depth of a leaching field below finished grade from 36” to 52”.~ Variances from Chilmark BOH Regulations are as follows: to reduce the distance from leach system to property line from 30’ to 10’; to reduce the distance from leach system to watercourse from 150’ to 46’; to reduce the distance from leach system to watercourse (pond) from 150’ to 50’; to reduce the
distance from tank and pump chamber to a well form 50’ to 30’ and 31’ respectively; to reduce the distance form a leaching field to a well from 150’ to 116’ (AP 26-29); and 112’ (A26-23); to reduce the distance form a leach system to neighboring leach system from 300’ to 117’.
The property poses difficult challenges to septic system construction.~ Wetlands on both sides of the property, and a small stream with a man-made pond cutting through the middle of the property severely constrain options.~ It appears that the line from tank to leach field will have to cross below the stream, which would require a variance from BOH Regulations.~ The two dwellings on the property together have a total of three bedrooms.~
The Board received two letters from abutters Simonsen and Matshullat, both expressing concern with the proximity of the leach field to the drinking water well on the Simonsen property.~ Abutter Kim Simonsen expressed concern regarding the separation from her shallow well.~ The Board explained that the proposed separation meets Title 5 requirements, and suggested that the water should be tested now, prior to a septic upgrade on the adjoining property, to get a baseline of water quality from that well.~ The Board also noted that the Chinoy property is entitled to a septic system to serve the existing capacity.
The Board considered that FAST treatment at this site would not yield significant benefits, since this is likely to be a seasonal-use property.~ The Board continued the hearing.~ Board members intend to conduct a site visit prior to the next meeting on June 15th.~
Public Hearing:~
Carroll, 21 Carroll Lane (27.1-176) ~ Katie Carroll recused herself from the discussion of the proposed septic system upgrade. ~ The hearing was opened at 18:18.~ Reid Silva presented the proposed three-bedroom upgrade for a failed cesspool.~ Marina Lent reported that the BOH office has not received comments or communications regarding the proposed upgrade.~ The upgrade requires the following variances to Chilmark BOH Regulations: leaching system to well 150’ to 135’; leach system to property line 30’ to 18’; leach to wetland 150’ to 78’; leach to saltwater body 200’ to 78’; septic tank to saltwater body 100’ to 69’ proposed.~ The Board noted that the proposed plan appears to be the best option for the property, and approved the upgrade.
Taylor, 5 Homeward Way (20-95.3) Reid Silva presented a well construction application.~ The Board noted that the well location as shown on the plan is not quite 30’ from the property line.~ Reid Silva will provide an updated plan showing a compliant well location.
Substance Abuse initiatives:~ Marina Lent reported on an application under preparation for a Rural Scholars clerkship in October 2016 which will focus on addressing substance abuse on Martha’s Vineyard.~ The Health Agents’ Coalition has also submitted an MHOA internship application which will fund 50 hours of work between July 1 and September 31, 2016.~
