Caton, Nab’s Corner 11 Ridge Hill Road, (11-46) The Board noted that house plans provided by Gerry Caton are adequately served by the septic application and plan approved on 2/4/2015.

Mermaid Dairy: Food Establishment Plan Review:  The Board continued its consideration of a proposed Food Truck, and decided to issue a “yellow-light” food establishment permit to the Mermaid Dairy Farm Food Truck, valid for three months following a successful pre-operation inspection of the Food Truck.  The three-month pilot program will help the Board and the applicants evaluate the feasibility of the project, and address any issues that may arise.

The main dilemma for the Food Truck is the lack of a fully-equipped fixed kitchen, in particular, the associated lack of on-site wastewater disposal for food prep wastewater.  The Board worked with the applicants on creating a strong on-board water and wastewater storage capacity, and secure wastewater disposal at the Edgartown wastewater treatment plant.  The Board noted that this was an ad hoc solution which, if carefully managed and closely monitored, would be adequate to protect food safety for the purposes of this pilot program only, but that it is not a long-term, or generally-applicable solution.  

A permanent solution, to be instituted no later than the opening of the next season, will be either a Title-5 compliant onsite septic system for the Food Truck kitchen, or a DEP-approved, farm-specific wastewater disposal method.  Jan Buhrman noted that the Board of Health could work with State agencies MDAR and DEP during the off-season to explore on-farm, approved wastewater composting options.

Under the pilot program, any off-site food service provided by the truck shall be under a Temporary Food Event Permit issued by the Board of Health.  There shall be no charge for individual temporary food event permits; they are included in the permit issued for the truck.

  • Food and drink shall be served on disposable wares;
  • Food prep shall be completed in advance and separately from food service, allowing food service sessions to begin with a full on-board water storage tank and an empty wastewater tank;
  • Food storage between service shall be in the on-farm, brick-and-mortar walk-in cooling units, not on board the truck;
  • Frozen food shall be thawed in the walk-in cooler, not in the truck;
  • The Board of Health shall be periodically updated on the menu and types of food and prep-processes on offer;
  • Pre-rinsed farm Vegetables shall be re-rinsed during food prep on board the truck, and vegetable rinse-water only may be reserved for on-farm re-use;
  • On-board wastewater from handwashing and washing cookware shall be stored in the on-board wastewater tank during service and disposed of at the Edgartown Wastewater Treatment plant. A full on-board wastewater tank means immediate cessation of food service.
McDowell, 20 Blackberry Lane (7-3.2)  The Board noted that the as-built letter for this property requires follow-up review of the d-box to ensure that, having been installed on fill, it does not settle in a way that will lead to uneven wastewater distribution.  The Board asked Marina Lent to follow up with the owner to ensure that the required inspection is carried out so that the Certificate of Compliance for this system can be issued.

MV Savings Bank, 517 South Road (30-96):  The Board approved a deadline extension request for septic system upgrade triggered by a failed official Title 5 sale inspection report dated 6/6/2015.

Title 5 Official Inspection Reports:  The following Title 5 official inspection reports were received by the BOH office and all show that the systems have passed inspection: Bruuns & Puciul, 3 Nickerson Farm Lane, (21-48.2);  Dreyer, 134 South Road (17-46).  

As-Built Letter/Plan:  As-built letters and plans have been received for the following properties with Certificates of Compliance issued to: Sands, 4 Austin Pasture (33-85); Muglia, 3 Blue Barque Road (17-38.1).

Food Establishment Permits and Inspections:  Sushi Shack pre-opening inspection and permit issued 7/3;  Temp Food Event Permit: Kitchen Porch MVFF 7/8 and 7/15; All-Island Seafood 7/7;  Larsen’s Fish 7/7; Menemsha Market 7/7;  Beetlebung Coffee 7/7;

Tent Permit:  Chippari, 2 Pepperbush Road (13-6.3); Muglia, 3 Blue Barque Road (17-18.2); Palms/Gandrup, 16 Valley Lane (3-50); Buhrman/Ossnoss, 54 Hewing Field (12-68);

Invoices:  The Board approved the following invoice for payment:
  • MVRD SEMASS June 2015  $2,572.10
