Minutes of October 16, 2013 adopted.

Hait, 13 Deerpath Lane (7-83)  Chris Alley proposed a pool house tie-in to the existing septic system. The plan calls for a non-grinder ejector pump to pump to the tank at a rate of <60gpm.  He noted that this pump will be able to pump at these low rates at an uphill or even grade, and, at the ca 2’ uphill grade proposed, it will pump at ca 50gpm.  It is equipped with an alarm on the pump. BOH members saw that the alarm is not noted  on the plan and asked that this be rectified as a condition of approval along with a copy of the recorded deed restriction.  The Board approved the proposed plan.

Negroponte, Signal Hill Lane (34-1.3)   Chris Alley presented a septic system construction permit application that would replace a permit approved by the Board on 3/21/2012.  The previous plan has been slightly modified to accommodate proposed house plans.  No variances are required.  The Board approved the permit.

Larsen, 13 Wampum Way (11-74)     The Board considered a request for an out-of-season perc at 13 Wampum Way; however, a number of questions arose that the Board was not able to answer from the submitted documents.  The Board will review this request at its next regularly scheduled meeting, on November 20th, 2013.  The Board also asked Marina Lent to conduct a bedroom count prior to the November 20th meeting.

Harris, North Road (8-48)   Mike Thompkins presented a septic system construction permit application for a FAST system to serve a proposed dwelling on a small lot on North Road.  The proposed plan does not require variances.  The Board noted that an Operation and Maintenance Agreement will be required for the FAST system, and approved the permit.

Rose Morning Glory LLC, Wequobsque Road (30-113)   Mike Thompkins presented a septic system tank tie-in proposal for a house that has been moved to a greater distance from an eroding coastal bank.  A prior plan for the move had not been completed.  The proposed plan meets setbacks and was approved.

Parker, 9 Moses West Road (32-46) Mike Thompkins provided a revised as-built plan for a septic system built in 2007.  The Board approved issuance of the Certificate of Compliance for this system.

Gerson, 31 Hammentt Road (8-4)   The Board took note of a revised emergency replacement well construction permit application approved by the Board at its meeting of 10/11/13; the approved location of the replacement well, however, has not yielded adequate water.  The Board asked Marina Lent to confirm that the new proposed well location has been staked prior to drilling.

Curran, 5 Dirt Road (20-14)  Mike Thompkins discussed septic system options for a two-bedroom dwelling with a failed cesspool.  He inquired whether advanced treatment could enable a three-bedroom dwelling on the substandard lot.  Any proposed plan along these lines will require variances.  The Board decided to continue the discussion at a future session with a full board present.

Cooper, 21 Ridge Hill (11-16.1)  Mike Thompkins held a renovation plan discussion with the Board regarding an existing ca. 1984 tank & 2 pits, 4-bedroom system inspected by Doug Cooper in August 2006.  The owners would like to convert the garage into a finished space.  In addition, a bedroom count shows that the existing number of bedrooms in the dwelling exceeds septic system capacity, and the owner plans to renovate a downstairs den area to disqualify it as a bedroom.  Nevertheless, the Board felt that the significant proposed renovations will require a septic system upgrade.

Sica, 52 Prospect Hill, (14-26)   Mike Thompkins presented a revised pool house tie-in plan prepared by Reid Silva to install two tanks in series.  The Board approved the revised plan.

Fischer, 27 Cross Rip Lane (24-20)  The Board reviewed an Official Title 5 Inspection Report on a failed system.  System is single cesspool which “shows signs of recent back-up and lush green grass around its perimeter.”  The Board asked Marina Lent to contact the owner to require an upgrade plan for the failed system within 90 days.

Temporary Food Events and unlicensed “caterers” – The Board asked Marina Lent to write a letter to the Community Lunch Committee c/o the PTO to outline the violation of Chilmark BOH Regulations regarding the need to obtain a Temporary Food Establishment Permit in a timely fashion.

The Board’s broader discussion of Temporary Food Events and unlicensed caterers is continued to future full meetings of the Board.

Tea Lane Caterer retail and wholesale sales   The Board took note of  a notice from owner Dee Smith regarding the upcoming hire of a baker for the company, who will sell baked goods at catered events and at wholesale. The Board noted that Chilmark Zoning Bylaw will not permit a retail establishment at the catering company location.  In addition, a caterer’s license does not cover sale from the premises, which would have to be separately licensed as a food establishment. It is therefore not possible to sell items produced at the catering kitchen from the kitchen location.  The Board asked Marina Lent to write a letter to the Tea Lane Caterer, outlining the town requirements.

Chilmark School Lunches  The Board noted that, once again, the permitting process for the Chilmark School lunches leaves much to be desired.  Despite multiple reminders, the lunch organizers failed to obtain a permit application until the morning of lunch.  The Board asked Marina Lent to write a letter to the Community Lunch Committee via the PTO, explaining the recent violation and outlining procedures to be followed in the future.

Chilmark BOH Regulations regulating the sale of Tobacco:  The Board noted an announcement from the Cape & Islands Tobacco Control Project that Edgartown has adopted updated regulations regarding the sale of tobacco and tobacco products.  The Board will ask Matt Poole for a copy of the newly-adopted regulations.

Craver, 47 Blueberry Ridge Road (8-67) Official Title 5 Inspection Report – passes. Pumpout recommended, and pumpout permit issued.

Fool’s High Tide LLC, 25 East Lane (32-68.1)  proposed beach nourishment/cobble berm

Wachsler, 17 Tiasquam Ridge Road (8-34) Title 5 Official Inspection Report – passes

Bonomo, 14 Paddock Circle (11-28.7) Title 5 Official Inspection Report – passes

Craver, 47 Blueberry Ridge Road (8-67) Official Title 5 Inspection Report – passes. Pumpout recommended, and pumpout permit issued.

Preston, 9 Sheep Pen Lane (33-53) as-built received, Certificate of Compliance issued

Rowe, 22 Kennasoome Way (11-55.4) as-built received, Certificate of Compliance issued

Menemsha Hills RE Trust, 6 Trustees’ Lane (14-22.3) repair permit to install missing pump alarm float, as-built letter received, Certificate of Compliance issued

Chestnut Rise Nominee Trust, 61 North Road (3-5) Official Title 5 Inspection Report – passes

O’Brien, 25 Basin Road (27.1-157) Official Title 5 Inspection Report – passes
