Minutes of September 18, 2013 adopted.

Khedouri, Bartlett Woods (11-1.3)   Katie Carroll, whose home directly abuts the property, recused herself from the discussion and decision.  John Clarke presented a well permit application for a new well at the newly-subdivided property.  The proposed location meets all setback requirements.  The Board approved the well permit construction application.

Khedouri, Bartlett Woods (11-1.4)   Katie Carroll, whose home directly abuts the property, recused herself from the discussion and decision.  John Demers came before the Board to request an out of season perc test.  The Board granted the request, on the condition that the Board will review the results of the soil evaluation and assess whether the complexity of the soils requires an additional, in-season perc test.

Khedouri, Bartlett Woods (11-1.5) Katie Carroll, whose home directly abuts the property, recused herself from the discussion and decision.  John Clarke presented a well permit application for a new well at the newly-subdivided property.  The proposed location meets all setback requirements.  The Board approved the well permit construction application.

Khedouri, 14 Yardarm Lane (24-227)  The Board reviewed a replacement well construction permit application presented by John Clarke.  The proposed well is located in the Coastal District, and the required well-to-septic separation for the Coastal District will require a variance to Chilmark BOH regulations.  The Board approved the proposed replacement well construction permit application, on the condition that the existing well be properly abandoned in accordance with the DEP Private Well Guidelines.

Khedouri, 14 Yardarm Lane (24-227)   Reid Silva presented a Septic tank relocation permit application to serve a renovation of the existing dwelling.  The upgrade requires the following variances: well to leaching system(s) 200’ required, 186’, 164’, 156’ and 150’ proposed; well to property line: 30’ required, 11’ proposed.  The existing septic tank is located where a porch is proposed; a gravel trench leaching system passed inspection in 2012.  The proposal involves relocating the tank, drilling an replacement well, installing a new pump chamber.  The Site Review Committee has requested a bedroom count, and the house is limited to 3 bedrooms by the Zoning Board of Appeals.  The Board approved the proposed plan.

Glasgow, 22 South Road (11-52)   Eric and Molly Glasgow came to the Board to review a proposed addition to the residential septic system serving their five-bedroom home. The addition will be a studio room in a nearby barn.  The Board noted that the septic system has a six-bedroom capacity, and that an additional bedroom in the barn poses no obstacle to permitted function of the system.

Shaloub, 205 South Road (18-107)   Reid Silva presented renovation plans for the property which will include building a barn with a washer/dryer and a toilet, a 2-bedroom guest house, and a studio.  The Board noted that the system has 6-bedroom capacity.  The location of the existing leaching trench, installed in 2000, must be verified.  If possible, additional leaching capacity can be added to the existing trench, or a new trench can be added.

The addition of a guest house will require submission of plans demonstrating two separate, compliant septic systems before the proposed “merged” system can be reviewed and approved.  

Harris, North Road (8-48) Reid Silva presented a Septic System Construction Permit application for a 1-acre parcel on North Road, just opposite the Great Rock Bight road. The plan calls for a variance, as the well would have to be located 11’ from the property line, instead of the 30’ called for by Chilmark BOH Regulations.

Katie Carroll felt that if full Title 5 compliance is possible, it is preferable to having the Board issue a variance for a non-conforming lot.  She acknowledged that full compliance will result in a less-than-optimal building site for the house, which will be sited above a steep incline close to the road.  

A revised septic system plan will also require additional soil testing. The Board approved an out-of-season perc for this property.

Shapiro, 20 Quitsa Lane, (33-39)   Reid Silva brought a revised septic plan with a slightly altered building footprint that does not affect septic system separations.  The Board noted the revised plan.

Sica, 52 & 68 Prospect Hill Road (14-26 and 20-32)   Reid Silva presented a plan to tie-in a proposed pool house into the existing septic system via a pump chamber and force main.  An electronic device will be required to moderate the force of the pump to prevent stirring up solids in the receiving tank. The Board noted that a device can be disconnected or removed.  Reid noted that it would also be possible to add a secondary settling tank to the far side of the primary tank.  He could also ensure that the device, called a “Speed Bully”, is hardwired so that it will remain operational.  He will review these options with the owner.  If the owner accepts a secondary settling tank, the revised proposal can be approved out-of-session. If the Speed Bully is the preferred option, the Board will review the proposal at its next meeting.

Menemsha Hills Trust, 6 Trustee’s Lane (14-22.3) Title 5 Official Inspection Report – conditional pass:  does not have an alarm float in the pump chamber.  Marina Lent has written a letter to the owner to address this deficiency.

Chilmark Tavern drinking water   Following a routine water sample which tested positive for total coliform and E coli, and a positive retest within 24 hours, the Department of Environmental Protection has issued a boil order for the building housing the Chilmark Tavern.  The Board noted that a restaurant of the size and complexity of the Tavern cannot safely operate under a boil order, and hoped for a speedy resolution of this unfortunate situation.

Wallach, 15 Red Wing Road (25-106) Title 5 Official Inspection Report – passes.

Syslo, 14 Lobster Lane (17-14) upgrade as-built letter received; certificate of compliance issued

Brookside Realty Trust, 489 South Road (30-98) Official Title 5 Inspection Report -- passes


Temporary Food Events and  Catered Events in Chilmark  The Board held a free-ranging discussion of food safety considerations involved in the increasing number of public food events and private catered events held in Chilmark, mostly during the summer season.  Jan Buhrman pointed out that many catered events are catered by private “chefs” rather than licensed caterers; and also pointed out that drinking and wash water is frequently provided via a regular garden hose, which poses a high risk of contamination.

The Board noted that this is an ongoing and evolving issue for Chilmark, and asked Marina to keep this item on the agenda through the upcoming off-season, so that the Board can develop a systematic approach.
