May, 15 Red Valley Road (33-81) Chris Alley asked the Board for permission to conduct an out of season perc test. The Board permitted the perc test, but asked to review the results before determining whether the out-of-season perc test can be used to approve a proposed septic system.
Balaban, 35 Menemsha Crossroads (26-137) Reid Silva reviewed the history of the drip dispersal septic system at the Balaban residence at 35 Menemsha Crossroads. Following the installation of the system last summer, it was found that the topology was sending surrounding surface water runoff into the control box and leaching field. Katie noted that the alarm system was activated during heavy rains in February. It was found that the control box was flooded.
A drain has since been installed to divert the water away from the control box. It was also necessary to raise the leaching area to prevent pooling of surface water runoff. The Board requested that, in future, repairs of this magnitude will require notification of the Board of Health office to determine whether a septic construction permit (repair) should be submitted.
The Certificate of Compliance for this system has not been issued, pending receipt of the final testing and approval of the system by the Oakson Company.
Halby, 11 Half Inch Lane (24-4) Reid Silva asked that the Board put consideration of this well permit application on hold until he is able to contact the abutter to inform her that the proposed well is less than the 200' from her septic system required by Chilmark BOH Regulations.
McGarry, 108 Hammett Road (4-7) Reid Silva presented a revision to an eight bedroom septic plan originally approved 1/16/2013. No variances are required – relocation of septic tanks and leaching field will make room for a proposed swimming pool. The Board approved the proposed revision, with the condition that the engineer certify the elevation at the bottom of the system, since groundwater tends to be elevated in the area, and was found at 6'3" during soil evaluation.
Kauffman, 20 Chappaquoit Road (24-210 & 211) Chris Alley discussed a septic system upgrade of a 1989 system serving a garage (currently empty, no plumbing), a three-bedroom house, and a two-bedroom structure that currently has a kitchen. The system required variances when it was originally built, and the well-to-septic variance of 4’ separation was denied by the Board at the time, according to handwritten notes found in the file, while the 11’ septic-to-property line separation was approved. The 1989 application and plan are not on file with the Board; nor are there minutes of the Board’s approval on file. Onsite review indicates a six-bedroom capacity system.
A number of possibilities are under review by the current owners: to eliminate the kitchen in the second, smaller dwelling, making it a “detached bedroom” – however, the size of the structure would exceed the recently-adopted limits for a detached bedroom. Chris Alley also asked if the Board would consider keeping the existing leaching trenches as part of the upgraded system.
The proposal is to reduce one of the buildings to a detached bedroom (or two), keep the leaching system, install a new pump chamber and FAST system. Matt Poole pointed out that the system has been pumped out regularly, and that if this is due to lacklustre leaching, rather than a zealous maintenance schedule, it would be far preferable to build a new leaching system even though a new leaching system is not required. The Board will reveiw an application at its next meeting.
Mosquito Testing The Board reviewed the 2013 Massachusetts Arbovirus Surveillance Program which specifies steps to be taken to prevent and respond to the mosquito-borne illnesses West Nile Virus and Eastern Equine Encephalitis. The Board will look for a way to conduct mosquito testing in Chilmark during the 2013 season, and asked Marina Lent to determine whether the Town has funding for this purpose, since the Board of Health has not included mosquito testing in its FY’13 and FY’14 budgets.
The Board asked Marina Lent to write a memo to the Board of Selectmen stating that the Board of Health would like to see mosquito testing during the 2013 summer season, and asking whether the Selectmen have designated funding for mosquito testing in their FY’14 budget.
Installer Permit Application: The Board approved an installer application for Eastern Excavation (John Kasboski).
Food Inspection staffing: The Board noted the availability of Barney Suman to conduct food establishment inspections in Chilmark if the additional capacity is needed. Based on reports of pre-opening inspections done so far, the Board asked Marina Lent to undertake the next round of inspections unannounced, and to engage Barney if it seems that additional attention and a fresh pair of eyes is needed to achieve satisfactory food safety practices.
Site Review Committee: The Board discussed problems faced in BOH attendance at the bi-monthly Site Review Committee meetings, which are held on the second and fourth Wednesdays in the mid-afternoon. During the summer months, more often than not, all three Board members are unable to attend. The Board asked Marina to inquire as to whether it might be possible to change the meeting time of the Site Review Committee to evening after work, and/or to move its meetings to conincide with BOH Wednesday meeting schedule to meet on the first and third Wednesday instead of the second and fourth.
Health Department staff The Board reviewed the position description for the Health Department position, and decided that it may be necessary to increase the hours of the position in the future in order to accommodate public water system operation.
I/A Technology Testing requirements: The Board asked Marina Lent to respond to an inquiry from Wastewater Treatment Services, Inc. regarding reduced testing requirements for systems approved for remedial use for residential systems using less than 2,000gpd. The Board reserves the right to require more than the one field test per year on a case-by-case basis.
