Harris, 1 Wequobsque Road (30-46) Kate Warner and Chris Alley presented proposed house renovation plans to the Board in order to determine whether the work can be approved without a septic system upgrade. The Board pointed out that the sale-transfer inspection of the septic system was a “conditional pass”, with indications that there may be a leak in the septic tank, and recommending that a riser be placed on the tank (which has been done) and that a wet-pump test of the system be undertaken in order to rule out a leaking septic tank. Chris Alley will prepare a septic repair application to get the recommended tank test done.
Zoia, 18 Point Inner Way (33-114) The Board reviewed draft language for a deed restriction on the gazebo proposed by Adam Zoia. The Board wishes to incorporate conditions listed by the Site Review Committee. The history of this property shows that details are best spelled out, not left open to interpretation or assumptions. The Board is prepared to accept the draft deed restriction which reflects Site Review conditions (draft date-stamped received January 2, 2013). The Board asked Marina Lent to inform Building Inspector Lenny Jason that no building permit should be issued for the gazebo until this matter is resolved.
Zoia, 18 Point Inner Way (33-114) The Board resumed its review of its condition relating to the size of the accessory structure/detached bedroom/third structure at 18 Point Inner Way. The Board reviewed a draft summary of the issue, and asked Marina Lent to supplement this summary with data from an existing conditions plan. The Board also discussed whether “screened-in porches” with solid glass panels would or would not be counted as living space or square footage of a given building under the meaning of the agreement reached with Adam Zoia.
Squibnocket Pond Phragmites follow-up Matt Poole discussed the Board’s position with Lenny Jason, who confirmed the Board’s role according to the Zoning By-laws. As discussed at its last meeting, the Board noted that its role under Article 12 is to determine which substances qualify as chemical fertilizers, herbicides, fungicides, etc., not to evaluate the merits of any individual application or proposal. The Board feels that it is evident that Rodeo is a “chemical herbicide” within the meaning of Article 12.H.1 of the Chilmark Zoning Bylaws. The Board felt it would be desirable to have good data on the actual impact of the proposed chemical control process proposed for Squibnocket, and hopes that perhaps grant funding could be found to conduct impact
studies of areas treated in the past.
2012 BOH Annual Report Katie Carroll suggested that the Board’s 2012 Annual Report could include a retrospective of the long and productive tenure of Mike Renahan on the Board of Health. Mike, who joined the Board in 1995, passed away in late 2012, and is sorely missed.

PWS #4062000, Menemsha Water Co. Q4 water test results for Nitrate and E Coli for the Menemsha Water Company pass: E Coli is not detected; Nitrate levels 0.34 and 0.30, well within the maximum allowable level of 10.
Teller, 22 Redwing Lane (24-17) well completion report received: replaced well is abandoned, potability test shows TC+, and the Board asked Marina Lent to follow up with John Clarke to ensure that we get a clean retest.
Feinberg, 10 Allen Farm Road (25-20.11) as-built letter and plan received; Certificate of Compliance will be issued when electrical system is installed and pump/alarm wet pump test has been done.
Invoices: The Board approved the following invoices for payment:
- MVRD Water Monitoring Q4 2012 50% and Gas Monitoring Q4 50% $2,000.82
- MVRD Q4 Inspections 50% $221.76
- Mass Dept of Environmental Protection Public Water System fee for #4062006 $20
- MVRD Q3 Drop Off Contract $7,597.54
- MVRD Semi-Annual Assessment FY’13 2nd half $43,311.68
