Greenburg, 8 Greenhouse Lane (33-30) The Board heard from concerned abutters Peter and Della Darling and Barbara Barre regarding extensive irrigation of large areas of the 4.5 acre property at 8 Greenhouse Lane. The Board also noted that a new well was drilled under permit from the Board, but that conditions stipulated by the Board in the permit, namely the decommissioning of the existing well, and that there be no irrigation of the grounds, have not been fulfilled. The abutters noted that the area’s water supply has been known to be precarious, and that extraordinary additional stresses could compromise the drinking water supply of the entire neighborhood.
The irrigation is below-ground, with “pop-up” buttons. The Board noted that the Conservation Commission had allowed a “temporary, above-ground irrigation system to be installed for the first two years to establish the root systems.” (e-mail correspondence with ConCom staff dated July 9, 2012). The Board asked Marina Lent to look into the matter of decommissioning the old well and asked her to contact the person in charge of landscaping the property, Leo DeSorcy, to discuss BOH and ConCom conditions for the property, and to draft a letter in follow-up.
Well Permit Application Approval Process The Board asked Marina Lent to review the well permit application approval process and make recommendations to the Board at its next meeting as to how the process could be improved to provide for better oversight of implementation of Board conditions and Regulation requirements.
Merkel/Shanus, 17 Howell Lane (27-3) Chris Alley presented a 9-bedroom capacity septic system construction permit application for a ca. 7.3 acre lot. No state or local variances are required. The Board approved the application, and suggested that the proposed 20-foot separation between the leaching system and the swimming pool be increased if possible.
Zoia, 18 Point Inner Way (33-114) Chris Alley informed the Board that he has completed the inspection of the septic system serving the Zoia residence at 18 Point Inner Way and asked whether all the agreed conditions had been met for the Board to issue a Certificate of Compliance for this property. The Board asked Marina Lent to share information relating to the septic system with Building Inspector Lenny Jason, and will review the as-built letter and plan at its next meeting on July 18th.
17:30 Public Hearing:
Vytlacil, 21 Squibnocket Road (35-24): The hearing was opened at 17:30. Reid Silva presented a septic system construction permit application for a pre-existing, non-conforming four-bedroom dwelling requiring the following variances from Chilmark BOH Regulations: Leaching facility to Squibnocket Pond Wetland 200’ 148’; Leaching facility to Squibnocket Pond 500’ 166’; leaching facility to Well 200’ 155’ and 190’ (locus well); proposed well to property line 30’ required, 10’ proposed. A new well will also be required; a proposed location for the new well is indicated on the septic system plan; an application to drill the well has not yet been received by the Board. Abutters within 300’ of the property had been duly notified of the hearing; the Board confirmed that no communication from abutters had been received by the Board of Health office. The Board approved the permit application and plan as presented.
Wachsler, 12 Peases Point Way, (26-1) George Sourati presented a septic system construction permit application which was identical to the application approved at a public hearing for the property on 6/17/2009, which had since expired. The proposal requires the following variance to Chilmark BOH regulations: leaching system to isolated locus wetland separation to be reduced from 150’ 109’. The Board approved the application as presented.
Collins, 26 Hammet Road (8-2) The Board approved a septic system construction permit application which had originally been approved by the Board on 7/15/2009, extended by one year on 6/6/2012, and was now before the Board for renewal. The plan requires no variances to state or local regulations.
Guidelines for Ground Source Heat Pump Wells: The Board took note of the Guidelines for Ground Source Heat Pump Wells, and asked Marina Lent to write up recommendations for retroactive steps for completion of existing GSHP wells as well as recommendations for future BOH procedures in review and approval of such wells.
Beach posting policy: The Board reviewed proposed procedures which differentiate between Pond and Oceans for beach posting in the event of bacterial counts exceeding allowable limits: the Board would like to take a conservative approach to the Pond and post immediately following notification of a high bacterial count or a significant rain, as outlined in 105 CMR 445.000, for two reasons: the Pond does not enjoy the tidal flushing of the ocean beaches, so high bacterial counts will likely take longer to dissipate, and more vulnerable, immune-compromised individuals, such as the very young, the very old, and people suffering
from illnesses, will be more likely to use the calmer, warmer waters of the Pond for swimming or wading. Ocean beaches shall be posted within 24 hours of a high bacterial count as required by 105 CMR 445.000.
All-Island Seafood, Inc. Due to observed violations of Section 6-202.15 of the 1999 Food Code, namely, the screen door to the establishment missing or propped open, the Board of Health decided to issue a notice of suspension of the food establishment permit for All-Island Seafood under the authority of 105 CMR 590.014(B), “Suspension of a Permit with notice”. The Board stipulates that the permit will be suspended as of July 21, 2012, if at any time the screen door is witnessed and reported to be missing or propped open in the intervening days.
PWS #4062006 Annual Water Quality Report The 2011 Report has been received and posted at Library in accordance with 105 CMR 22.000, 310 CMR 22.00.
Grey Barn The Grey Barn Farm received a raw milk cease and desist order from the Massachusetts Department of Agricultural Resources, MDAR, dated July 2, 2012 re: a June 27th sample with a coliform count of 290; witnessed raw milk sample re-test July 3 resulted in a coliform count of 5, and raw milk sales have been fully reinstated as of 7/9/2012.
Poole, 90 Menemsha Crossroad, (26-35.1) as-built received, Certificate of Compliance issued.
Eaton, 29 Tilton Farm Road (18-14.4) as-built received, Certificate of Compliance issued
Pasteurization Permit: A License to maintain an establishment for the pasteurization of Milk was issued to the Mermaid Farm and Dairy on July 11, 2012.
Tent Permit: A Tent Permit was issued to Jim Feiner 235 Middle Road (19-63);
Recreational Camp Permit: A Permit to run a Recreational Camp for Children at the Chilmark Community Center was issued to Danika Dorsey.
Public Bathing Beach Permit issued to Menemsha and Squibnocket Beaches.
Temporary Food Permits were issued for the Slow Food Summer Solstice event; and to the Tea Lane Caterer to sell frozen pies @ Chilmark Flea Market on Wednesdays from 9am to 2pm.
Catered Events: The Board was notified of the following catered events: Bill Smith’s Clambake Oc. Haskell, Mayhew House 225 State Road, 7/3, 25-30 people; Bill Smith’s Clambake Co. Guylay, 2 Muddy Cove Road, 7/8, ca. 40 people; Bill Smith’s Clambake Co. Sankaty Advisors Pary 14 Black Point Road, 7/11, ca. 20 people; Bill Smith’s Clambake, 9 Fulling Mill Hill Road, 8/4/2012, 30 people;
Training: The Chilmark Emergency Manager will share the cost of having Marina Lent attend a two-day Disaster Sheltering for Companion Animals workshop in Weymouth, MA, on August 27 & 28.
Planning Board schematic representation of Town regulatory processes: The Board took note of charts showing the regulatory steps for townspeople seeking to build a house in Chilmark.
Harbor Sewage Pump-Out faucet: Marina Lent reported that the harbor sewage pump-out faucet has been rendered incapable of supporting a hose connection via the application of gorilla glue as of 6/28/2012, thus ensuring that a hazardous cross-connection between human sewage and drinking water will not occur.
