Minutes of April 4, 2012 approved.
Bologna, 275 State Road (24-163.4) Title 5 Inspection Report -- passes
5:30 Public Hearing:
Shapiro, 20 Quitsa Lane (33-39) The Board noted that no correspondence has been received regarding this hearing. Reid Silva presented a septic system construction permit application requiring the following variances to Chilmark Board of Health Regulations: leaching facility to property line: 30’ 13’; leaching facility to leaching facility: 300’ 49’; leaching facility to locus well: 200’ 138’.
The Board noted that the abutting property, Map 35 Lot 18, is of sufficient acreage that the reduction of separation to the property line will not cause hardship. The Board approved the Title 5-compliant proposed plan, on the condition that the owner provide a letter to the Board stating that s/he is aware that the separation between the leaching field and the locus well is less than the 200’ required by Chilmark BOH regulations.
Hornblower, Round Pond Road (35-1.5) The Board approved a septic system construction plan revision presented by Reid Silva.
Lewenberg, 3 Osprey Lane (25-122) The Board noted receipt of a deed restriction on the detached bedroom; noted the demonstration of two fully-compliant septic systems on the property; noted that the existing system passes inspection. The Board approved the proposed septic system tie-in plan presented by Reid Silva, with the request that the wording on the plan regarding the now-deed-restricted detached bedroom be clarified.
Packer, 511 North Road (Menemsha Market) (27.1-97) The Board read a letter from property owner Dorothy Packer, dated April 14, 2012, asking the Board to allow the Market to operate without completion of the sewage disposal system upgrade because composting toilets reviewed by the owner do not seem suitable for the Market. The Board noted that Title 5 requires upgrade of the septic system, and that the US Food Code requires an individual sewage disposal system to be sized, constructed, maintained, and operated according to law. The Board therefore maintained the original condition outlined at its meeting of June 15, 2011, which requires the upgrade to be completed prior to the 2012 season in order for the Menemsha Market to be able to operate.
