Swordfish Enterprises, DH’s Hill Road (21-71) Mitch Gordon presented renovation plans for a 2-bedroom dwelling which is served by a 3-bedroom system.  The Board noted that planned renovations will not increase the number of bedrooms in the dwelling, and that the renovation plans are within the capacity of the septic system.  

Gadd, Emily, 322 South Road (24-218)   Chris Alley presented a well permit application on behalf of John Clarke to drill a well at 322 South Road.  The house has an existing well and cesspool, with a separation of 67’; the new well would increase the separation to 107’, and is located such that, when the cesspool is upgraded, the leaching area of the new system will have a 150’ separation from the well.  The Board approved the application; the applicant will provide a letter, stating that s/he is aware that the separation between leaching field and the well is less than the 150’ required by Chilmark BOH regulations.

Gale, Basin Road (21-1.5)  Reid Silva discussed plans to install a tight tank at the fish wholesale operation on Basin Road.  The Board looks forward to receiving a proposal for the system.  Discussion then ensued as to whether Menemsha Harbor is part of the Coastal District DCPC.  The definitive map showing the boundaries of the DCPC was not at hand, so the determination will be made at a future date.

Boyd, 80 State Road (30-6)  Reid Silva discussed a proposed plan to place a septic system in the corner of the lot where the current well is located, and to drill a new well at a considerable distance, running the water line along the road.  The Board noted that a hearing will be required, and suggested that the hearing be held as early as possible, at the next meeting of the Board on February 15, 2012 at 5:30.

Keene, 27 Harbor Hill Road (27.1-108)  Reid Silva described upcoming work on a septic system for the property and asked if a public hearing would be required; the Board said it would, and a hearing date was set for March 7, 2012 at 5:30 pm.

Weatherall, 31 Spruce Gate Road (35-1.13) Reid Silva presented a septic system construction permit application for a 3-bedroom capacity system serving a proposed 2-bedroom detached structure.  The system will have a pump chamber; sewage will be pumped ca. 443’.  This format was deemed best because of extensive landscaping surrounding the detached structure.  The main house will continue to be served by its existing septic system.  No variances are required.  The Board approved the application.

Doyle, Seven Gates (1-8)  The Board noted receipt of the as-built well plan, well completion report, and passing potability test.

Joroff, 5 Sarah Brown Lane (7-56)   Marina Lent reported that Doug Cooper has not yet been hired to initiate the septic system repair/upgrade at the Joroff residence.  The Board considered sending a letter to the current occupant of the dwelling, with copy to Mr. Joroff, informing them that occupancy of the dwelling will not be permitted beyond Memorial Day 2012 in the event that the septic system has not been properly upgraded by that time.  

Barclay, Osprey Lane, (25-117.2) as-built received, Certificate of Compliance issued.

Walton, 142 Quenames Road (17-30)  Evidence of sewage backup into the Distribution Box was noted in a Title 5 Inspection Report on the property.  The Board asked Marina Lent to write a letter to the owner, stating that the dwelling may not be occupied until such time as the system has been properly repaired or upgraded.

Chase Bank 27 Old Ridge Hill Road—Main House & Guest Cabin (11-2.5)  The Board reviewed a Title 5 Inspection Report indicating that the septic system serving the main house fails inspection.  The Board instructed Marina Lent to write a letter to the owner, stating that the dwelling cannot be occupied until the septic system has been properly repaired or upgraded as appropriate.

Pandora’s Box, 4 Basin Road (27.1-117)  The Board noted that an emergency pumpout of the cesspool was required in 2011, and also in 2010.  The Board instructed Marina Lent to write a letter to the owner, pointing out that the system may be on the verge of failure, and asking that this matter be looked into.

Smith, 16 Harbor Hill Road (27.1-104  The Board noted that two pumpouts of the cesspool were required during the 2011 summer season.  While this does not automatically constitute system failure, the Board asked Marina Lent to write a letter to the owner, advising that it appears that system failure may be imminent, and requesting that the owner look into the matter.

Zoia, 18 Point Inner Way (33-114)   The Board reviewed its request for updated plan reflecting conditions as per agreement between the Board and Adam Zoia at the Board meeting June 30, 2010: while some of the conditions are reflected in the septic plan of May 5, 2010 submitted to the Board by Chris Alley on July 7, 2010, other information, such as the square footage of the proposed and actual Accessory Building, is not available.  The following conditions were agreed between the Board of Health and Adam Zoia at the Board meeting of June 30,2012:

  • 7 bedrooms; < 14 rooms total
  • Size of the accessory structure to be reduced 50% from the plan originally considered by the Board on 6/30/2010; (proposed sewage disposal system plan dated May 19, 2010)
  • Deed restriction on barn to bar use for sleeping (received and on file)
  • Septic plan to showing no wastewater out of the barn; (water access outdoor faucet as discussed at BOH meeting of 6/15/2011); Credits for septic system in accordance with Title 5; blowout location for blower vent;  location of ejector pump;  proportion of flow to be pumped;  basement floor elevation in relation to septic tank.  (septic plan conditions confirmed with Chris Alley)
  • Archeological survey of property with tribal cultural resource monitors on site;
  • Only one well is allowed on the property—others to be properly abandoned; (per well permit approval of 2/9/2011)
  • Plan showing original grade and re-grading of land.
The Board asked Marina Lent to follow up with Building Inspector Lenny Jason to determine whether these conditions have been met.

VNA Home Visits The Board noted that better use could be made of the home visits public nursing service provided by the town, and asked Marina Lent to obtain a list of all Chilmark citizens over 80 years old to see who may be able to benefit from home health care visits.

Cooperation with other town boards The Board discussed how best to cooperate with other Town boards on projects of a certain size and impact.  Katie Carroll noted that the Board of Health is not empowered to regulate the size or visual/social/cultural impact of development, and that this is the proper responsibility of the Planning Board.  The Board noted that ongoing information exchange with other town Boards, and consistent and active participation in the Site Review Committee, is desirable.

Draft BOH Annual Report 2011  The Board approved a draft annual report.

Tobacco Regulations: The Board took note of proposed updates for town regulations provided by the Tobacco Control Program.
