Minutes of August 17, 2011 approved.
Langman, 8 Salt Meadows, (21-52.2) The Board reviewed a Form C Notice for subdivision of the property prepared by Doug Dowling for the Langman property. The plan includes a proposed septic system, showing wetland and well separations; however, the separation to the wetland is less than the 150’ required by Chilmark Board of Health regulations. The Board noted that it has not received a variance request from Doug Dowling, and requested a revised plan or formal variance request for the proposed system before a decision can be taken to approve or disapprove the Form C Subdivision.
Walsh, 320 Middle Road (25-11) Marina Lent reported that there has been no well installation at the property. The Board stressed the urgency of moving forward with legal enforcement of the court order, and requested Marina Lent to convey this message to BOH counsel Michael Goldsmith.
Verret, 10 Kenasoome Way (11-55.2) The Board reviewed a building renovation plan under which an attached, unfinished one-car garage would be converted to additional living space; the building footprint would remain the same. Marina Lent reported that a bedroom count on the property shows three bedrooms in the main house (to which the one-car garage in question is attached). According to BOH files, the septic system, which was installed in 1989, is permitted for five bedrooms. The Board approved the proposed renovation, contingent on a prior Title 5 septic system inspection by a licensed System Inspector.
Bierstedt, 12 Menemsha Gate (26-132) The Board reviewed building renovation plans submitted by builder Bob Russillo, but noted that, as there is no other information on file regarding this property, a bedroom count and Title 5 septic system inspection by a licensed System Inspector must be undertaken before the Board can consider the proposed renovation plans.
Pechter, 16 Valley Lane (3-50) The Board approved a well permit application submitted by John Clark for a replacement well, stipulating that the existing well is to be properly abandoned. The existing well was installed but never used. The well completion report for the existing well is on file, but the well is no longer operational. The permit will be valid when it is signed by the applicant and returned to the Board of Health office.
Maida, 31 Menemsha Crossroad (26-136) The Board noted the approval of an emergency well permit application, and awaits a well completion report and potability test for the well. No variances were required.
Joroff, 5 Sarah Brown Lane (7-56) Mike Renahan and Marina Lent will conduct a site visit to determine whether sewage disposal system failure has occurred at this property.
Watkins/Cartel, 9 Stonewall Road (32-47) Marina Lent reported on a possible sewage disposal system failure, since a second emergency pumpout permit in the space of five weeks was obtained for the property. The Board instructed Marina to write to the owners, requiring a Title 5 septic system inspection by a licensed System Inspector. Should the owners decide to proceed directly to initiate a septic upgrade, a prior inspection to confirm system failure will not be required.
Glimcher, 211 Middle Road (19-20) Mike Renahan reported that a septic backup at the property was confirmed to be a blockage, which has been easily resolved, rather than system failure.
Campbell, 5 Marjo’s Way (27-7) Marina Lent reported on an emergency septic repair undertaken by David Merry, according to Joe El-Deiry, of John Keene Excavation. Marina Lent will follow up with the owner to obtain a permit, and with David Merry regarding a record of the work undertaken.
Emerson, 35 North Road (3-9) The Board examined a sewage disposal system plan submitted by George Sourati, and noted that it will require a Title 5 variance and hearing. The Board also asked Marina Lent to convey to George Sourati that the plan should show the Zone I of the Dunkl drinking water well, as well as the existing cesspool. The Board also asked that the location of the existing well be field-verified.
Cullen, 31 Shadbush Hollow (11-10) The Board reviewed a sewage disposal system construction permit application submitted by George Sourati and previously discussed by the Board at its meeting of May 18, 2011. The plan requires a variance from the wetland separation of 150’ required by BOH regulations – the separation proposed in the plan is 129’. The Board required that a hearing be held for the decision on this plan, and asked Marina Lent to inform engineer George Sourati, with a tentative hearing date scheduled for the Board’s October 5 meeting.
Osterman, 79 Quansoo Road (17-25) The Board noted receipt of a well completion report and clean potability test for this property.
Zoia, 18 Point Inner Way, (33-114) The Board noted receipt of a well completion report, however, the potability test for the new well is positive for total coliform. The Board asked Marina Lent to follow up with John Clark on potability re-test and proper abandonment of the previous well.
Kocien, 100 South Road, (11-62) The Board noted receipt of an as-built letter and plan; the certificate of compliance has been issued.
Kling, 41 Tilton Road, (4-17) The Board noted receipt of an as-built letter and plan; the certificate of compliance has been issued.
Regulation Revision The Board took note of the final draft Section 3: Sewage Disposal. There were no comments or additions at this time; Marina Lent will send copies of the draft to engineers and the building inspector for comment and discussion. A public hearing on the final draft will be held prior to finalizing and adopting the draft regulations in accordance with Massachusetts General Laws.
Marina Lent 2011 performance evaluation Marina Lent presented a call-down list of officials and individuals who frequently work with the Board of Health office to facilitate the annual performance evaluation of BOH staff. Jan Buhrman will make random calls to selected individuals on the list and report any feedback to the Board.
Community Septic Management Loan Program: Marina Lent reported that there is funding for the Town to support a septic management loan program for Chilmark residents, and suggested that owners of failed systems should be informed of this opportunity in the future.
Integrated Pest Management Marina Lent reported on the Integrated Pest Management program for Chilmark: according to County Manager Russell Smith, the program covers regular maintenance for all Town buildings, including the Chilmark School, which, as a mandated program, pays a reduced fee for the IPM services. In addition, private individuals of a participating town can avail themselves of pest management services at a reduced rate. The program does not cover raccoons and skunks, however.
Food Establishment Plan Review: Marina Lent is developing a Plan Review process for future Chilmark food establishments.
C&I Health Agents’ Coalition Marina Lent requested permission to attend the Coalition’s monthly meeting on Friday, Sept 16. She noted that the Chilmark Board of Health has not been represented at the Coalition since early spring 2011.
Rabies test The Board noted that a raccoon killed in Menemsha has tested negative for rabies.
Food Establishment Inspections: The Beach Plum Inn was inspected on 8/22/2011. Marina Lent noted that funding for joint, precepted inspections with Barney Suman is still available. Mike Renahan suggested that this be employed at next spring’s opening inspections.
