Wiesner, 46 Meadow Lane (31-11.1) The Board approved an emergency well permit application presented by John Clark for a replacement well that was placed in the identical location to the old steel well it replaced. A plan showing the well location will be provided.
Bell, 62 Stonewall Road, (32-61) John Clark reported to the Board on a well that was drilled immediately adjacent to the existing well pit. The separation to the septic system is roughly 500’. The property is being surveyed at this time, and a plan showing well location, as well as a well permit application, will be submitted to the Board for approval in due course.
Osterman, 79 Quansoo Road (17-25) John Clark presented a well permit application for a replacement well to accompany a replacement house that is being built on the site of the old house. The well meets required setbacks. The Board approved the application, pending receipt of a plan showing well location, and stipulated that the old well is to be properly abandoned.
Gourley, 420 Middle Road (19-70) John Clark discussed a proposed well which has been staked >150’ from the septic system and ca. 200’ from the Pond. A plan showing the well location will be provided. There is a hand-dug well and a pumphouse nearby. The Board approved the permit application pending receipt of the plan and requiring proper abandonment of the existing well.
Morgan, By the Woods, (18-105) Mitch Gordon presented an application for a composting toilet at a proposed shed at the Morgan property. He submitted plans for the unit, drawn up by designer Anna Edey. The unit consists of three 20-gallon, closed barrels, which can be rotated and stored for the required 2 year holding period. There is no effluent from this system. Following a review of Title 5 requirements for humus/composting toilets, the Board approved the application.
Walsh, 320 Middle Road (25-11) The Board asked John Clark whether he had been contacted by the Walsh family to drill the well which had been approved by the Board at its meeting of June 1, 2011. At that time, the area in question was too wet to bring in heavy equipment, but the Board noted that the area has been dry for quite some time now, and that the summer rental of the property is proceeding. The Board expressed strong dismay with the delay, and instructed Marina Lent to look into reactivating a legal response; John Clark suggested he could follow up with the homeowner first to see if action could now be initiated.
Lyons, 57 Wequobsque Road (30-116.2) as-built received, certificate of compliance issued
BOH Regulation Revision: The Board discussed specific outstanding questions relating to the draft of Section 3, Sewage Disposal. The Board wishes its regulations to follow Title 5 stipulations with regards to garbage grinders; will not at this time pursue regulations regarding innovative/alternative systems beyond what is contained in Title 5; and will require failed septic systems to be upgraded within 90 days, rather than the two years allowed in Title 5.
Maciel & Sons, Inc.: Marina Lent reported on discussions of the Edgartown Board of Health regarding outstanding fees with the Edgartown wastewater treatment plant. Due to the unpaid fees, which include payment for septage originating in Chilmark, the company has not been permitted to deliver septage to the Edgartown plant since January 2011. The Board expressed grave concern, and asked Marina Lent to follow up with the Edgartown Board of Health about measures they have taken to address this problem. If the issue is not promptly and fully resolved, the Board will consider revoking the Chilmark hauler’s permit currently held by Maciel & Sons, Inc.
Prince, 395 North Road (20-89): The Board received a final report from Bennett Environmental (Brewster, MA) on an oil spill cleanup operation at the site: the clean-up is complete.
Temporary Food Permits: Lemonade at the Chilmark Flea Market; Backyard Bash 8/3/2011; Chilmark Road Race Jerk Chicken cart 8/13/2011. The Board noted that having a temporary food establishment serving the Chilmark Road Race is a departure from past practices, and asked that Marina Lent consult with the Board prior to issuing a permit in cases such as this.
Catered Events: Irie Chicken at Menemsha Inn, 8/8/2011;
Non-Compliance notices for PWS #4062008 (Chilmark School) and PWS #4062000 (Menemsha Water Company): The Massachusetts Department of Environmental Protection has issued a non-compliance notice for the Chilmark School and Menemsha Water Company for failure to submit 2010 Annual Statistical Reports. The Board asked Marina Lent to follow up with the school to ensure that the requirements are being met.
Grease traps in restaurants with tight tanks: Marina Lent reported that restaurants with tight tanks are not required to have a grease trap, since the effluent will be processed at the wastewater plant, which has the capacity to handle grease.
Children’s Dance Classes at The Yard: The dance program at the Yard does not qualify as a Recreational Camp for Children under 105 CMR 430.000, which specifies that “a classroom based instructional program, provided that no specialized or high risk activities… are conducted… shall (not) be deemed to be a recreational camp for children.”
West Nile Virus + mosquito: The Board took note of a report from Mass Department of Public Health Arbovirus Surveillance Program dated July 25, 2011, which found one West Nile Virus-positive mosquito in Tisbury.
Ehrlichiosis case report The Board received a report of a Chilmark resident who has tested positive for Ehrlichiosis (7/8/2011).
Food Establishment Inspections : Chilmark Store 7/22; Tea Lane Caterer (ongoing);
Native Earth Teaching Farm: The Board noted requirements for the labeling of meat products for sale to the public which Marina Lent has transmitted to the Native Earth Teaching Farm. Marina Lent will follow up to ensure proper labeling of the product.
Pasteurization Permit and Inspection: Mermaid Farm and Dairy (ongoing). Marina Lent reported that she is in the process of issuing the pasteurization permit for the Mermaid Dairy. Re-inspection of required paperwork will take place 8/5/2011.
Food-Borne Illness Investigation: Marina Lent reported on a trace-back investigation being carried out by the Department of Public Health for a possible food-borne illness relating to raw oysters consumed at a Chilmark food establishment. She noted that the oysters have not been identified as the source of the illness, and that this is not an outbreak (involving two or more people). Mike Renahan pointed out that it is not the responsibility of the local Board of Health to carry out these investigations.
Rat Investigations: The Board noted that the town has chosen to engage pest control to address any problems with rats or mosquitoes, and that these problems do not ordinarily need to be handled by Board of Health staff. The Board asked Marina Lent to contact T.J. Hegarty of the Integrated Pest Management program of the County, and get an update on Chilmark pest control activities.
Invoices: The following invoices were approved for payment:
- Barnaby Suman, Food Inspection Training, $112
- Thermometers and alcohol wipes for Beach testing and food inspections $56.50
- Certified Professional—Food Safety application fee $410
- MVRD SEMASS Transportation Recycling $4,356.20
