5:15 pm  PUBLIC HEARING
Star, 7 Huckleberry Hollow, (13-9.10)   Katie Carroll opened a public hearing on a proposed septic system upgrade at the Star property at 7 Huckleberry Hollow, submitted by George Sourati.  The proposal involves installation of a 5-bedroom leaching field to replace a leaching pit currently serving a three-bedroom house.  The proposal is Title-V compliant, but will require the following variances from Chilmark Board of Health regulations: to reduce the required distance from leaching system to property line from 30’ to 15’; to reduce the required distance from leaching system to wetland from 150’ to 135’ (128’ from reserve area).  The Board asked whether any communication had been received from abutters to the property; it had not.  The Board noted that two of the notified abutters had not picked up the notification of the hearing.  They therefore requested the property owner to communicate with the abutters in question prior to Board approval of the proposal.  An approved permit will be held by the Board of Health until well test results have been reported.

Eaton, 29 Tilton Farm Road (18-14.4)  George Sourati proposed a revision to an approved sewage disposal system construction permit which would relocate the leach field closer to the house, enabling a gravity-fed, rather than a pumped system.  The Board approved the revision.

Rivera, 88 Quenames Road (17-21.1)  George Sourati presented a sewage disposal system construction permit application for installation of a sewer pipe from a proposed two-bedroom dwelling to an existing 3-bedroom capacity leaching trench serving the owner’s former dwelling which was destroyed in a fire a few years ago.  The Board approved the proposal.

Packer (Menemsha Market) 511 North Road (27.1-97) The Board discussed the ongoing upgrade of the sewage disposal system at the Menemsha Market with engineer Reid Silva.  Medeiros Excavation carried out the work to install the approved greywater system.  However, in the course of installation, an existing leaching trench, rather than the pit shown on the plan, was discovered in immediate proximity to the proposed greywater trenches.  The installer did attempt to contact the engineer for instructions, but then proceeded to disconnect the existing system and concluded installation of the greywater system, leaving no connection to handle blackwater from the building.  

Reid Silva requested permission from the Board to reinstall a simple gravel trench for blackwater during the summer, so that the Menemsha Market could open and operate throughout the season.  A low-flow toilet will be installed.  The Oliver family does not plan to live in the apartment upstairs over the market space this summer.  

The Board approved these measures, and stipulated that implementation of the composting toilet option discussed in connection with this system must be initiated at the end of September 2011, and completed prior to next summer’s opening.

The Board also discussed the infraction of proper procedure by the installer which had resulted in the present dilemma.  The Board asked Marina Lent to write up a note to the file on the discussion of the Board, and to send a copy to the owner and the installer, together with a copy of the relevant sections of Title 5 so that such a situation will not occur again.

Cochin, 100 South Road (11-62) Chris Alley came to the Board to request permission to conduct an out-of-season perc test to replace a failed sewage disposal system.  He noted that an in-season perc test of an immediate abutter could provide additional data to assess groundwater levels.  The Board approved an out-of-season perc test.

Malkin, 10 Tilton Cove Way (25-124, 125) Chris Alley presented a sewage disposal system construction permit application for a proposed upgrade to serve an existing three-bedroom dwelling and proposed detached bedroom.  The system is Title 5 compliant, but requires the following variances from Chilmark Board of Health regulations: leaching field to wetland from 150’ to 123’; leaching field to own well 200’ to 150’.  

Chris Alley asked whether the Board would permit the new 1,500 gallon septic tank to be hooked up to the existing four-bedroom capacity leaching pit, which per evaluation by Doug Cooper on May 14, 2011, shows no sign of having had water beyond 20% capacity.  He noted that it seemed wasteful to abandon the leaching pit at this stage, and wondered whether the Board would be satisfied with a proposal to build the new system, have the proposed accessory building be connected through the proposed new 1,500 gallon septic tank to the existing leaching pit, which would be monitored bi-annually in September, and abandoned with all flow diverted to the new leach field if/when the pit was ever shown to have reached 80% capacity.  The Board approved the proposal.

Zoia, 18 Point Inner Way (33-114)   Chris Alley reported on the decisions taken by the Conservation Commission earlier today to deny plans for a re-built gazebo, an expanded boathouse, and a substantial pathway to the Pond on the Zoia property.  The Board confirmed that the Title 5 bedroom definition will in fact apply to any gazebo that is an insulated, enclosed structure such as that proposed by the plan denied by the Conservation Commission.

The Board reiterated its condition that there shall be no wastewater in the barn, as agreed directly with Adam Zoia on June 30, 2010, and confirmed that a sink constitutes a source of wastewater, while an outdoor hose-bibb faucet connection does not.  

Hornblower, 11 Round Pond Road (35-1.4)  The Board took note of a Title 5 inspection report.  The inspection passes.

Shea, 11 Hammett Lane (8-43)  The Board took note of a FAST Wastewater Inspection report.  The inspection indicates proper functioning of the system.

2011 Food Establishment Permits:   Judi Worthington (Residential Kitchen); Summersweet B&B;

Pasteurization Permit:   Marina Lent reported that a pasteurization permit has been issued to Grey Barn Farm and Dairy following full inspection of the operation.

Mosquito update: Marina Lent reported on efforts to send mosquito information home with students.  Due to school regulations, such a mailing would have to be available in Portuguese.  The Board noted that there are no Portuguese-speaking students at the Chilmark School, and decided to approach the Chilmark School PTO for a mailing list to send the information through the Post Office.

Tick Program update:  Marina Lent reported on an education program carried out for the Chilmark School on June 10, and noted that the Tick Borne Illness Steering Committee is scheduled to meet on June 22 to discuss progress to date and upcoming work.  Interested Board members are invited to attend, and Marina Lent will report on the meeting at the upcoming meeting of the Board on July 6th.
