Minutes of December 15 2010 and January 5 2011 approved.

Mosquito Testing on Martha’s Vineyard: Marina Lent reported that Russell Smith was unable to attend tonight’s meeting due to a County Commission meeting which was rescheduled to tonight because of the recent snowstorm.  The next available time to meet with the Board will be February 16th.  Marina Lent noted that Russell Smith is also willing to meet with the Board outside of its regularly scheduled meetings if necessary.

Food Allergen Awareness Act  Mike Renehan noted that new allergen awareness requirements are in force, and asked Marina Lent to make sure to incorporate these in her upcoming food inspections.  Jan Buhrman noted that the required allergen awareness certification can easily be acquired on line.

Town-generated trash  Marina Lent reported that custodian Rodney Bunker had explained to her that on occasion there are large amounts of trash to dispose of when cleaning out a storage space, for example.  Jan Buhrman still feels that the total amount of waste generated by the Town on a regular basis is too high, considering that most of the waste generated is recyclable, and that the Town Hall and Library have instituted not only paper recycling, but also metal/plastic recycling.  Jan Buhrman said she will meet with Rodney to discuss this further.

Clivus Composting Toilets at Town Beaches: the Board took note of a proposal from the Beach Committee to install composting toilets at Town beaches.  The Board requested Marina Lent to research feasibility of well-maintained, properly-functioning composting toilets and report back to the Board at its next meeting on February 9th.

5:15pm  PUBLIC HEARING:  
Poole, 10 Basin Road (27.1-109):  The proposed plan submitted by Kent Healy requires no Title 5 variances; Chilmark Board of Health variances are 20’ leach bed to property line separation (30’ required), and 4’ separation of the bottom of the leach field to high groundwater (5’ required).

The Board asked Marina Lent whether any communication, whether verbal or in writing, has been received in response to the notices sent out to abutters regarding today’s hearing.  Marina Lent confirmed that no communication has been received.

Mike Renahan reviewed the history of the Board’s consideration of this property, He noted the Martha’s Vineyard Commission (MVC ) order of conditions regarding the chandlery building, dated April 13, 1978, which makes reference to holding tanks under the parking lot.  Per the MVC conditions, these are to be tested once a year, with certification given to the Board of Health that the tanks remain in sound condition.  Everett Poole noted that these tanks have not been in use for a number of decades.

The Board asked whether there are potential difficulties with running the pump line under the existing parking lot; inquired specifically about separation distances between system components, leach field and the wetland across Basin Road;  (50’ from pressure line required, Kent Healy confirmed adequate separation).

The one-bedroom apartment over the restaurant; the 2-bedroom cottage on the other side of the chandlery, accounts for the 3-bedroom capacity reflected in the flow calculations of the proposed plan.

The Board also asked why the Menemsha Café is limited to 17 seats, when the usual cutoff for the maximum seats without toilet facilities is 19 seats.  The proposed system capacity allows for 17 seats at the Café; depending on how many employees are working at the chandlery, however, flow may be available to accommodate the 19 seats reflected in the Café’s food establishment permit.

The Board next considered the flow calculations for the chandlery, which are based on the Title 5 requirements of 15 gallons per employee, with a maximum of 8 employees.  

The Board noted that the proposed system is a great improvement over current sewage treatment and disposal at this property, and approved the proposal.

2010 BOH Annual Report  The Board approved the draft Annual Report for submission to the Town’s Annual Meeting in 2011.

Feinberg, 10 Allen Farm Road (25-20.11)  Reid Silva reported to the Board on results of a soil observation at the property. The owner would like to renovate, expand from 5 to 6 bedrooms, and install a swimming pool.  The soil observation results showed unsuitable material (clay) in the area proposed for the septic system.  Reid Silva asked the Board whether it would be acceptable to add to the existing system to accommodate the proposed renovations and expansion of required flow.

The Board noted that the existing system already requires variances, and asked that Reid Silva look into the possibility of building an entirely new, fully compliant system on this 3.1 acre lot.

Couch, 46 Stonewall Road, (30-12) Reid Silva presented a proposed septic system to serve a 3-bedroom addition to an existing dwelling.  The proposed new system has a 6-bedroom capacity.  Soils are suitable.  No variances are required.  The Board approved the construction application.

Hawkins, 29 Welles Way (25-6.1) Title 5 inspection report received—passes

Menemsha septic system public education material  The Board approved education material for posting in the Menemsha bath house, educating clientele on disposal limitations of an on-site septic system.

MVC DRI checklist revision The Board noted the ongoing review process of the checklist for projects requiring or eligible for review by the Martha’s Vineyard Commission as a Development of Regional Impact.

Children’s Flu Clinics: Marina Lent reported that the All-Island Health Agents, through the Vineyard Nursing Association, have organized two flu clinics to immunize children which will be held on Janury 29, 2011, from 9am to 11am at Howes House in West Tisbury,  and February 5, 2011 9am-11am at the High School.

Regulation Revision:  Marina Lent proposed a process for adoption of final drafts by the Board, with a view to finalizing a comprehensive revision of Board of Health Regulations. The Board felt that BOH regulations on Transport and Burial of Human Remains are redundant, since the relevant State regulations will be incorporated into Chilmark regulations by reference.

The Board instructed Marina Lent to present a final draft of septic system regulation revisions for finalization and formal adoption by the Board, so that the provisions regarding room counts for dwellings of more than 8 bedrooms can be implemented.

The Board also considered submission of an application for an Installer’s permit submitted by Leo DeSorcy.    At its session of December 1st, the Board had met with Leo DeSorcy to discuss violations of its requirements in connection with work at a Chilmark job site, including the requirement to have a valid permit issued by the Board for any work undertaken within the Town.

The Board declined to issue a permit to the DeSorcy Company for the upcoming year, and instructed Marina Lent to return the application fee to the applicant.
