Minutes of August 18th 2010 approved.
Goldberg, 19 Peaked Hill Road (19-5) George Sourati presented a disposal system construction permit to upgrade the existing septic system and expand from a four-bedroom system to accommodate an additional bedroom. The house is on a 37,459 ft2 lot, and has an easement in place enabling the adjoining lot to be used and accessed for a sewage treatment and disposal system. The small lot size will require use of a de-nitrification system to allow for the additional flow, and a FAST tank is proposed.
Katie Carroll reported on a walk-through and bedroom count she had conducted, and the Board reviewed the existing and proposed house plans. The basement functions as a single studio, and George Sourati provided a draft deed restriction which would restrict the basement from being used as a sleeping space. The Board reviewed and approved the deed restriction. The Board determined that additional studio flow of 5 gallons per day per 100 ft2, and 10 gallons per day for the studio occupant, will be required. George Sourati will supply an updated plan showing the additional flow. An Operation and Maintenance Agreement from the FAST company, a copy of the recorded deed restriction, and a copy of the amended plan will be provided to the Board. The Board approved the proposed
application.
Eaton, 29 Tilton Farm Road (18-14.4) George Sourati presented a disposal system construction permit application for a proposed new 5 bedroom house on a 9-acre lot that has an old brick barn which was converted into a 2 bedroom house and one-bedroom carriage house. The Board insisted that the 2 bedroom house cannot be designated as a guest house. George Sourati will provide a revised plan with the proper designation. The Board asked to see the house plan for the proposed 5-bedroom house.
Emerson, 35 North Road (3-9) George Sourati requested permission to conduct an out-of-season perc test for a failed system at 35 North Road. The system is a cesspool serving a 2 bedroom cottage. The Board noted that, according to pumpout permits granted by the Board this year, the system appears to be in good working order as no permits have been requested for this system. The Board denied the request for an out-of-season perc test on the basis of information currently available about the existing system. The Board also requested that the Zone I of the Dunkl’s well on the adjacent property be reflected on any future plans regarding this system.
Thompson, 20 Wauwompauque Trail (24-145) The Board approved the replacement of cesspool serving an existing six-bedroom house with a nine-bedroom capacity Title 5 system proposed by Chris Alley.
Regulation Revision In discussion about the Board’s need to review house plans to confirm the proposed bedroom count on a new construction, Chris Alley suggested that the Board could approve a permit on the condition that it will review the building plan as presented to the building inspector for final approval of the building permit; the Board considered this a very good suggestion and requested Marina Lent to incorporate language to this effect in the draft BOH regulation revision.
Miller, 7 Georgiana’s Way (17-23.2) Chris Alley presented a proposed 6-bedroom capacity sewage disposal system to serve an existing 4-bedroom house and a detached bedroom. The Board approved the proposed application.
Middle Line Road Affordable Housing Project (13-43.2,5,8) The Board approved a minor revision to a sewage disposal system plan for rental site #5 of the Middle Line Road Affordable Housing Project to accommodate a change in placement of the driveway.
Matschullat (26-28) The Board reviewed proposed plans for renovation of an existing bedroom count for building revision plan. The Board asked Marina Lent to conduct a bedroom count of the existing house.
Davis, 290 South Road (24-195) The Board review a building renovation plan an existing five-bedroom house. The plan adds a bedroom, and converts another room into a laundry room. The Board asked Marina Lent to conduct a bedroom count of the existing house. The Board moreover noted that, for a renovation of this magnitude, an upgrade of the 1980s septic system will be necessary. The Board feels that de-nitrification is called for at this location, close to the Chilmark Pond. Furthermore, if the system capacity is to remain at five bedrooms, the owner will need to place a deed restriction on the proposed laundry room, preventing its future use for sleeping space. Alternatively, a six-bedroom system could be designed on this 9-acre lot.
Polinger, 54 Post Oak Road, (11-28.10) septic inspection report received—passes.
Levy-Church, 8 Greenhouse Lane (33-30 & 177) septic inspection report received—passes with recommendations. The Board asked Marina Lent to write a letter to the homeowner, requesting implementation of the recommendations made by inspector Douglas Cooper.
Chilmark Tavern Pantry Option: The Board reviewed correspondence with restaurant manager Paul Petersiel regarding the Pantry option currently listed on menus used by the Chilmark Tavern and on the on-line menu, which offer raw shellstock and marinated steaks for home preparation, which would require both a separate retail permit from the Board of Health and a Retail Seafood Permit from the Massachusetts Department of Marine Fisheries. Marina Lent reported on a discussion with Paul Petersiel, in which he assured her that staff have been instructed to inform diners that the “take-out” of raw product was not available, offering cooked take-out from the menu instead. He also stated that the Tavern will change over to a fall menu when its hours change after September 6th. The Board instructed Marina Lent to call the restaurant and request a take-out meal from the Pantry.
DPH-FPP inspection review report: the Board reviewed an inspection report of the plans for the for Grey Barn Dairy operation. The BOH role foreseen for the Dairy is to:
- issue license for milk pasteurization;
- approve grey-water disposal system for washing/processing of milk products.
The Board noted that a pasteurization license will not be issued until all other components of the operation are approved and completed.
Enforcement Guidelines for Allergen Awareness Regulation: The Q&A factsheet and poster for the regulations which come into effect on October 1, 2010 were distributed to: Chilmark Tavern, The Bite, Menemsha Café, The Galley, Larsen’s Fish Market, Beach Plum Inn, Menemsha Inn, copy to go to Chilmark Chocolates next time they open.
Food Establishment Inspections: Inspections were conducted at the Chilmark Tavern, Homeport, Tea Lane Caterer, Larsen’s Fish Market, Beach Plum Inn, and All-Island Seafood. This concludes the routine inspection schedule for the 2010 season.
CC Construction (for MLR) Installer Permit application: The Board requested Marina Lent to make inquiries with the Dennis Board of Health regarding capabilities and track record of the company prior to approving the installer permit application. Mike Renahan explained that soils on the Cape are significantly less challenging and more uniform than in Chilmark, and a Cape-based company will have to be sufficiently experienced and equipped to address a varied, possibly difficult soil profile in the process of installation.
