Uman Nominee Trust, 20 Ocean View Farm Road (25-99)  Kent Healy discussed a proposed expansion of an existing 3-bedroom capacity septic system, built per plan of April 1998.  Kent Healy proposes adding a leaching trench to enable the owners to add a fourth bedroom.

Mike Renahan noted that the Board is not in possession of a letter from the owners acknowledging the variance on the separation between their well and the neighbor’s leaching pit from 150’ to 104’.

Katie Carroll pointed out that the lot appears to be too small to support a fourth bedroom, since that would require 40K ft2, and the lot is only 39,600 ft2.  The Board suggested that the lot could be re-surveyed to determine whether it has the required size to support a fourth bedroom.

Freedman (25-127)  The Board reviewed a letter regarding the desirability of having a de-nitrifying system in the Chilmark Pond watershed. Marina Lent will make corrections to the letter as specified by the Board.

Scheuer, 2 Chockers Lane (33-4)  The Board approved a revised construction permit submitted by Reid Silva (Vineyard Land Surveying and Engineering), to replace the proposed BioClere de-nitrifying system with a FAST system.

Eddy, 20 Welles Lane (25-7.6)  The Board took note of a Title 5 Official Inspection Report conducted on 8/3/2010 by Doug Cooper.  The inspection passes.

Caldwell, 14 Towhee Lane, (14-36.3) The Board took note of a Title 5 Official Inspection Report conducted on 8/3/2010 by Doug Cooper.  The inspection passes.

Shalhope, 462 North Road (26-48)  The Board reviewed a well completion report and potability test which passes for both primary and secondary standards.

Ruben, 12 Larsen Lane North Fork (27.1-217)  The Board took note of a Title 5 Official Inspection Report conducted on 8/3/2010 by Doug Cooper.  The inspection passes.

Food Establishment Inspections:  Marina Lent reported on food establishment inspections at the Chilmark Tavern and the Homeport Restaurant.   Board members asked Marina to check with the Homeport as to whether the two broken items, the torn screen door at the Back Door and the cooler drawer in the kitchen had been fixed, and, if not, to set a date for completion of these corrections.

The Board expressed concern about the Chilmark Tavern’s “Pantry” option for take-out of food partially prepared but not cooked, as well as some raw bar items, noting that this was clearly contrary to the understanding reached regarding the seafood wholesale license issued to the Tavern last season, under which seafood would be purchased for sale to customers of restaurant meals, not for retail sale from the restaurant.  The Board instructed Marina Lent to write a letter to the Tavern to this effect, and to conduct a follow-up inspection as soon as possible.

Mike Renahan also noted that someone had mentioned to him seeing a person pouring something down the storm drain in front of the Tavern on State Road. He asked Marina Lent to look into the drain.

The Board emphasized that the food establishment inspections required for the 2010 season must be rapidly completed.

Basin Road Lease Agreements  The Board noted that the All-Island Seafood fish market is selling beverages, which violates the lease agreement with the Town.  The Board asked Marina Lent to check into the items approved for sale at Basin Road establishments, and to inform lease holders of any infractions.

Regulation Revision:   The Board reviewed draft language relating to Title 5 flow requirements, and requested that Marina format the new draft sewage treatment and disposal system regulations in a way that shows changes from the Board’s 1992 regulations.

Water Testing of public bathing beaches in Chilmark  The Board stated that ocean beaches in Chilmark will be posted if the 24-hour re-test comes back above the 104 limit for Enterococci.  The Board took note of the fact that consistently high bacterial counts for the Pond at Lucy Vincent Beach have placed it in geo-mean failure.

Updated Fee Schedule  The Board noted that the word “repairs” should be added to the fee schedule line item for “revisions” of sewage treatment and disposal systems, and established a $100 fee for a milk pasteurization license.

Office hours for the Board of Health Office  The Board stated that Marina Lent should attend no more than one Health Agents’ meeting per month, and that out-of-office field work, with the exception of emergencies, should be done only on Tuesdays or Thursdays.  The Board also noted that there should be only one dairy pasteurization inspection per year, upon issuance of the annual Board of Health license, and that the Board of Health office should not conduct inspections that are not mandated by the State.

Invoices  Payment of the following invoices was approved by the Board:

·       Water Treatment I Operator Examination fee  $97
·       Travel to Holliston, MA for Water Treatment Operator class on 8/5/2010 and 8/12/2010, $79.4 x 2 = $158.80
·       VNA July 2010  $ 682.00
