Minutes of February 17, 2010 approved.
Dimovich (12-42) The Board was unable to review the disposal system construction permit application as the engineer, George Sourati, was unavailable to attend the meeting. (Post-meeting approval of the permit was secured following consultation with George Sourati).
4:15pm Public Hearing: Harrison (33-114) The Board opened a public hearing on a disposal system construction permit requiring variances from Chilmark BOH regulations as follows: leaching field to inland wetlands 103’ (150’ required); leaching field to existing leaching facility on A.P. 33-98 248’ (300’ required); reserve area to existing leaching facility on A.P. 33-98 250’ (300’ required). Chris Alley noted that, following rejection by the Conservation Commission, the owners plan to submit a new proposal showing a slightly more modest building footprint. However, the proposed septic system, which includes a FAST treatment unit, would remain unchanged by a smaller building footprint. He also noted that this septic system
proposal requires fewer and smaller variances than the proposal already approved by the Board on January 13 2010, with the existing building in place.
Abutter Everett Poole submitted a letter he had written to the Zoning Board of Appeals on 10 October 1988 regarding a proposed guesthouse at the same site as the proposed system, in which he had noted the fragile nature of the area, proximity to pond and wetland and active otter habitat in the area. The owner at the time withdrew his proposal. Everett Poole stated that he had attempted to measure the proposed separations in the field to confirm the distances to his well. He also submitted a photo, taken just that day, showing standing water at the site of the proposed leaching bed. Chris Alley reviewed soil observation data, and noted that excavation and filling with sand at that site would be undertaken, but that naturally occurring soil below 72” was appropriate for effluent treatment
and disposal.
The Board felt that, prior to continuing the hearing at its next session on April 7th, engineer Chris Alley and Everett Poole should re-measure and confirm the separation distances listed on the plan, and an observation pipe placed to a depth of 10’at the proposed leaching site to confirm level of groundwater table.
Street (14-19.1A) Brooks Billingham came before the Board to present a well location revision for the well. A well completion report was received by the Board on 1/4/2010.
Feiner (21-72) Jim Feiner addressed the Board to follow up on the meeting of January 20, 2010, at which the Board had asked him to locate the inspection report on the system. The inspection report is no longer on file with the inspector, and the homeowner was unable to locate it. However, the proposed outbuilding is not going to have any plumbing; the Board asked Mr. Feiner to establish a deed restriction limiting the property to three bedrooms. Mr. Feiner agreed that this was an appropriate measure for the ¾ acre-sized lot.
Milch (18-63) The Board reviewed the situation where an unlicensed individual, Erin Blair, was found attempting to establish a well with a vacuum pump. On Saturday, March 6, 2010, Chilmark Board of Health member Michael Renahan had been notified of unauthorized well drilling taking place on 17 Wooten Basset Road, a property in the Town of Chilmark belonging to Randal S. Milch and Amelia Salzman. Mike Renahan and Marina Lent went to the site to issue a cease and desist order to Mr. Blair, who explained that he had been operating under the direction of well driller John Clarke of Island Water Source. A licensed driller was not on site.
Well permit 09-30, issued by the Board in connection with this property on September 30, 2009 to Island Water Source, Inc., was for a different location as reflected on the plan dated September 30, 2009 and approved by the Board on that date.
Howland (34-1.6) Chris Alley presented a plan and permit application to upgrade a failed cesspool serving an existing 6-bedroom dwelling. The property is on a shared well. Chris Alley noted that, although the current plan shows a pump chamber, the pump chamber is only necessary because the current plumbing starts low, under the basement slab. He will propose to the owner to have the plumbing re-done to obviate the need for a pump chamber, but the current proposal includes the pump chamber in case it is needed. The Board approved the permit application.
Howland (34-1.5) Chris Alley presented a septic construction permit application for a coastal district property with a proposed 6 bedroom house. The plan meets Title 5 and Chilmark BOH requirements. The Board approved the permit application, subject to receipt of satisfactory well report and potability test.
Flanders (27.1-107) The Board noted receipt of a Title 5 septic inspection report; the system passes.
Ennis (17-23.2) The Board noted receipt of a Title 5 septic inspection report; the system passes.
Jason (20-98.2) as-built letter received, Certificate of Compliance issued.
Wiggins (31-2) The Board received an as-built letter from PE Chris Alley. The Board requires a copy of the owner’s inspection and maintenance contract for the FAST system in order to be able to issue the Certificate of Compliance. The Board requested Marina Lent to inform the current owner of the property that the system cannot be operated prior to receipt of the Certificate of Compliance.
Food Establishment Permit issued to: Ethel Sherman (residential kitchen); Roberta Morgan (residential kitchen)
The Board requested Marina Lent to write a memo to the Town Clerk and other relevant parties, transferring the appointment of Alternate Burial Agent from Jessica Bradlee to Jennifer Christy.
