The minutes of July 23, 2008 and August 6, 2008 were approved and signed.

Mike abstained from the Murphy vote

Ann Murphy (25-23) –  The Board approved this five (5) bedroom residential septic system.

John Klein (32-52 & 53) – The Board approved a five (5) bedroom residential septic for this parcel.

Susan Davidson (34-1.2 & 34-1.1) – This hearing was opened at 5:15 PM.  The engineer is requesting the following variances  1) A reduction in separation from leaching area to wetland from 150 ft to 101 ft,  2) A reduction in separation between leaching area and leaching area in the coastal district from 300 ft to 201 ft. , and is proposing a leaching area on a separate parcel.  The original subdivision was created on April 11, 1988 for the Howlands’ and presented to the Martha’s Vineyard Commission and the Chilmark Planning Board.  The Planning Board granted three vacant lots and three house lots. The total property in Chilmark is 53.1 acres and 8.5 acres in Aquinnah/Gay Head.  The six (6) current lots are 21 acres.  There are 40 acres in conservation.  One lot was given to Woods Hole Oceanographic Institute (WHOI). Part of the sub-division agreement was that there would be no guest houses on these lots, allowing six (6) main dwellings in the sub-division.   What is being proposed is approximately 10 acres per dwelling.  Lot #2 has been assessed as a buildable lot valued at about $4.0 million.  Since 1988 three changes have come into effect; 1) New regulations regarding boundaries of streams and wetlands draining into coastal bodies, 100 ft buffer zone with no septic.  The Squibnocket District regulations in the early 1990’s limit septic systems to be at least 500 feet from the water.   2)  There are drainage changes due to the road location and the tennis court.  3)  The Conservation Commission has a change of opinion in what is useable land.  The technical aspects of the design:  This is a five (5) bedroom house with a FAST reduced nitrogen system (50% reduction in nitrogen); the proximity of the sited leaching area on lot #1 meets the separations to the wetlands and existing septic system on lot 1.  If the ground water flow is going toward the pond and the pressure distribution system works, it will allow a reduction in the size of the leaching area.  A five (5) bedroom house using a reduced nitrogen system is producing about 2 ½ bedrooms of nitrogen.  The Board reviewed two letters received from abutters.  Composting toilets were recommended by Jan Buhrman.  The Board approved this septic system with the following conditions;  1) Must locate well on site plan,  2)  Must locate WHOI well on site plan,  3) A covenant/easement must be recorded and copied to the Board of Health,  4)  The FAST system must have an operation and maintenance contract under general permit (test 1x per year) and four (4) foot buried insulation near D-box.

Simon Huntington (16-16.1) – A letter will be sent to Mr. Huntington instructing him to repair the failed
septic system within 180 days.

The Board noted that a septic inspection report for Gloria Hastreiter (25-7.12) was received and passed.

A letter will be sent to John Powers to thank him for the septic inspections he has done for us and offer any assistance he may need.

Araujo Brothers, Inc – The Board approved this Septage Hauler Permit.

Chilmark Road Race – The Board of Health signed a letter to the Selectmen referencing the need for additional porta-potties at the road race.
 
The Board has instructed Sylvia to send a letter to the Selectmen regarding trash left outside the gate at the transfer station.  The Board would like Brent Bandi to pick up any trash left outside the gate.
 
The Board has reviewed the edited version of the Coastal District Regulations and has requested that it be sent to Michael Goldsmith for final approval.
