Attendees:   Katie Carroll, Mike Renahan, Jan Buhrman, Sylvia Yeomans, Reid Silva, Chris Alley, Frank Fenner, Frank LoRusso

Susan Davidson (34-1.2 & 34-1.1) – This hearing was opened at 5:20 PM.  Jan was not present at the last hearing for this septic plan.  The engineer expressed the owner’s desire to waive the Mullin Rule since she would prefer that all Board members participate in the decision regarding this septic plan.  The Board asked Sylvia to contact Michael Goldsmith to find out if the applicant can waive the Mullin Rule.

The engineer is proposing a leaching area on a separate parcel.  The engineer is also trying to get the lot lines changed so the leaching area can be on the same lot.  This hearing will be continued on 8/20/08 at 5:15 PM.  The hearing closed at 5:45 PM.

Robert H. Nixon (21-79) – This hearing was opened at 5:45 PM.   A new plan was presented for one septic design supporting one dwelling only.  This is an upgrade to an existing system to serve a three (3) bedroom residential dwelling.  There is one variance for four locations as follows;  1) A reduction in separation between leaching  to leaching in the coastal district from 300 ft to 89 ft, 300 ft to 162 ft, 300 ft to 250 ft. and  300 ft. to 254 ft.   Mike Renahan made a motion to approve and Jan Buhrman second.  All in favor, it was approved unanimously.

Frank Fenner/ The Galley, Inc. – Mr. Fenner discussed his concern regarding the cost of frequent pump-outs of his tight tank.  The Board informed Mr. Fenner that the regulations regarding pump-outs are from Title 5, a state requirement.  Katie is not as concerned with collecting the fee, but expressed concern for knowing the condition of septic systems in the town.  Mr. Fenner asked if the Board of Health would consider a reduced fee for pump-outs of tight tanks.  The Board was very receptive to the idea of a discounted fee or an annual permit.  The Board will look into this and if allowed will change the regulation to reflect a change in the fee schedule for tight tanks.

Chilmark Associates (25-5) – The Board approved this well permit application.   The existing well is to be properly abandoned.

David Feinberg (25-20.11) – The Board approved an emergency repair of this septic system.  The pump needs to be replaced.

Saul Gordon (12-32) – The Board approved this emergency well permit application.   All existing wells must be properly abandoned.

Chilmark Firemen’s Association – The Board noted a Temporary Food Permit for the Firemen’s Bash.

Coastal District Variance Regulation Draft – The Board reviewed a draft of this proposed regulation change and said to send it to Michael Goldsmith (Town Counsel) for review.
