Chilmark Board of Health Minutes
June 21,  2006

Visiting Nurse Services Bids B A Public Health Nursing Contract Bid was reviewed in the amount of $9,435.  Mike made a motion to approve,  Jan second, and it was carried.  

Weston Howland III (34-1.3) B This disposal works design does not meet the required wetland setbacks.  This will be held to the next meeting.

Jared Stammell (23-7) B The Board approved a revision to permit #6-30 for a four (4) bedroom  guest house with a 1 bedroom bunkhouse.  The Board also approved a new six bedroom septic design, permit #6-37 for the main dwelling.  The cesspool serving the main house is being abandoned.

Lewis & Whitney Sachs (20-21) B This disposal works design is for a shared septic system.  The engineer must first submit a drawing showing that two Title 5 compliant systems can be sited on the parcel.  If this can be satisfied, then a shared system may be designed.  This will be held to the next meeting.

Honker & Sons LLC / Bill Murray (35-1.2) B The Board approved this disposal works application for a seven (7) bedroom septic design with the following condition; any renovations to the existing house or outbuildings must come before the Board of Health before issuing a building permit.

Pacer Nominee Trust (35-1.15) B The Board approved this disposal works application for a ten (10) bedroom shared system to serve an eight (8) bedroom main house, and a 2 bedroom guesthouse.

Point Inner Trust LLC (33-98, 99, 101) B The Board approved this well permit application with the following variances; a reduction in separation between leaching area and well from 150 feet to 118 feet, and a reduction in separation between the abutter=s leaching area and the proposed well from 15 feet to 125 feet.  The following  condition applies;   The Board has requested notification in writing that the owner is aware that the separations between the well and leaching areas are less than the 150 feet required by Chilmark bylaws.

Roseline Glazer (21-78) B The Board will hold this disposal works application until the ZBA determines if the swapping of use in the buildings (as specified in the June 7, 2006 minutes) makes the new guest house Anew construction.@  The engineer has waived the 45 day deadline.  

Forbes Smiley (20-41) B The Board reviewed two letters that were sent to Mr. Smiley regarding the work required to complete the septic system on this parcel.  

Robert & Francis Labaree (21-36) B This disposal works design requires the following variances; Title 5 Variances:  1) A reduction in separation between cellar wall and leaching area from 20 feet to 13 feet.  
2) A reduction in separation between the coastal bank to leaching area from 50 feet to 35 feet.  3) A reduction in separation between leaching area and high ground water from  4 feet to 3.6 feet.  4) To increase the required slope of an adjacent naturally occurring downhill slope from 3 horizontal : 1 vertical up to 2.23 horizontal : 1 vertical.  (The breakout condition occurs 70 feet away from the leaching field).  Chilmark Variances: 1) A reduction in separation between leaching area and property line from 30 feet to 16 feet.  2) A reduction in separation between leaching area and cellar wall from 20 feet to 13 feet.  3) A reduction in separation between leaching area and neighboring leaching area less than 300 feet.  4) A reduction in separation between leaching area and wetland from 150 feet to 50 feet.  
5) A reduction in separation between leaching area and surface water from 150 feet to 62 feet.   6) A reduction in separation between leaching area and salt water body from 200 feet to 117 feet.  7) A reduction in separation between leaching area and coastal bank from 100 feet to 35 feet.  8) A reduction in separation between leaching area and seasonal high ground water from 5 feet to 3.6 feet.  The Board suggested that the leaching system be sited on the adjoining property also owned by Mr. Labaree.  The Board will make a site visit with the engineer prior to further discussion.  This will be continued at the next meeting.


Board of Health Minutes
June 21, 2006

Bruce & Marcy Slater (20-84) B The Board approved a disposal works application # 06-09 to serve a four (4) bedroom guest house.  This design is a revision to permit # 5-03.

The Board is rescheduling the July 5th meeting to July 12, 2006.  Sylvia will post this date change.

Marin Street (14-19.1) B The Board approved this disposal works application with the following conditions.
1) The septic tank and pump chamber must be waterproof.   2) The engineer must be on-site to verify soils and observe the installation of both tanks.   3) A spare pump must be on-site.  4) A septic alarm must be installed inside both the main house and the guest house.  5) The cesspools are to be abandoned.  6) The Board of Health is to be notified 24 hours prior to construction.   The Board wants to know who did the wetland delineation and find out if the second well is active.

Joel Kozol (35-11 & 35-6) B The Board instructed Sylvia to send a letter to David Damroth (copied to Mr. Kozol) in response to Mr. Damroth=s letter of June 9, 2006.  The deadline specified in the original letters (on April 10, 2006) for these two parcels remain as ordered.  These septic applications were given a deadline of June 28, 2006, because the existing septic systems both failed inspection in 1999.  These dwellings are not to be occupied until the work is completed and a certificate of compliance is issued.

Peter Oberfest (3-47) B It appears that the barn located on this parcel was connected to the septic system without a permit.  The Board has determined that a permit must be obtained at this time.  A qualified engineer must submit a site drawing and application for approval.

Jody Newman & Martin Rosenthal (8-19) B This house was inspected and all orders listed in the letter of
October 7, 2005 have been met.

The following food permit renewals were received and approved:
Summersweet Bed & Breakfast             Summer Film Festival Temporary Food Permit

Chilmark Store tobacco permit renewal was received and approved.

The following sewage disposal system inspection report was received:

The following Aas-built@ letters were received:   
Elizabeth Wiesner (31-12) - This septic system serves a four (4) bedroom house and was installed by John Keene Excavation, Inc..
Brian Cioffi (17-8.6) - This septic system serves a four (4) bedroom house and was installed by Maciel Tree & Land.
Michael Liebowitz (7-53) - This septic system serves a six (6) bedroom house and was installed by Watercourse Construction.
