The Board approved the minutes of April 5, 2006 and April 19, 2006
The Board welcomes Jan Buhrman in her new position as Board Member.
Dexter Young (32-56) B The Board approved this disposal works application.
Joseph Chapman (26-2) B Chris Alley asked the Board if he could connect a pool house to the current septic system. The existing septic system is an old Title 5 design using a 1000 gallon septic tank and the old flow calculations. Since the pool house is new construction, new calculations must be done and trenches added to the leaching area. The septic design must be compliant with the current Title 5 regulations.
Point Inner Trust LLC (33-98, 99, & 101) BThis disposal works hearing was continued at 6:30 PM.
Sylvia confirmed a bedroom count of five. The engineer submitted a new site drawing relocating the ejector pump from the south side of the house to the north side to eliminate a variance of pressure lines to the wetland. He also confirmed the location of the water lines. The Board received a letter from the owner acknowledging the separation between well and leaching area is less than the required 150 feet. Mike made a motion to approve this plan, Katie second and it was carried. The hearing closed at
6:36 PM.
Kerry Elkin (20-46.7) B The Board approved this disposal works application.
George Hadley (4-28) B Glenn Provost discussed designing a septic system using a reduced nitrogen system at this location. The existing approval for this property on October 20, 1993, is for a composting toilet only. Mr. Provost would like to design a new nitrogen reduction system. The Board would be receptive to a design utilizing a new technology to reduce nitrogen loading.
Geoffrey Cowan (27.1-80) B Mr. Povost asked if the Board of Health would consider a Title 5 septic system with a leaching area and reduced nitrogen loading at this parcel. The intent of the owner is to design a shared septic system to support the main house and a guest house. The Chilmark by-laws do not allow a shared septic system unless you are able to show that two Title 5 compliant septic systems can be located on the property. Since this parcel will not support the design of two separate systems, the Board denied this request.
Forbes Smiley (20-41) B Glenn Provost reported Kent Healy=s findings after a site inspection of this septic installation. Mr. Healy said the system must be uncovered and the tank pumped before he can make an accurate assessment of the situation. Mr. Povost will pursue this with Mr.
Healy by exposing the system and doing a complete inspection, after pumping the septic tank.
Marin Street (14-19.1) B The Board reviewed this septic design and requested the following; 1) Schedule 80 pipe is required for the sewer line. 2) There must be a 150 foot separation between the septic tank and the wetland. 3) A ten foot separation is required between the sewer line and water lines. 4) The engineer must show two Title 5 compliant septic systems in order to construct a shared system. 5) The wetlands must be sited on the septic site drawing.

Andrew Marcus (26-90) B The owner wants to change use of the studio to a guest house. The Board determined that he must show two Title 5 compliant systems on the site plan, one system to serve five bedrooms, and one system to serve two bedrooms.
Cornerway Restaurant (30-83 & 84) B The Board signed a letter to Mr. LoRusso explaining that they cannot issue a food establishment permit until Mr. LoRusso has submitted effluent data for calendar years 2004 and 2005. On February 4, 2004 it was determined that Mr. LoRusso would submit effluent reports on an annual basis.
Tom Walsh (25-11) B The Board acknowledged a legal complaint and summons served to the Chilmark Board of Health from Thomas Walsh. This action is an appeal under M.G.L. c 249, sec. 4, seeking relief in the nature of certiorari from a Cease and Desist Order (the ACease and Desist@) issued to Plaintiff, Thomas Walsh, by Defendant Chilmark Board of Health (BOH). The Plaintiffs challenge the issuance of the Cease and Desist by the BOH, as well as their jurisdiction to issue such an order. The Board voted to proceed with litigation on this matter, and instructed Sylvia to speak to Tim Carroll about contacting Town Council.
M. V. Hill (33-115) B The Board of Health has recognized an outside shower on the garage building at this parcel. It was determined at a Board of Health meeting on January 7, 2004 that there is to be no plumbing in this building and it is not to be used as sleeping space. The Board requested a deed restriction be written confirming that the building will not be used as sleeping space. The Board did agree to allow the owner to insulate and sheet rock the second floor of the workshop, to be used for storage. They also agreed
to allow the owner to heat and insulate the building so the first floor could be used as an office. The Board of Health has not received a deed restriction and they would like to gain access to the building to conduct an inspection of the renovations.
The Board requested a memo be sent to the Building Inspector asking if he issued a building permit for the outside shower at the garage, and find out if a plumbing permit was issued for the garage.
Seven Gates Farm / Holiday Parker (3-60) B The Board noted that a sewage disposal system inspection was performed on this parcel on September 30, 2002. The owner was ordered to replace a metal tank with a 1,500 gallon cement septic tank. Although this was a conditional pass and no deadline was given to complete the work, there is no evidence that any work has been done at this time. The Board has asked Sylvia to research this with Deborah Hancock.
Pickett House Bed & Breakfast (30-25) B Elizabeth Pickett-Gray has submitted a renewal application to reopen the Pickett House Bed & Breakfast. Since the reason for vacating the house was due to the furnace explosion and air quality problems, the Board has requested an air quality report be submitted prior to food establishment renewal.
The Board instructed Sylvia to contact DEP and request copies of Menemsha Water Company water testing reports.
The Board instructed Sylvia to do water tests in Menemsha Harbor, June, July, August and September. The Board also suggested that the beach department do the weekly beach testing for the state.

Perc Season B Katie made a motion to end perc season and Mike second. The perc season has ended.
The Board agreed to allow George Sourati to do out-of-season perc tests for the folling parcels;
