Chilmark Board of Health Minutes
April 20, 2005


Attendees: Mike Renahan, Matthew Poole, Sylvia Yeomans, Reid Silva, Peter Wells, Jay Walsh, Carly Look, Mark Hurwitz

The minutes of March 16, 2005, and April 6, 2005 were approved.

Ralph Seferian (20-20) – The Board approved this well permit application.  The permit will be held until Sylvia receives confirmation from Kent Healy, that the well has been staked.

Michael Urban (30-36) – The Board approved a well permit application and the disposal works application for this parcel.

Matt arrived at 6:20 PM

Patrick Lyons (30-116.2) – The Board approved a revision to disposal works permit #04-08.  This revision is dated April 20, 2005.

Mason Walsh (24-220) – The Board reviewed this disposal works application and requested the following prior to approval; 1)  The engineer is to submit specification sheets on the drainage product (Eljin);   
2) Notes regarding the installation should appear on the site plan.  The Board will review this plan again after receiving this information.    

George Fifield (18-108) – The Board approved this disposal works application.  The construction permit is being held for receipt of the well report.  

The Board will keep percolation season open until the next Board of Health meeting on May 4, 2005.

Jay Grossman (8-40) – Carly Look submitted floor plans for two (2) proposed out-buildings to be used in the pool area.  One building will house pool equipment and a small lavatory.  The other building will include a small bar sink, and an under counter refrigerator.  This building is to be used as a small office.   The Board requested a bedroom count be done on the main house and the guest house.  They have also requested an engineer’s site plan showing how the pool house will connect to the existing septic system.  The Board wants an engineer to evaluate how to accommodate additional flow, as this septic system is designed to support only four (4) bedrooms.  During this discussion, the Board discovered that the Building Inspector issued a building permit prior to Board of Health evaluation.  The Board has requested Sylvia to send a memo to Mr. Jason to find out why this was done.

Frank & Tiffany Foster (35-1.28) – Mark Hurwitz presented a floor plan showing the proposed renovation of this dwelling.  There currently is a recirculating sand filter to accommodate a three (3) bedroom house.  The proposed structure will only contain three (3) bedrooms.  The Board has requested that Sylvia research the files and confirm that all conditions originally requested are being met. The Board will review this again at the May 4, 2005 meeting.

Thomas Porter (26-34) - During the transfer and sale of this property, it was determined that the septic system failed because the cesspool was in ground water.  The Board ordered this system to be made Title 5 compliant by March 1, 2005.  Glenn Provost at Vineyard Land Surveying has requested an Board of Health Minutes

extension to the deadline and expects to have a disposal works application submitted to the Board of Health
by May 4, 2005.  Before making a determination on this, the Board would like to know what the anticipated use of the house is.  Does the owner plan to rent it?   It can not be rented in its present condition.  The Board will review this again at their May 4, 2005 meeting.

M.V. Hill (33-115) – The Board denied this disposal works application for the following reasons;
1) The plan does not show the ability to support two (2) Title 5 compliant systems,   2) All sewer lines (either gravity flow or pumped pressure line) are prohibited within 50 feet of any land subject to protection under M.G.L. c. 131 section 40 and described in 310 CMR 10.02 (1).

The Board approved a Disposal Works Installer’s Permit for Kevin Peters.

The Board asked Sylvia to research pump-out records for the Cornerway to see if they obtained a permit for Maciel to pump-out tanks on April 5, 2005.  

The Board noted the following food establishment renewal applications were received;
        Theo’s          Larsen’s Fish Market                    Menemsha Texaco
        Home Port, Inc.

The Board noted the following sewage disposal system inspections:
Quitsa Cliffs Realty Trust (33-76.1) – The guest house passes

The main house is a conditional pass. – The owner must repair or replace the septic tank to the main house and will transition to a pass at that time.  This must be completed by June 25, 2005, and requires a septic permit and an inspection.

Carmine Cerone (8-57) – This sewage disposal system inspection passed

  Various invoices were submitted for approval.
