Chilmark Board of Health Minutes
April 6, 2005

The minutes of February 16, 2005, and March 9, 2005 were approved as corrected.
Aileen & David McGlade (30-55) B After examination of the floor plan, Sylvia determined that there are five (5) bedrooms in the main house and one (1) bedroom over the garage. A total of six (6) bedrooms which does not exceed the disposal works permit design.
Beach Plum Inn B James McDonough explained the renovations the Beach Plum Inn is making to their kitchen. They have poured a new floor and plan to install a walk-in freezer outside. Mr. McDonough also asked if he could move the ice machine outside. The Board approved the new floor and outside freezer. They denied moving the ice machine outside. The Board did approve the food establishment permit renewal.
Joshua Scott (20-47.19) B The Board approved this disposal works application for one detached bedroom.
Robin Shanus (27-3) B The Board approved this well permit application.
Matthew Poole arrived
Thomas Walsh (25-11) B Mr. Walsh wants the Board to reconsider their condition of approval regarding the installation of a new well on this property. The Board requested a good faith attempt by the property owner to come into compliance with Title 5 and not occupy this dwelling without a certificate of compliance. Matt Poole made a motion that the Board stand by the terms of the letter from the Board of Health to Mr. Walsh dated 12/29/04. If the property owner makes timely progress for construction of the well that the Board of Health
will reconsider the potential penalties associated with the violations stated in the 12/29/04 letter. Katie Carroll seconded the motion and it was unanimously voted.
Blue Sky, LLC (18-92) B The Board approved this disposal works revision to permit #01-54.
Karen K. Joba (7-9) B The Board approved this disposal works application.
William Bingham (27.1-221) B This disposal works application requires the following variances; 1) A reduction in separation between leaching area and wetland from 150 feet to 50 feet., 2) A reduction in separation between leaching area and property line from 30 feet to 23 feet. The Board requested siting the well located on assessors= parcel 27.1-222 and listing it with the variances. A hearing is scheduled for May 4, 2005 at 7:00 PM.

Robert Kenney (4-20) B The Board approved this disposal works application.
Pepperbush Farm (13-61) B The Board received a letter from Craig Wiggins and a site plan stamped by Glenn Provost for a subdivision of this property. This application is incomplete and not valid for the following reasons; 1) There is no Appendix B Form C Application for Approval of a Definitive Plan, 2) No soil data was submitted with the plan. Since the Board of Health has not received a valid subdivision application containing all data necessary to make a determination, we cannot respond and the 45 day response period does not apply.
Refuse District Representative -- The Board reviewed a letter received from Alex Preston requesting reappointment to the position of Chilmark Representative to the Refuse District. Mike made a motion to appoint Alex Preston to this position and Katie seconded the motion. The Board voted in favor and appointed Alex Preston to a two year appointment as Chilmark Representative to the Refuse District that expires in September of 2006.
Chilmark Landfill Project B The Board suggested using a cell phone at the landfill shack. We will research a municipal plan for a cell phone. Cingular was suggested as a possibility.
The Board conducted a performance review for the Health Inspector.
