CHILMARK PERSONNEL BOARD MEETING NOVEMBER 16, 2006

CALL TO ORDER: 8:05 AM
PRESENT: Members Jennie Greene, Susan Heilbron, Richard Williams and Max McCreery. Also present: Staff Liaison Polly McDowell, Chuck Hodgkinson and Selectmen’s Liaison Riggs Parker. Absent: Executive Secretary Tim Carroll.
MEETING MINUTES: The 11/2/06 meeting minutes were reviewed and discussed. Ms. Heilbron made a motion to approve the minutes as amended. Mr. Williams seconded and the vote was unanimous in favor.
DECEMBER 7TH PERSONNEL BOARD MEETING: The regularly scheduled December 7, 2006 Personnel Board meeting will be canceled due to schedule conflicts and re-scheduled for Wednesday, November 29 @ 8:00 AM. Chuck H. will post the changes accordingly.
DRAFT EMPLOYEE ADMINISTRATION POLICY: Ms. Heilbron reviewed Ms. Greene’s email comments on draft # 7 of the Employee Administration Policy. After discussion the Board agreed the following must be clarified: 1. Who is an employee’s evaluator? 2. Who appoints a designated evaluator? 3. What is the purpose of the three-month oral evaluation that takes place during a new employee’s six-month probationary period? 4. What is the role of the evaluator in this three-month oral review? 5. Clarify whether or not a current permanent employee who accepts a promotion to a new job must satisfactorily complete an additional six-month probationary period in the new position. It was discussed that in theory, an employee could be promoted
beyond their capabilities as a means to “force them out” of the Town’s employ.
After further discussion Chuck H. was asked to obtain an opinion from town counsel on the following questions:
1. Clarify whether or not a current permanent employee who accepts a promotion to a new job must satisfactorily complete an additional six-month probationary period in the new position. It was discussed that in theory, an employee could be promoted beyond their capabilities as a means to “force them out” of the Town’s employ.
2. If a current Town employee has attained permanent employee status and accepts a new employment position with the Town, what rights has this employee earned as an existing permanent employee that will carry over to the new position?
3. If an employee leaves the town’s employ for a period of time and thus does not have continuous employment, what are this employee’s rights as they specifically pertain to: Vestment in the county retirement plan; Vestment toward the ten-year requirement to continue receiving subsidized town medicals benefits upon retirement. Section 14.0 of the Personnel Bylaw refers to MGL Chapter 32B with regard to Group Health and Life Insurance.
SHELLFISH CONSTABLE JOB DESCRIPTION: The Board reviewed Mr. Carroll’s memo dated 11/9/06 about the formation of the Shellfish Restoration Committee. After much discussion the Board agreed to send its comments to the Board of Selectmen regarding: 1. The member composition of this committee and how it should include someone with shellfish knowledge of all of the Town’s shellfish resources and ponds. 2. Its opinion that the Board of Selectmen should appoint a Chairman for the committee. Chuck H. will draft the memo before Friday, November 17.
