Conservation Commission Minutes 08/01/18

Present for the Conservation Commission and attending the meeting were:  Bob Hungerford, Vice Chairman, Candy Shweder, Sandy Broyard, Pam Goff, Russell Maloney, Maureen Eisner and Chuck Hodgkinson.  Chris Alley and Jerry Kauff also attended.  Chris Murphy and          Joan Malkin did not attend.   

The meeting came to order at 12:30 PM.  Mr. Hungerford assumed the Chair and appointed Alternate Commissioner Mr. Maloney as a voting member.

CONTINUED PUBLIC HEARING NOI SE 12 – 818; CHRIS ALLEY FOR MARJORIE SCHEUER; 7, 14 Herring Run; AP 34-4.1, 4.3:  Mr. Hungerford opened the continued public hearing at 12:31 PM and confirmed all Commissioners are eligible voters.  Mr. Alley reviewed a revised site plan dated 7/23/18 to install two new water wells and two FAST De-Nitrifying Septic systems.  One well is 40 feet from the top of the Coastal Bank to Menemsha Pond and 45 feet from a wetland draining into the Menemsha Pond.  The second well is outside the buffer zone but, the trenched water line is within the buffer zone.  The two septic system leaching fields are 50 feet from a large wetland draining into Menemsha Pond and 80 feet from the top of the Coastal Bank of Menemsha Pond.  He reminded the Commission the Board of Health required two separate leaching fields as one will serve the house on a separate lot that is planned for subdivision.

He added the Commission asked for an alternatives analysis for one well and septic location to see if they could be relocated outside the buffer zone.  Mr. Alley explained he did additional septic system soil tests in a potential alternative location.  The tests revealed the area was glacial till and did not meet the Board of Health standards.  The Commission thanked Mr. Alley for the alternatives assessment.  With no public comment a motion was made to close the hearing at 12:40 PM.  The motion was seconded and unanimously approved.  A second motion was made to approve the revised site plan dated 7/23/18 as presented with the following special conditions:
  • Silt fencing shall be installed between the well in the buffer zone and the wetland and approved by the Conservation Agent before work begins.  
  • The excess excavation spoils shall be removed from the site.  
  • The trenching spoils shall be placed on the upland side of the trenches to contain erosion during a rain storm.
The motion was seconded and with no further discussion passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 742; PRISCILLA LAVIN; 1 North Slope Lane; AP 14-19.1:  Chuck H. explained an Order was issued in 2015 to construct an addition, a new dry-laid blue stone patio and a stone retaining wall with re-landscaping.  He presented photographs of the finished work and recommended the project is in complete compliance with the Order.  A motion was made to accept the recommendation and issue the Certificate.  The motion was seconded and unanimously approved with six in favor.

DISCUSSON JERRY KAUFF; AP 31-11.2:  Chuck H. explained in August 2017 a negative Determination of Applicability was given to Mr. Kauff to open a water view by removing several trees located on Zach Wiesner’s land under CR—AP 31-11.2.  The CR allows the removal of trees and shrubs if done in accordance with accepted forest, pasture, horticulture or agricultural practices.  A few trees were within the 100-foot buffer zone of the Top of the (heavily vegetated) Menemsha Pond Coastal Bank.  They were specially conditioned and removed using hand held power tools, stumps left in place, no heavy machinery was used and no paths were cut.  The work was done in the fall – after bird nesting season.  Mr. Kauff explained he would like to remove a total of eight more trees in two separate locations.  Mr. Wiesner has consented.  The Commission reviewed the photographs of the area and the two locations.  There is extensive tree growth.  After brief discussion a motion was made to allow Mr. Kauff to remove the additional trees under the existing Determination of Applicability provided the Conservation Agent visits the site and approves the tree removal and, the existing conditions are still enforced.  The motion was seconded and unanimously approved with six in favor.

The draft July 18, 2018 meeting minutes were reviewed and approved as presented by consensus.
