Conservation Commission Minutes 09/21/16
FINAL

Present for the Conservation Commission and attending the meeting were:  Joan Malkin, Vice Chairman, Maureen Eisner, Pam Goff, Sandy Broyard, Bob Hungerford, Chris Murphy and Chuck Hodgkinson.  Jimmy Morgan also attended.  Russell Maloney and Candy Shweder did not attend.  

The meeting came to order at 12:30 PM.   Ms. Malkin assumed the role of Chair for the day’s agenda.

FOLLOW UP DISCUSSION JIMMY MORGAN FOR CHIP PHILLIPS; LARSEN LANE LLC; 19 Larsen Lane; AP 27.1-57:  Mr. Morgan explained an RFD was reviewed in February 2016 to do the following:  Brush cut the rear property to the lot lines; remove dead trees and vines and spread seed.  The root structure for the brush will remain intact as no tilling will be done.  The closest activity is approximately 15 feet from the wetland edge.  He continued by saying that as requested, the wetlands were flagged by Doug Cooper.  Mr. Morgan then presented the site plan dated 9/21/16 showing the wetland delineations.  The Commission accepted the delineations.  The Commission then discussed several options that would allow the owners to use more of their yard without having an adverse impact on the wetlands.  A consensus was reached and a motion for a negative determination was made with the following special conditions:  1. The area shown on the plan 20' from the wetland edges is a no cut/no mow zone.  This area may only be pruned to a height no lower than four feet to preserve the view.      2. The area shown on the plan from 20' - 50' from the wetland edges shall be cut/mowed only twice/year.  3. The area beyond 50 feet from the wetland edges may be cut/mowed more than twice/year.  4. The limits of the 20' no cut and 50' cut twice/year zones shall be permanently marked with rocks.  The motion was seconded and passed unanimously with six in favor.  

CERTIFICATE OF COMPLIANCE SE 12 – 766; REID SILVA FOR CHLOECO HOLDINGS; 20 David’s Way; AP 21-21.1, 22:  Chuck H. explained an Order was issued in April 2016 to stabilize an eroding coastal bank on Vineyard Sound by planting American Beach Grass one foot apart on the coastal bank.  Approximately 160 linear feet of bank was planted.  After reviewing several photos he recommended the project is in full compliance with the on-going conditions # 1, 3 as outlined in the Order:   No coastal engineering structure is allowed; any maintenance plans shall be reviewed by the Commission or its designee before the maintenance work begins.  A motion was made to accept the recommendation and issue the Certificate.  The motion was seconded and unanimously approved with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 223; JILL A. GOODMAN, TRUSTEE;                     72 Cobbs Hill Rd.; AP 11-25.1:  Chuck H. shared photos for an Order issued in 1994 to build a ramp and two seasonal float docks.  The property is being sold and a Certificate of Compliance has been requested.  After sharing photos he recommended the project is in full compliance with the on-going conditions # 16, 17, 18:  only 2 floats are allowed for a total length of 34 feet; the ramp and float dock shall be removed by hand and stored on top of the fixed deck by November 1 of each year and installed no sooner than April 15 each spring.  Floats are to be cleaned only with water and no anti-fouling paint shall be used on any part of the structure.  A motion was made to accept the recommendation and issue the Certificate.  The motion was seconded and with no further discussion passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE AMENDED SE 12 – 749; REID SILVA FOR SCHEUER FAMILY PROPERTIES; 2 Chocker’s Lane; AP 34-4.2:  Chuck H. explained a partial Certificate was issued to remove AP 33-5 from the scope of work.  This Certificate is for the amended plan for a walking path and beach stairway to Menemsha Pond that were cleared and built on AP 34-4.2.  He shared photos and recommended the project is in full compliance with the on-going condition # 1, 2, 4 from the Order:  No mowing of path along the bank to the second set of stairs to the east; any stairway maintenance plans must be reviewed by the Commission or its designee before work begins; The Order is valid provided all conditions are met at all times.  A motion was made and seconded to accept the recommendation.  The motion passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 380; JAMES HORNBLOWER;                    78 Squibnocket farm Rd.; AP 35-1.1:  Chuck H. explained an Order was issued in Y2K to upgrade the septic system.  The property was sold and they need to close out the open Order.  He said the Commission has been to the site several times recently and recommended full compliance as the system is operating and passed the BOH inspection.  A motion was made to accept the recommendation.  The motion was seconded and passed unanimously with six in favor.
