Conservation Commission Minutes 07/20/16
FINAL

Present for the Conservation Commission and attending the meeting were:  Candy Shweder, Chairman, Maureen Eisner, Pam Goff, Bob Hungerford, Sandy Broyard, Joan Malkin and Chuck Hodgkinson.  Also attending were Reid Silva, Carlos Montoya, Peggy Weis, Lil Province and Zach Wiesner.  Russell Maloney and Chris Murphy did not attend.  

The meeting came to order at 12:30 PM.

NOI SE 12 - 772; REID SILVA FOR RANDOL & MARGARET WEIS; 76 Old Farm Road; AP 7-19:  Ms. Shweder opened the public hearing at 12:34 PM.  Mr. Silva explained the history of the property and how the owners would like to build an addition to an existing house within the buffer zone of a Bordering Vegetated Wetland.  The existing dwelling is 59 feet from the wetland edge and the closest part of the addition is 68 feet from the wetland edge.  The current dwelling has a basement foundation and the addition will have a crawl space foundation.  The meeting minutes from 1998 were reviewed which indicated the wetland edge may in fact be farther from the structure than delineated on the site plan.  With no public comment a motion was made to close the hearing at 12:42 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the plan as presented with the following special conditions:   1.  There shall be no further clearing in the direction of the wetland.  2.  The staging area shall be located in the driveway.  3.  A crawl space foundation shall be installed under the addition.  4.  Construction fencing shall be installed along the limit of work as shown on the site plan to contain construction activity.  The motion was seconded and with no further discussion passed unanimously with six in favor.

RFD LIL PROVINCE FOR ZACH WIESNER; AP 31-11.1:  Ms. Province explained         Mr. Wiesner would like to open and maintain a view channel for 31 Meadow Lane; Map 30 Lot 76.1 by selectively pruning a total of ten trees on property that is protected under a Conservation Restriction (CR) on Map 31 Lot 11.1.  The Commission reviewed the CR conditions which allow tree work if done in accordance with standard forestry practices.  Mr. Wiesner added the entire area was originally an expansive open meadow.  After brief discussion a motion was made for a negative determination with the following on-going condition:  The view channel and pruning of these ten trees may be maintained provided the maintenance plans are reviewed with the Conservation Commission or its designee before the work is done.  The motion was seconded and passed unanimously with six in favor.

DISCUSSION SE 12 – 746; CARLOS MONTOYA FOR FRANK SICA; 16 Crick Hill Rd.; AP 27.1-121:  Mr. Montoya explained an Order was issued in 2015 to repair the coastal bank that was damaged by a storm and relocate a boulder that was in a position to roll into the boathouse.  The bank stabilization is very successful as evidenced by the photos.  Mr. Montoya said he would like to do the same on the bank where the boulder was relocated.  Jute netting will be staked to contain erosion until the terraced planting can be done.  The Commission thought the current revegetation is quite successful.  A motion was made to declare the proposed change as inconsequential.  The motion was seconded and unanimously approved.  A second motion was made to approve the additional planting as proposed.  This motion was seconded and unanimously approved with six in favor.

DISCUSSION SE 12 – 767; REID SILVA FOR BRICKYARD FIELDS LLC; 0 Brickyard Rd.; Map 9 Lot 2.10:  Mr. Silva explained an Order was issued in April 2016 to install buried power lines below the overhead lines. The trench will be done by a boring machine.  A different, unknown, buried power line was cut during work and temporarily spliced.  The owner would like to replace the spliced power line that runs through an existing underground vault.  He added a mini excavator will be used for this section of trenching.  After brief discussion a motion was made to declare the change as inconsequential to the original approved plan.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the request as presented.  The motion was also seconded and unanimously approved with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 516; RICHARD SCHEUER AND AMY COHEN; 267 State Rd.; AP 33-5:  Chuck H. explained an Order was issued in 2006 for a seasonal float dock located on the end of the fixed pier that was certified at the June 15 meeting.  Photos of the installed seasonal float dock were reviewed and Chuck H. recommended the project as in full compliance with the following on-going condition:  1. The seasonal float shall be installed after April 15 and removed before October 15 each year.  A motion was made and seconded to accept the recommendation.  The motion then passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 749; RICHARD SCHEUER AND AMY COHEN; 267 State Rd.; AP 33-5:  Chuck H. explained this is the original Order that was replaced with Amended SE 12 – 749 to build a set of stairs to the beach on Menemsha Pond.  He added that the amended Order has no work proposed on Map 33 Lot 5 and recommended nullifying the original Order for Map 33 lot 5.  This Certificate is needed to release Map 33 Lot 5 from the Order.  A motion was made to accept the recommendation.  The motion was seconded and passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 659; GRIN ACRES FAMILY LTD. PARTNERSHIP; 15 Nickerson Farm Rd.; AP 21 – 10, 12, 13:  Chuck H. outlined that this Order was issued in 2012 to re-vegetate a meadow with a wetland and stream that was cleared without a permit.  The work was done by Wilkinson Ecological Design.  Semi-annual progress reports were submitted as conditioned for the first three years.  The meadow plantings are fully established and he recommended full compliance with on-going conditions of #3, #5, #6; Plus, on-going hand weeding of invasive species and nuisance plants and two mowings are allowed each year -- before April 1 and after August 1.  A 10-foot no cut zone bordering both sides of the stream shall also be maintained.  A motion was made and seconded to accept the recommendations.  The motion then passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 409; JAMES HORNBLOWER; 18 Spruce Gate Rd.; AP 35-1.7, 1.8, 1.9:   Chuck H. explained a second Order was issued in 2015 for view clearing and maintenance which was declared in compliance at the June 15 meeting.  This is the original Order for the view clearing project in Squibnocket Farm.  This Certificate is needed to release this parcel from the original Order.  He recommended full compliance with the note that this Order is replaced with SE 12 – 712.  A motion was made and seconded to accept the report.  The motion also passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE SE 12 – 735; CHRISTINA LURIE; 2 Gosnold’s Way; AP 14 - 1:  Chuck H. explained an Order was issued in 2015 to reconfigure the footprint by moving a bedroom from the back of the house to the northeast side, renovate the house, install a new foundation under the main house and install a basement foundation under the relocated bedroom.  A screened porch will be added on top of the existing deck to the north.  The activity is within the 100-foot buffer zone of the top of the coastal bank on Vineyard Sound.  He added that there is a Notice of Intent (NOI) for this property scheduled for the August 3 meeting.  The Commission said this Certificate should be postponed to August 3 so all may see the new house during the NOI site visit.
