Conservation Commission Minutes 11/04/15
FINAL

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Chairman, Candy Shweder, Vice Chairman, Maureen Eisner, Joan Malkin, Chris Murphy, Bob Hungerford, Pam Goff and Chuck Hodgkinson.  Reid Silva and Josh Scott also attended.  

The meeting came to order at 12:30 PM.

NOI SE 12 – 751; REID SILVA FOR FREDERICK N. KHEDOURI; 10 Harbor Hill Road; AP 27.1-101:  Ms. Broyard opened the public hearing at 12:31 PM.  Mr. Silva explained this renovation was approved in 2007 but the work was never done.  This new application does not propose to use a barge to lift the shack off its foundation and place it onto a new one – as presented in 2007.  The scope of work will repair and maintain the existing boathouse and pier on Menemsha Basin.  Several spiles will be replaced on the house foundation and pier.  The new owner would also like to prune the vegetation around the boathouse and access stairs.  Mr. Silva added the dock has a Chapter 91 license for the area of the dock that is over land under water.  The Commission inquired about detailed methods and materials for the work and how the site will be managed during construction.  With no public comment a motion was made to close the hearing at 12:50 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the site plan dated 9/21/15 with the following special conditions:

  • The approved scope of work shall include:
  • The footprint of the shack, deck and dock shall not change.
  • Replace six piles:  4 on the deck and 2 for the dock nearest the deck.
  • Remove non-functional supports for the shack and deck including timber piles, concrete blocks, and stones.
  • Replace and install a functional support system of pin footings or an approved equivalent such as butterfly brackets.
  • The deck, stairway, ramp, exterior shingles, roof and windows will be replaced.
  • Interior renovations will also be done.
  • The bittersweet vines on the sides and rear of the shack will be pruned off the building.  The root structures shall remain in place.
  • The materials staging area shall be located at the roadway level, away from the top of the bank.
  • All debris shall be stored in a covered dumpster located at the roadway level or removed from the site on a daily basis.
  • A tarp shall be secured to the deck and side of the shack facing the water to prevent any construction materials or debris from falling into the bank or water.  This tarp shall be approved by the Conservation Agent (CA) before work begins.
  • Tarps shall be installed on both sides of the shack to also prevent any construction materials or debris from falling into the bank or water.  These tarps shall be approved by the CA before work begins.
  • An on-site meeting shall take place among the CA and contractor(s) to review this Order before work begins.
  • A copy of this Order shall be on site at all times during construction.
The motion was seconded and with no further discussion passed unanimously with seven in favor.
NOI SE 12 – 752; REID SILVA FOR YOU DIRTY RAT, LLC; 227 North Road; AP 14-9:  Ms. Broyard opened the public hearing at 12:58 PM.  Mr. Silva reviewed a site plan dated 10/9/15 to reconstruct and replace the existing bridge over Roaring Brook and re-grade and maintain the existing roadway.  Concrete abutments will be poured to support the new bridge deck.  The activity is over the shore of a perennial stream and within the 100-foot buffer zone and first 100 feet of the Riverfront area.  Mr. Silva added the current timber bridge will be replaced with a 12-foot wide concrete bridge that will be 21 feet long with hardener dense mix on top of the deck.  The façade and side rails of the bridge will be granite for aesthetic purposes.

The Commission inquired at length about the methods, how the site will be contained and resources protected during construction and how the roadway’s water runoff will be managed on both sides of the bridge.  After much discussion and with no public comment a motion was made to close the hearing at 1:17 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the site plan dated 10/9/15 with the following special conditions:  1. The bridge as proposed with a 21-foot span; 12-foot surface width and 14-foot exterior width is approved.  2.  Before work begins the applicant shall return to the Commission with a detailed plan for managing road surface water runoff at least 100 feet on both sides of the bridge.  A combination of water bars, specific roadway surface material and a roadway sides drainage system and material shall be considered.  A construction erosion control system shall also be presented.  3.  An on-site conference shall take place among the applicant, contractor and Conservation Agent to review the scope of work, erosion controls and this Order before work begins.  The motion was seconded and with no further discussion passed unanimously with seven in favor.  
 
CERTIFICATE OF COMPLIANCE SE 12 – 698 GRAEME FLANDERS; Tucker Trail;              AP 33-94:   Chuck H. explained an Order was issued in April 2014 to install an elevated walkway from an existing boathouse and runs over a salt marsh on Quitsa Pond.  Several photos of the finished work were reviewed and Chuck H. recommended the project is in full compliance with an on-going condition stating any future walkway maintenance plans should be reviewed with the Conservation Agent before work begins.  A motion was made and seconded to accept Chuck H’s recommendation.  With no discussion the motion passed unanimously with seven in favor.

DISCUSSION SE 12 – 752; REID SILVA FOR THE TOWN OF CHILMARK; Squibnocket Road; AP 35-1.30, 17.3, 17.4, 23:  Mr. Silva explained the first archaeological survey revealed possible significant Native American artifacts.  A second, more detailed survey is required by the Massachusetts Historical Society that will need excavation where the proposed parking lot retaining wall is planned.  The digging will be done with an excavator.  It will scrape small sections six-feet wide to a depth of about 12-18 inches.  The sediment will be evaluated and immediately replaced.  Siltation barriers will be installed between the work area and wetland.  The Commission thought this is a temporary disturbance that is within the scope of work for the project.  A motion was made to declare the second archaeological survey as an inconsequential change to the Order.  The motion was seconded and unanimously approved with seven in favor.  A subsequent motion was made to approve the work as described with the condition that the Conservation Agent shall be on site during the work.  This motion was seconded and unanimously approved with seven in favor.

ADMINISTRATION:

The October 21, 2015 meeting minutes were reviewed and approved as presented by consensus.
