Conservation Commission Minutes 01/21/15
FINAL

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Chairman, Pam Goff, Joan Malkin, Bob Hungerford, Maureen Eisner and Chuck Hodgkinson.  Reid Silva and Kristen Fauteax also attended.  Wesley Cottle, Chris Murphy and Candy Shweder were absent.        

The meeting came to order at 12:30 PM.  Ms. Broyard appointed Alternate Commissioner Eisner as a voting member for the day’s agenda.

RFD KRISTEN FAUTEUX FOR SHERIFF’S MEADOW FOUNDATION; North
and Old Farm Roads; AP 3-4, 14:  Ms. Fauteux explained they would like to cut vegetation along the edge of the Mill Brook for the purpose of a one-time survey to locate and assess the stream bed.  The work will be done on Sheriff’s Meadow Foundation’s Roth Woodlands property and the parcel owned by the Island Grown Initiative (formerly owned by the Dunkl family) over which SMF holds a Conservation Restriction.  She added this is being done at the request of IGI and the Dunkl family.  After brief discussion a motion was made for a negative determination.  The motion was seconded and unanimously approved with five in favor.

CHRISTMAS TREE CUTTING:   Ms. Fauteux also explained that the Foundation would like to host a free Christmas tree cutting event next year on their Roth Woodlands property near the Inn at Blueberry Hill.  The spruce trees will be offered.  The Commission agreed this one-time activity will not harm the resource buffer zone.

FARMING ON WADE’S FIELD:  Ms. Fauteux also asked for advice regarding Wade’s Field between Wade’s Cove and Gilbert’s Cove.  Wade’s Field is NHESP habitat and the Foundation would like to seek proposals to allow farming on this property.  She explained some of the land is also in the cove’s buffer zone and within the 100-year flood zone.  The Commission asked if animals or crops will be farmed.  Ms. Fauteux said they are seeking proposals for either option.  The Commission decided it cannot offer any advice until it reviews a specific plan.

NO1 SE 12 - 728; REID SILVA FOR JEROME AND CAROL KENNEY; 45 Beach Road; AP 2-3:  Ms. Broyard opened the public hearing at 12:52 PM.  Mr. Silva reviewed the plan to excavate, trench, backfill and maintain a 4 inch PVC foundation drain running to a gravel diffusion trench.  The work is within the 100-foot buffer zone of a Bordering Vegetated Wetland.  The closest activity is approximately 1 foot from the wetland edge.  A portion of the proposed driveway is also within the wetland buffer zone.

He explained several changes on the site plan dated 1/21/15 he made after yesterday’s site visit:  Three drain pipes are proposed for redundancy instead of one; a settling basin will be added between the foundation area and the end of the drainage plan to capture any silt that may travel through the system; a temporary settling tank and pump drainage system will be installed outside the buffer zone to help with drainage during construction.  Richie Olsen will do the work.

After discussion and with no comment from the public a motion was made to close the hearing at 1:10 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the changes and plan as proposed with the following special conditions:  1.  The installation of three 4” permanent drainage pipes; a 3’ deep X 6’ diameter settling basin and a temporary pumped drainage system with settling tank located outside the buffer zone as shown on the revised site plan dated 1/21/15 are approved.  2.  The Conservation Agent (CA) shall approve the installed siltation barrier system and the temporary drainage system before it is backfilled and before work begins on the permanent system.  3.  The CA shall inspect the installed permanent drainage system before the excavation is backfilled.  4.  All excavation spoils shall be removed from the site daily.  5.  A copy of this Order shall be available on site at all times.  The motion was seconded and with no further discussion passed unanimously with five in favor.

LANGMUIR SUNRISE CAMP LTD. PARTNERSHIP ORDER OF CONDITIONS;
SE 12 – 686; 26 Greenhouse Lane; AP 33-71:  Chuck H. reviewed the proposed lawn area and no cut area between the lawn and wetland edge as specified in the Order of Conditions.  The area is expected to be planted in May-June 2015.  After brief discussion a motion was made to approve the plan.  The motion was seconded and unanimously approved with five in favor.
  
ADMINISTRATION:  
        
The January 7, 2015 meeting minutes were reviewed and approved as presented by consensus.  

The $3,000 invoice from Dan Perry, Esq. for the Fool’s High Tide, LLC appeal was unanimously approved for payment out of the Commission’s Wetland Defense Fund.
