Conservation Commission Minutes 12/03/14
FINAL

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Chairman, Candy Shweder, Vice Chairman, Pam Goff, Chris Murphy, Joan Malkin, Bob Hungerford Chuck Hodgkinson.  Reid Silva, Kristen Reimann, Mark Hurwitz and Marni Lipke also attended.  Wesley Cottle and Maureen Eisner were absent.        

The meeting came to order at 12:33 PM.  

NOI SE 12 - 724; REID SILVA FOR KEITH MCNALLY; 34 Windy Gates Rd.;   AP 30-104.1:  Ms. Broyard confirmed all present Commissioners are eligible voters and  opened the continued public hearing at 12:34 PM.  Mr. Silva reviewed a revised site plan dated 12/3/14 to cut trees and brush; remove organic material for a 48’ X 18’ built-in swimming pool; excavate for the pool; locate a pool equipment shed and build a pool deck; trench for water filtration and electricity and construct a 4-foot high pool enclosure.  The chicken coop and fencing were relocated from the wetland edge to a location 26 feet from the wetland.  The goat shed that will become the pool equipment shed was also relocated adjacent to the studio.  This will not require as much trenching as the original location.  The closest point of excavation is 67 feet from the wetland; the pool and decks are 94 and 86 feet from the wetland edge respectively.  Silt fencing and hay bales will be installed along the perimeter of the proposed pool enclosure.  Ms. Lipke asked about the pool water treatment system.  Mr. Silva said it will be a saline ion-based system that does not use chlorine.  After discussion and with no further comment from the public a motion was made to close the continued hearing at 12:46 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the revised plan as presented and dated 12/3/14 with the following conditions:  1.  Silt fencing and hay bales shall be installed along the proposed pool enclosure as shown on the site plan and approved by the Conservation Agent (CA) before work begins.  2.  Construction fencing shall be installed along both sides of the vehicle access to the site and approved by the CA before work begins.  3.  The pool shall be filled from an off-site water source.            4.  Any pool water backwashing or removal shall be discharged outside the wetland 100-foot buffer zone.  5.  The pool water shall be treated with a non-chlorinated, saline-ion system.  Any alternative system shall be approved by the Commission.  The motion was seconded and with no further discussion passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE NANCY KIDD; SE 12 – 149; 11 Greenhouse Lane; AP 33-151:  Chuck H. explained this Certificate is for an Order of Conditions issued on January 26, 1998.  An addition to the house was built and recommended as in full compliance.  A motion was made to accept the report and declare the project in full compliance.  The motion was seconded and unanimously approved with six in favor.

CERTIFICATE OF COMPLIANCE NANCY KIDD; SE 12 – 687; 11 Greenhouse Lane; AP 33-151;  Chuck H. reviewed photos for an Order of Conditions issued on    April 19, 2013 for a patio and spa installation and replacing a deck with three steps at the main entrance.  He recommended the project is in full compliance.  A motion was made to accept the report and declare the project in full compliance.  The motion was seconded and unanimously approved with six in favor.
 
ADMINISTRATION:  

Review of the November 19 meeting minutes was postponed to the next meeting.  
        
The draft FY 2016 budget was reviewed.  A motion to approve the budget was made, seconded and unanimously approved.

Ms. Malkin reviewed a draft Bylaw regulation designed to establish guidelines for altering vegetation in buffer zones of great ponds.  It was discussed whether or not this should be expanded to include the buffer zones for all ponds and the 100-foot buffer zone of perennial streams.  Other updates to existing regulations were also discussed.  It was agreed that Ms. Malkin and Chuck H. will amend the new draft vegetation regulations and review all other Bylaw regulations that may need amending.  Eventually the Commission will advertise a special public hearing for any changed or new regulations.

The Fool’s High Tide, LLC Appeal for SE 12 – 705; AP 32-68.1 was discussed.       Chuck H. relayed Ron Rappaport’s recommendation to work with Dan Perry, Esq. of  Perry, Hicks, Deshaies and Mello, LLP out of New Bedford.   Ron has a conflict of interest and cannot represent the Town.  Mr. Perry is Town Counsel for the Town of Gosnold.  After much discussion a motion was made to ask Mr. Perry for an opinion.  The motion was seconded and unanimously approved.
