Conservation Commission Minutes 10/15/14

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Chairman, Candy Shweder, Vice Chairman, Pam Goff, Bob Hungerford, Chris Murphy, Maureen Eisner and Chuck Hodgkinson.  Marin Street also attended.  Wesley Cottle and Joan Malkin were absent.        

The meeting came to order at 12:30 PM.  Ms. Broyard appointed Alternate Commissioner Ms. Eisner as a voting member for the day’s agenda.

NOI SE 12 –715; MARIN STREET; 1 Crowberry Lane; AP 14-19.5:  Ms. Broyard opened the public hearing at 12:31 PM.  Mr. Street reviewed the plan to install a duplicate set of buried utility lines in an existing right of way and roadway that already has a set of buried utility lines feeding another lot.  The roadway and trench goes through a Bordering Vegetated Wetland.  Approximately 200 sq. ft. of the roadway within the wetland will be temporarily disturbed for the trench.  The Commission reviewed the NHESP report which had no conflicts with the proposal.  After brief discussion about the site visit observations and with no comment from the public a motion was made to close the hearing at 12:39 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the plan as presented with the following conditions:  1. Plastic silt fencing shall be installed along both sides of the roadway abutting the wetland and left in place until the roadway is returned to its original state.     2.  The Conservation Agent shall approve the silt fence installation before work begins.  The motion was seconded and with no further discussion passed unanimously with six in favor.

ADMINISTRATION:  

The September 17 and October 1 meeting minutes were reviewed and approved as presented by consensus.  The Commission asked Chuck H. to begin searching for an attorney – should one be needed for the Fool’s High Tide appeal.

Chuck H. read the Town’s new policy for Conservation Restrictions as adopted by the Selectmen.  It states:  The Town of Chilmark will not sign off on any new Conservation Restrictions that do not name the Town as parties to the enforcement of the CR.  This is to clarify that the Town will be a party to future enforcement of all Conservation Restrictions in Chilmark.

The next meeting will be Wednesday, November 5, 2014 @ 12:30 PM.  The site visits will take place on November 4 @ 12 noon.  With no further business to conduct the meeting adjourned at 12:52 PM.
