Conservation Commission Minutes 06/18/14

Present for the Conservation Commission and attending the meeting were:  Chairman, Sandy Broyard, Joan Malkin, Pam Goff, Bob Hungerford, Wesley Cottle, Maureen Eisner and Diana DeBlase. Chris Murphy and Candy Shweder were absent.
Chris Alley also attended the meeting.
The meeting came to order at 12:30 PM.  Ms. Goff moved to appoint Alternate Commissioner Maureen Eisner a voting member for the day’s agenda.  Mr. Hungerford seconded the motion which passed unanimously with 5 in favor and one abstention     (Ms. Eisner).

NOI SE 12 – 706 REID SILVA FOR RMJ DOCK, LLC; 16 Harbor Hill;               AP 27.1-104:  Ms. Broyard opened the public hearing at 12:31 PM.  Mr. Silva reviewed the plans to rebuild, repair and maintain the existing pier (License # 4712), including replacing piles, stringers and bents as necessary.  Mr. Silva said that the plans that we have for the existing dock do not resemble the 1950’s-issued Chapter 91 licensed plan.

The commission reviewed the differences. Mr. Silva stated the license is not what was built but, the dock does need repairs.  Discussion ensued. Mrs. Goff moved to continue this hearing to July 2, 2014 @ 12:35 PM to provide time to draft accurate plans.  Mr. Silva agreed.  The motion was seconded.  In discussion Mr. Silva was asked to return with a clear plan and an overlay of the differences versus the existing dock.  The proposed repairs should also be explained.  The motion passed unanimously with six in favor.

RFD CHRIS ALLEY FOR DAVID EPSTEIN; 58 Hammett Road (Spring Point); AP 9-4:  Mr. Alley summarized the plan to cut a new driveway section and install buried utilities.  A portion of the work is within the buffer zone of a Bordering Vegetated Wetland.  The closest activity is approximately 1 foot from the wetland edge.  He added the driveway will be used to access the area to construct a “barn like” house on the vacant lot beside the (David Epstein) owner’s home.  Mr. Alley said there is a road like path already on the site and the intention is to fortify this for the construction of the house.

Discussion ensued. Mrs. Goff said the resource interests concerning the Commission are water, wildlife and surface water runoff.  Mr. Hungerford said if the property is sold there will be more vehicle traffic just one foot from the wetland.

Mr. Alley proposed gravel on fabric for the driveway during construction of the home.  When construction is completed the driveway reinforcement will be removed to allow the area to return to its current, pre-construction original condition.  Mr. Alley also proposed adding snow fence backing the silt fencing as shown on plan.

Mrs. Broyard requested the owner(s) or their representative return to the Conservation Commission if they are seeking anything permanent in the pathway to the home that is in a resource area or buffer zone.   

After discussion a motion was made for a negative determination with the following special conditions:  1. The additional silt/snow fencing erosion controls to protect the wetland as proposed by Mr. Alley shall be installed and approved by the Conservation Agent before work begins.  2.  The applicant(s) or their representative shall return to the Commission if they are seeking any permanent form of a pathway to the home that is in a resource area or buffer zone.  The motion was seconded and passed unanimously with six in favor.

CERTIFICATE OF COMPLIANCE; CHRIS ALLEY FOR I FOUND MY THRILL; 74 North Rd.; AP 3-2 (Inn at Blueberry Hill):  Order of Conditions issued on 12/21/12:  Mr. Alley asked if this could be postponed to the next meeting when John Abrams can attend.  The Commission agreed.
