Conservation Commission Minutes 05/07/14

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Chairman, Candy Shweder, Vice Chairman, Pam Goff, Bob Hungerford,        and Chuck Hodgkinson.  Maureen Eisner, Gary Stuber, Reid Silva, Debbie and          Steve Hoxsie also attended. Joan Malkin and Wesley Cottle were absent.       

The meeting came to order at 12:30 PM.

RFD GARY STUBER FOR JACI JUDELSEN; 15 Cove Road; AP 27.1-206:         Mr. Stuber reviewed a plan to construct a 184 sq. ft. addition to an existing deck.  The framing will be approximately 30 inches above grade.  The addition will be supported by four non-concrete “Ready Footings”.  The footings will be approximately four feet below grade and installed with a post-hole digger.  The framing will be pressure-treated wood and the deck surface will be recycled fir.  The closest point is approximately 30 feet from the wetland edge.  He added the house was reduced from a 5-bedroom to a 3-bedroom dwelling with a composting septic system.

The Commission commented this increased deck area could become enclosed living area sometime in the future which would increase pressure on the resource.  A subsequent motion was made for a negative determination with the following special conditions:       1. No portion of the existing deck and this new deck shall be enclosed at any time in the future because of its proximity to the wetland.  2.  An original copy of this Determination of Applicability shall be filed with the property deed at the Registry of Deeds.  3.  Proof of this filing shall be provided to the Conservation Agent before a building permit may be issued.  The motion came to a vote and passed unanimously with four in favor.  

RFD REID SILVA FOR MARY ANN HOXSIE 14 Marjo’s Way; AP 27-2:            Mr. Silva summarized the plan to abandon and fill the existing cesspool and install and maintain an upgraded septic system.  The cesspool and new system are within the        100-foot buffer zone of a Bordering Vegetated Wetland.  The closest point is approximately 49 feet from the wetland edge.  As discussed at the site visit Mr. Silva presented a revised site plan dated 5/5/14 that rotated the leach field so it meets the Board of Health’s (BOH) 30-foot setback distance from the lot line.  He added the original plan dated 4/11/14 will be presented to the BOH because it is 84 feet from the wetland edge – versus the revised plan dated 5/5/14 that has the leach field 55 feet from the wetland edge.

After brief discussion a motion was made for a negative determination with the following special conditions:  1. Both the 4/11/14 and 5/5/14 site plans are approved provided the soil conditions are suitable for both plans.  The 4/11/14 plan is preferred as the leach field is farther from the wetland edge (84 feet) than in the 5/5/14 plan (55 feet).  2.  Hay bales and silt fencing shall be installed as shown on the 5/5/14 plan and approved by the Conservation Agent before work begins.  The motion came to a vote and passed unanimously with four in favor.  

ADMINISTRATION:  

The April 16, 2014 meeting minutes were reviewed and approved as presented by consensus.

An amendment to SE 12 – 681 which is The Nature Conservancy’s Order of Conditions for an oyster nursery in Tisbury Great Pond was reviewed.  They would like to place an additional 60 cu. yards of clutch within the approved footprint of this oyster propagation nursery.  The DEP Chapter 91 license division determined the change is an insignificant modification to the plan.  After brief discussion a motion was made to declare the change as inconsequential and approve the plan as described.  The motion was seconded and passed unanimously with four in favor.

The next meeting will be Wednesday, May 21, 2014 @ 12:30 PM.
