Present for the Conservation Commission and attending the meeting were: Sandy Broyard, Chairman, Candy Shweder, Vice Chairman, Pam Goff, Bob Hungerford, Chris Murphy, Wesley Cottle, Joan Malkin and Chuck Hodgkinson. David Hill also attended.
The meeting came to order at 12:30 PM.
RFD MARC VILLA; 20 Howell Lane; AP 27-4.1: This is a response to an Enforcement Letter. Chuck H. mentioned that Mr. Villa apologized for not attending as he was called to Boston for business. Mr. Villa offered to postpone his application to the next meeting if desired. After discussing the site visit the Commission agreed it would be better to postpone this discussion to December 4th to get a better understanding of Mr. Villa’s plans. The application outlined his desire to remove 2 dead trees within a 40-ft. ROW in a wetland buffer zone and 25 feet from the wetland; remove a fallen tree in a wetland; remove several dead beech trees in the southwest section of the property and within a wetland buffer
zone; maintain an existing walking path from the outdoor shower to the roadway that is in a wetland buffer zone.
RFD DAVID HILL FOR LINDA SCHAPIRO; 20 Quitsa Lane; AP 33-39: Mr. Hill summarized the plan to remove all dead trees and shrubs, fallen limbs and dead lower limbs to a maximum height of 20 feet. He would also like to cut and remove as much bittersweet and grape vines as possible. The equipment used for the project will be chain saws, power hedge shears and a chipper. All debris will be removed from the site. All of the work is in the buffer zone of a Bordering Vegetated Wetland or within the 100-foot buffer zone of the top of a coastal bank. The closest activity will be 20 feet from the wetland edge and 15 feet from the top of the bank. The Commission asked how the area will be maintained after the initial pruning is completed. Mr. Hill said the roots of
the understory and stumps of the dead trees will remain in place. A ground “hedge hog” mower will be used to clear the understory to a height of approximately 6 inches. The Commission deduced this is a view clearing and we’ll see what grows back in the spring. With no further discussion a motion was made for a negative determination with the condition that any future maintenance plans shall be reviewed with the Conservation Agent before work begins. The motion was seconded and with no discussion passed unanimously with seven in favor.
CERTIFICATE OF COMPLIANCE 308 SOUTH ROAD REALTY TRUST; SE 12 – 673; 308 South Rd.; Map 24 Lot 204: Chuck H. reviewed photos of the finished project for an Order of Conditions issued in December 2012. The project was to re-build, license and maintain an existing walkway and fixed pier in Chilmark Pond that was destroyed by Hurricane Sandy. As specified in the Order a Chapter 91 license for the walkway has been obtained. After brief discussion a motion was made to accept the report and declare the project is in full compliance with the on-going condition that any future maintenance plans shall be reviewed with the Conservation Agent before work begins. The motion was seconded and with no further discussion passed unanimously
with seven in favor.
ADMINISTRATION:
The November 6, 2013 meeting minutes were reviewed and approved as presented with four in favor and three abstentions (Commissioners Murphy, Cottle and Malkin).
The draft letter to the Commonwealth’s MEPA office with comments responding to the Environmental Notification Form (ENF) on the proposal to nourish the beach with 6,000 cubic yards of 6” to 9” cobble at 25 East Lane; AP 32-68.1 was reviewed. After discussing the November 14th site visit it was agreed to add the Bylaw Regulation that prohibits the construction of Coastal Engineering Structures to the text. The Order of Conditions that was issued in 1999 for the construction of the main house will also be reviewed to see if there are any on-going conditions.
Chuck H. informed the Commission that the Selectmen will host a public presentation on December 3 @ 7:00 PM at the Library. Its purpose is to receive public comment on a joint proposal among the Squibnocket Farm Association, Vineyard Open Land Foundation and the Town to expand the Town’s Squibnocket Beach, relocate the beach parking lot and the Association’s plan to build an elevated roadway to replace the existing causeway that has experienced severe erosion over the past few years. The final phase of the project would be to design a plan to remove the revetment and re-nourish the current Town beach to bring it back to its original barrier beach state.
The next meeting will be Wednesday, December 4, 2013 @ 12:30 PM.
