Conservation Commission Minutes 01/04/12
FINAL

Present: Pam Goff, Richard Smith, Sandy Broyard, Wesley Cottle, Donald Poole and Diana DeBlase.  Others: Ryan Bushey, Reid Silva, Jonathan Mayhew.  Richard Steves, Caitlin Jones and Chuck Hodgkinson were absent.

At 12:30 Chairman Pam Goff called meeting to order.

RFD REDI SILVA FOR BLUE SKY MV, LTD (BLUE HERON FARM) Cobbs Hill Rd.; AP 11-23.3:  Mr. Silva began with an explanation of the fencing already erected on the site. The fencing is not within the 100 foot buffer zone. The determination would apply to the relocation of the air conditioning units and gas meter and related trenching for plumbing and electric.

Mr. Bushey said the function of the air conditioner units would be compromised with the deck they were planning to build in the area.  The A/C manufacturer recommended relocation. Secondly the noise of the units is another factor for moving the units.

Mr. Cottle asked why move them into the buffer zone. Why not move them to an alternate location.

Mr. Silva said because the other areas are established lawns and there was already a screen of greenery on the pond side in buffer zone.

Mr. Goff asked what the distance of proposed activity is from the coastal bank.
Mr. Silva measured from the plans available and said approximately 90 feet.

Mrs. Goff said the Determination form states approximately 65 feet. Mr. Silva said that figure is incorrect and should be 90 feet.  (Subsequent examination of the application indicated the site plan had the closest activity for construction access 65 feet from the coastal bank.  A new site plan has been provided placing the construction access outside the buffer zone.)

Mrs. Goff asked if members of the Conservation Commission were ready for a motion.
Mrs. Broyard asked if a condition could be put into place stating no more additions to the buffer zone in the future.

Mrs. Goff said a condition for a negative determination could be as follows:
“Because of the presence of wildlife, especially of Great Blue Herons on the near shore the condition is that no additional mechanical equipment or structures shall be allowed in the buffer zone.”~

Mrs. Broyard moved to grant a negative determination with the above mentioned condition.  The motion was seconded and unanimously approved with five in favor.

The December 21, 2011 Meeting Minutes were approved as presented by consensus.
