Conservation Commission Minutes 09/07/11
FINAL
Present for the Conservation Commission and attending the meeting were:  Pam Goff, Sandy Broyard, Caitlin Jones, Dick Smith and Chuck Hodgkinson.  Tom Della Rocco and Geoghan Coogan also attended.  Richard Steves, Donald Poole and Wes Cottle were absent.  The meeting came to order at 12:34 PM.  Ms. Goff was appointed as acting Chair.  Caitlin Jones was appointed as a voting member for the day’s agenda.  The site visits for today’s meeting were made on September 6.  

NOI SE 12 – 638; GEORGE SOURATI FOR DAN AND TARA GOLEMAN;               15 Hammett Rd.; AP 8-50.1:  Chuck H. informed the Commission that Mr. Sourati requests the hearing be moved to September 21 @ 12:30 PM.  A motion was made to accept the request.  The motion was seconded and unanimously approved with four in favor.  The application is to install a six-foot wide horse path through an isolated wetland and install a buried utility line under the proposed horse path through the wetland.

DISCUSSION TOM DELLA ROCCO OF TEA LANE NURSERY; SE 12 – 536; AP 33-31:  Mr. Della Rocco summarized the Order of Conditions issued for this project and said he wants to review his proposed maintenance plan for the beach nourishment and coastal bank erosion control (SE 12– 536; 16 Greenhouse Lane; AP 33-31).  The Commission asked if the owner stills wants to proceed –considering the impact of Hurricane Irene.  Mr. Della Rocco said they do want to move forward with the maintenance of the bank vegetation.  His explained how jute netting, additional beach nourishment and beach grass will be planted.  The beach nourishment will be added by wheel barrow and all other work will be done by hand.  He reviewed samples of the John Keene white sand and clay hardener mixture and compared it to Goodale’s sand.  The proposed sand and clay mixture is two parts Keene white sand and one part clay.  He estimates needing approximately 30 tons of beach nourishment.  After brief discussion a motion was made to approve the recommended maintenance plan using the Keene white sand and 1/3 clay mixture.  The motion was seconded and unanimously approved with four in favor.

REVIEW DRAFT CONSERVATION RESTRICTION - GEOGHAN COOGAN FOR RICHARD COLEMAN; MAP 18 LOTS 92.2, 92.3.   Mr. Coogan summarized the proposed conservation restriction (CR) for two parcels of land owned by Richard Coleman off of Meetinghouse Rd.  The Commission complimented the proposal and said it was very close to the Commonwealth’s recommended format.  The Commission thought the proposal was in the public’s interest as it has several benefits:  It would maintain significant acreage in a primarily undeveloped and protected state to add to the values of Sheriff’s Meadow Middle Road Sanctuary near by.  The reduction of density will help preserve the water resources of the Town.  The possible establishment of trails could benefit the walking public.  The natural, open, scenic and potential agricultural use of the land will preserve wildlife habitat and the rural character of Chilmark.  After brief discussion a motion was made to sign the Municipal Certification and forward the proposal to the Board of Assessors for review.  The Commission asked Mr. Coogan to transform the draft into a finished proposal before they send it to the Assessors.
CERTIFICATE OF COMLPIANCE SE 12 – 445; JEROME KENNEY & DEBBIE HANCOCK; 18, 20 Crick Hill Rd.; Map 27.1 Lots 119, 120:   An Order of Conditions was issued in 2003 to upgrade the septic system.  A site inspection was made on 8/23.  The work was done as permitted.  Chuck H. shared photos of the finished project.  A motion was made to approve the Certificate of Compliance. The motion was seconded and unanimously approved.

CERTIFICATE OF COMPLIANCE – SE 12 – 533; JEROME KENNEY & DEBBIE HANCOCK; 18, 20 Crick Hill Rd.; Map 27.1 Lots 119, 120.  An Order of Conditions was issued in 2007 to drive steel pilings, install a composite sheet bulkhead wall, install geo-technical slope stabilization fabric and to backfill, grade and landscape as necessary upslope to the bulkhead and to perform ongoing, routine and necessary maintenance on the bulkhead and coastal bank.  This work was designed to reinforce and stabilize the coastal bank.  As conditioned, Rusty Walton approved the planting plan and the re-arrangement of stones on the beach to help dissipate wave energy.  Chuck H. shared photos of the finished revetment and planting.  A motion was made to approve the Certificate of Compliance with the following on-going condition:  Any maintenance work of the revetment must be reviewed with the Conservation Agent before work begins.  The motion was seconded and unanimously approved.   

REVIEW NEW WETLAND DELINEATION AS REQUIRED IN THE DETERMINATION OF APPLICABILITY; DOUG DOWLING FOR TOM LANGMAN SUBDIVISON; WELL AND WATER LINE; 8 Salt Meadow;             AP 21-52.2:  Chuck H. summarized the condition of a negative determination of applicability that required the wetland edge delineation to be performed by a certified wetland scientist.  The new wetland was delineated by Julia Fiske—Certified Wetland Scientist # 1840.  A new site plan dated August 15, 2011 from Dowling & Smith with the original and new delineations was reviewed.  Chuck H. added the subdivision will be heard by the Planning Board on September 12.  The Commission’s acceptance or denial of the delineation is required.  After reviewing the new site plan the Commission agreed this is much closer to what it concluded during the previous site visit.  A motion was made to accept the new delineation as shown on the site plan dated 8/15/11.  The motion was seconded and unanimously approved.
 
ADMINISTRATION:  
The Commission reviewed and ratified the Enforcement Order issued for                          8 Greenhouse Lane; AP 33-30.
The August 17 and August 30, 2011 Meeting Minutes were approved as presented by consensus.  The following documents were signed:
