Conservation Commission Minutes 03/16/2011

Present for the Conservation Commission and attending the meeting were:  Sandy Broyard, Caitlin Jones, Donald Poole, Dick Smith and Chuck Hodgkinson.  Also attending was John Johnson for Spring Point Association.  Andrew Fischer, Richard Steves, Pam Goff and Bruce Bartels were absent.

The meeting came to order at 12:30 PM.  Ms. Broyard was appointed as acting Chair.  Associate Commissioners Ms. Jones and Mr. Poole were appointed as voting members for the day.  

NOI SE 12 – 628; ROBIN HYDE (JOHN JOHNSON) FOR SPRING POINT ASSOCIATION; Beck’s Beach; AP 5-1:   Ms. Broyard opened the public hearing at 12:35 PM.  Mr. Johnson attended in Robin Hyde’s place and reviewed the plan to replace and perpetually maintain three sets of pre-existing beach stairs on Beck’s Beach.  All work will be done by hand.  Mr. Johnson asked for some flexibility in the stair tread materials and stairway support posts.  He said the composite tread material is not strong enough for stair treads and favored new pressure-treated wood and spruce.  He also explained they may try to use helix metal posts for the stair supports—if there are not too many rocks below grade.  Locust posts are still being considered.  

After brief discussion and with no comment from the audience a motion was made to close the hearing at 12:47 PM.  The motion was seconded and unanimously approved.  A subsequent motion was made to approve the plan as presented with the following special conditions:  1.  The lower sections of all three stairways will be permanently labeled as follows:  “Spring Point Assoc.”.  This will identify any loose materials that may be caused or damaged by storms.  The Association must clean up any loose stair debris on the beach.  2.  All construction debris shall be removed from the site on a daily basis.      3.  The stairways may be maintained in perpetuity provided the maintenance plans are reviewed with the Conservation Agent before work begins and all conditions of this Order are followed.  The motion was seconded and approved unanimously with four in favor.

CERTIFICATE OF COMPLIANCE; SE 12 – 392; 20 Vineyard Sound Path (now David’s Way) AP 21-21.1, 22:  Chuck H. summarized this Order of Conditions that was issued in 2000 and renewed in 2003.  The following work was done in 2004:  a pre-existing dwelling that was within the 100-foot buffer zone of the Vineyard Sound coastal bank was demolished.  A new, larger dwelling was built outside the buffer zone.  Several photos of the property were shared with the Commission along with the certified site plan indicating the footprint of the new dwelling.  After brief discussion a motion was made to approve the Certificate of Compliance.  The motion was seconded and unanimously approved with four in favor.
 
ADMINISTRATION:  

The March 2, 2011 Meeting Minutes were approved as presented by consensus.
