Conservation Commission Minutes 07/21/10

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Pam Goff, Sandy Broyard, Caitlin Jones, Dick Smith, Virginia Dyer,           Donald Poole and Chuck Hodgkinson.  Also attending were Reid Silva, Merle Berger, Lauri Dietz, Jim, Jennie, Jarrod and Jamie Belushi.  Rusty Walton, Andrew Fischer and Bruce Bartels were absent.

The meeting came to order at 12:30 PM.  Mr. Steves appointed Mr. Poole and Ms. Jones as voting members for the day’s agenda.  The site visits for today’s meeting took place on July 20.  

Mr. Belushi introduced his family and thanked the Commission for its help and reasonable solutions for relocating his home.  Home made chocolate chip cookies were enjoyed by all.

REID SILVA FOR WILLIAM ELBOW AND ANN ALLEN; NOI SE 12 – 613;    AP 8-42.2; 55 Hammett Lane: Mr. Steves opened the public hearing at 12:35 pm.  Mr. Silva summarized the site visit and plan to brush cut an existing cleared area using a push mover.  Native fescues and other meadow grass seed will be planted to restore the meadow.  The meadow will be maintained in late spring and early fall.  Any woodland under-story growth will be removed by hand from time to time to facilitate establishment of the meadow.  The work will be done in the buffer zone of a bordering vegetated wetland.  He also requested the ability to maintain the meadow for five years – if approved.

After brief discussion and with no comment from the audience a motion was made to close the hearing at 12:40 pm.  The motion was seconded and passed.  A subsequent motion was made to approve the plan as presented with a five-year maintenance plan.  The motion was seconded and approved by all seven Commissioners.  

DISCUSSION MERLE BERGER AND LAURI DIETZ; Peases Point Way;          AP 27-15.1, 15.2:  Dr. Berger asked the Commission for its guidance on the proper procedures for working with the Commission to develop an agreeable view maintenance plan for the property that is currently protected by a Town-sanctioned Conservation Restriction (CR).  He added that the CR does provide for the ability to prune vegetation to preserve the water views as they were in the year 2000 – when the CR was approved.  Ms. Dietz added that she is the Trustee for the property and also wanted to have the ability to approve the plan.

The Commission explained that a plan should be proposed that meets the requirements and protects the interests outlined in the CR.  The Commission will work with you to obtain an agreed plan that it believes achieves the goals outlined and allowed in the CR.  A site visit and discussion of the plan will take place among a representative of the Commission and the landscape contractor to review the limits and extent of the pruning before work begins.  Chuck H. offered to work with the parties to draft a plan.

DISCUSSION TOWN OF CHILMARK PUBLIC SKIFF LAUNCH RAMP AT SQUIBNOCKET POND; SE 12 – 609; AP 35-21:  Chuck H. shared the Town’s request to use stones for all 53 yards of the launch ramp – in lieu of the 2” X 10” portable planking proposed by the Commission.  The rock path is proposed because the Town believes the planking will float away in a storm surge.  After brief discussion the Commission unanimously rejected the proposal as it does not satisfy and protect the interests outlined in the Act and Town’s Wetland Protection Bylaws.  It requires a system that will protect the sediment and vegetation in the salt marsh and wetland to the water’s edge.  The proposed rock path will not achieve this goal.   

DISCUSSION SCHEUER, COHEN ORDER OF CONDITIONS; SE 12 – 552;      AP 33-4; 2 Chocker’s Lane:  Chuck H. summarized the applicant’s desire to install the permitted bridge over the wetland after the lot is sold.  It will be the new owner’s responsibility to comply with the Order.  Ms. Broyard added that the approved temporary planking for the well and septic installations has been removed.  After brief discussion the Commission accepted the plan.  Chuck H. will remind the applicant that the work must be completed within three years of Order’s date of issuance lest a new Notice of Intent application will be needed.

ADMINISTRATION:  The meeting minutes for July 7 were reviewed.  A motion was made to approve the minutes as presented.  The motion was seconded and passed.

Chuck H. shared the letter dated July 19, 2010 sent to Zach Wiesner and Warren Spector informing them that Glyphosate (Rodeo) can no longer be used as a part of their permitted Phragmites management in the Squibnocket Pond zoning overlay district;      SE 12 – 544; AP 35-1.9.

Chuck H. shared the letter dated July 19, 2010 from Schofield, Barbini & Hoehn outlining the materials and methods that will be used to re-build the existing Chapter 91 licensed, fixed pier at 18 Point Inner Way; AP 33-114; SE 12 – 476.  The Commission approved the plan.
