Conservation Commission Minutes 06/17/09
FINAL
Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff Vice Chairman, Bruce Bartels, Dick Smith, Rusty Walton and Chuck Hodgkinson. Caitlin Jones and Sandy Broyard also attended.  Virginia Dyer and Andrew Fischer were absent.

Mr. Steves opened the meeting at 12:32 PM.  The site visits for today’s meeting took place on June 16.

RFD REID SILVA FOR TOWN OF CHILMARK; AP 13-43:  Ms. Goff announced that she is an abutter to this housing program and added she has no material interest in the outcome of the Commission’s decision.  The Commission thanked her and agreed there is no conflict of interest.  Chuck H. summarized the application to drill and install a water well and excavate, install and backfill a waterline in a location that is next to the 40-foot right of way.  This is the tenth well needed for the Middle Line Road Community Housing Program.  An alternative location for this well did not produce water.  The proposed location is 84 feet from an existing clay pit-resource area.  After brief discussion a motion was made for a negative determination.  The motion was seconded and unanimously approved.

FOLLOW UP SHERIFF’S MEADOW FOUNDATION (SMF); ORDER OF CONDITIONS SE 12 – 574; AP 17-35; 23-5, 6:   Chuck H. summarized a request for the following change to the approved plan.  On one of the parcels in this management plan (AP 23-6-Priscilla Hancock property) the NHESP asked SMF to make soil amendments by hand.  SMF has approval from the NHESP to use a small bobcat in the non-growing season to remove and add sand, add compost and remove morainal soil and rocks.  All other work in the plan will be executed as proposed in the Notice of Intent.  A motion was made to accept the change as outlined.  The motion was seconded and unanimously approved.

RUSTY WALTON UPDATES:  The Commission accepted and thanked Mr. Walton for his thorough updates regarding the Frankel raised walkway (SE 12 – 579; AP 29-7) and the Frankel Beach stairway (SE 12 – 485; AP 29-7).

Mr. Walton then summarized his note dated June 15, 2009 regarding a subcontractor’s pickup truck that was stuck in a wetland at #23 The Aerie; AP 20-53.  He added that Mr. Thorpe called him as soon as he saw the truck.  By the time Mr. Walton arrived to investigate the truck was removed and the area restored.  He added that Mr. Thorpe told him the children at times drive their golf carts in the area and it is difficult to constantly monitor the area.

The Commission asked Mr. Walton to send a letter to Mr. Thorpe thanking him for proactively informing the Commission of the activity and for his swift resolution.  The letter should also include a request for Mr. Thorpe to outline the future risks to the area and submit a proposed plan for protecting the resource.


ADMINISTRATION:  

Chuck H. informed the Commission of a lecture that will take place this evening at      5:30 pm at the Chilmark Library about oyster restoration in the Tisbury Great Pond.
