FINAL
Present for the Conservation Commission and attending the meeting were: Richard Steves, Chairman, Pam Goff, Dick Smith, Virginia Dyer, Andrew Fischer, David Flanders and Chuck Hodgkinson. George Sourati, Esther Brandon, Steve Ewing and John Clift also attended. Bruce Bartels was absent.
Mr. Steves opened the meeting at 12:30 PM and informed the audience that the Commission made their site visits for today’s agenda on October 28th. He further appointed Alternate Commissioners Dick Smith and Andrew Fischer as voting members for the day’s agenda.
GEORGE SOURATI FOR ROGERS AND ESTHER BRANDON; AMENDED ORDER OF CONDITIONS SE 12 – 527; AP 16-7.3: Mr. Steves opened the public hearing to amend the Notice of Intent and Order of Conditions. John Clift of Landscope summarized the site plan to clear dead wood, prune certain trees and vegetation to open the water view of the pond. Approximately 11 pine trees and five oak trees will be removed. A separate section of the property will be returned to its original state of sand plain by removing the bayberry and scrub oak. Mr. Clift added that once completed they are requesting indefinite maintenance of the area with the condition they would return to the Commission before any work is performed. Mr. Sourati explained the plan to install a permanent stairway down the coastal
bank to the water’s edge. The top of the stairs will be 16 feet above the water line and the bottom will be five feet above the water line. A large stone will be placed at the bottom as a step. The proposed stair location will preserve the existing vegetation on the bank to prevent erosion.
A detached outdoor shower will also be constructed but this is outside the 100-foot shore zone and not in the Commission’s jurisdiction.
After discussion the Commission complimented the plan as reasonable, well conceived and modest. They added that if approved there can be no mowing in the months of June or July as outlined in the letter from the NHESP dated 10/20/08; file # 06-20916. With no comment from the audience a motion was made to close the hearing at 12:47 PM. The motion was seconded and unanimously approved. A subsequent motion was made to approve the amended plan as presented with the following conditions – which are in addition to the standard conditions: 1. A detailed plan for the stairway will be provided for the record. 2. Non-treated lumber will be used for the stairway. 3. The support posts will be helix-secured into the ground. 4. Only hand tools will be used to
install the stairway. 5. Photos of all the landscaping work will be provided for the Town’s records after the work is completed. 6. No mowing shall take place during June or July. The motion was seconded and unanimously approved.
STEVE EWING DISCUSSION SONGWIND LLC NOI SE 12 – 565; AP 27.1-86: Mr. Ewing reviewed the plans to repair the existing fixed pier as required in the approved Order of Conditions. A total of 8 new pilings will be installed for the hammerhead section of the pier. They will be installed from a barge and the old posts will be removed from the site. Oak or green heart pilings will be used – they will not be pressure treated. The work will be done either this fall or in the early spring. Mr. Ewing will notify the Commission before any work is done. After brief discussion the Commission thanked Mr. Ewing for explaining the procedures. A motion was made to approve the maintenance plan as outlined with the agreement he will notify the Commission before work
begins. The motion was seconded and approved with five in favor and one opposed (Ms. Dyer).
CARLOS MONTOYA LETTER REQUESTING AN EXTENDED PLANTING DEADLINE; BERGER SE 12 – 564; AP 27-15.1, 15.2: The Commission reviewed Mr. Montoya’s letter asking for an extension beyond the December 1, 2008 deadline for the planting in the heron rookery and pond area as outlined in the Order of Conditions. The key reasons stated are it is too cold for the planting and there is not adequate available inventory of native species. After discussion the Commission approved the extension and asked Chuck H. to research the heron migration dates. A planting window will be defined that does not allow any activity at least two weeks before the herons arrive and only after they leave their nesting grounds. If the planned screening cannot be installed before spring 2009 a temporary
fence shall be installed as screening until the fall 2009 planting season.
CERTIFICATE OF COMPLIANCE BAKER/WUSCORP; SE 12 – 538; AP 8-54, 55: Mr. Walton summarized his inspection report for the installation of utilities a slate patio and a parking area. He recommended approval of the Certificate of Compliance. A motion was made to approve the Certificate of Compliance based upon the Conservation Officer’s report. The motion was seconded and unanimously approved.
ADMINISTRATION: The meeting minutes for October 15, 2008 were reviewed. A motion to approve the minutes as presented was made, seconded and unanimously approved. The following documents were signed and notarized as needed:
