Conservation Commission Minutes 05/07/08

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff, David Flanders, Virginia Dyer, Rusty Walton, and PersonNameChuck Hodgkinson.  Reid Silva also attended.  Bruce Bartels, Russell Maloney and PersonNameRay Kellman were absent.

Mr. Steves opened the meeting at 1:30 PM.

RFD BARBARA ARMSTRONG AP 27.1-145; 4 CREEK HILL:  The application to install a 30-foot section of split rail fencing along the edge of the parking area was reviewed.  The fence will be located at the top of the bank of a salt marsh and is intended to contain parking and prohibit cars from going over the bank into the salt marsh.  After discussion a motion for a negative determination was made, seconded and unanimously approved.

RFD MICHAEL LIEBERMAN AP 27.1-109:  The Commission read a letter requesting the withdrawal of this Request for Determination of Applicability.  A motion to accept the request was made, seconded and unanimously approved.

REQUEST FOR EXTENSION OF ORDER OF CONDITIONS CityLAWRENCE placeCityBELL SE 12 – 429;            AP 31-10:   The application requesting an additional three-year extension for this Order was reviewed.  The initial Order was issued in 2002 for clearing brush and a view area.  A motion to grant the three-year extension starting May 29, 2008 was made, seconded and unanimously approved with the condition that the planned vegetation for pruning will be flagged and reviewed by the Commission before the work begins.

CONTINUED PUBLIC HEARING REID SILVA FOR RICHARD SCHEUER AND AMY COHEN; SE 12 – 552; AP 33-4: Mr. Steves opened the continued hearing at 2:00 PM.  Mr. Silva summarized the history of the application and his meeting with the Planning Board indicating there is no alternative for a new driveway other than the one proposed.  The site plan dated May 7, 2008 was revised to include a bridge for the section of driveway that crosses the wetland – as requested by the Commission.  The bridge will be 12 feet wide and approximately 30 feet long.  The height above the ground will range from a low of 4 inches to a high of 18 – 24 inches.  Two 2” X 6” capped logs will be on the two edges of the bridge to help guide traffic.  The bridge will support loads for 10-wheel trucks – an “H-25” load.  This will support construction and lumber trucks that are used during construction but not 18-wheelers.  After discussion a motion to close the hearing at 2:22 PM was made seconded and unanimously approved.  A subsequent motion was made to approve the plan as proposed with the standard conditions.  The motion was seconded and approved with three in favor and one opposed (Ms Dyer).  Ms. Dyer thought the bridge load factor was excessive.

RUSTY WALTON UPDATES:  Mr. Walton summarized his decision to issue a violation notice and fine to Vineyard Land Surveying & Engineering for not adhering to the special conditions outlined in the Order of Conditions for Pacer Nominee Trust; SE 12 – 551; AP 35 – 1.15.  The entire building envelope was excavated without notifying the Conservation Officer, installing the silt fencing and hay bales and having a pre-activity, on site meeting.  Mr. Walton added that the siltation barriers have since been installed to his satisfaction and the fine has been paid.  A subsequent discussion among the Commission and Reid Silva took place later in the meeting.  Mr. Silva apologized and said it was a mistake and added this is the first and last time this will happen.

The Commission reviewed the letter from the Department of the Navy for a controlled burn on placePlaceNameNomans PlaceTypeLand that is scheduled for May 7 or 8.  They asked Chuck H. to communicate the Commission’s desire for future burns to take place earlier in the year to avoid bird nesting season.    

ADMINISTRATION:  The meeting minutes for April 16, 2008 were reviewed.  A motion to approve the minutes with a minor correction was made, seconded and unanimously approved.
