Conservation Commission Minutes 6/20/07

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff, Bruce Bartels, David Flanders, Russell Maloney and Chuck Hodgkinson.  Also attending were Glenn Provost, Frank Dunkl, Debbie Hancock, Robbie Hutchinson and Peter Darling.  Ray Kellman, Virginia Dyer and Rusty Walton were absent.    

Mr. Steves opened the meeting at 1:30 PM and announced a site visit to addressStreetMeadow Lane for the Weisner Notice of Intent application.

PUBLIC MEETING RFD FRANK LORUSSO FOR RICHARD LOCHRIDGE; AP 25-130:  Mr. Steves reconvened the meeting at 2:00 PM and informed the Committee that the applicant requests a continuance to July 18 @ 2:00 PM.  A motion to approve the request was made, seconded and unanimously approved.

PUBLIC MEETING RFD FRANK DUNKL FOR addressStreetOLD FARM ROAD ASSOCIATION; AP 3-4:  Mr. Dunkl explained the plan to install 8” to 10” diameter locust posts along the roadside edges of addressStreetOld Farm Road to prevent cars from accidentally driving into the wetland abutting the roadway.  He added he will work with the Conservation Officer and Fire Chief before doing the work to make sure the post locations are acceptable.  After brief discussion a motion for a negative determination was made, seconded and unanimously approved.

PUBLIC HEARING NOI SE 12 – 536; AP 33-31 ROBBIE HUTCHINSON (DONAROMA’S NURSERY) FOR WHALE HILL, INC.:  Mr. Steves opened the public hearing at 2:15 PM.  Ms. Hutchinson explained that this is a follow up formal application for the emergency certification that was granted.  The plan is to replace the erosion control landscaping on a coastal bank that was lost in a spring storm.  Ms. Hutchinson reviewed several photos of the area and added the landscape plan will replicate the previously approved plantings (SE 12 – 372).  Mr. Steves read a letter from the NHESP indicating the proposed work will not adversely affect habitat or constitute a taking of rare species.  Abutter Peter Darling spoke in favor of the plan.  Ms. Hutchinson added that they unfortunately missed the spring planting window and said the planting will not take place until this fall.

After brief discussion a motion was made to close the hearing.  It was seconded and unanimously approved.  A subsequent motion was made to approve the plan as presented with the following special conditions:  1. No herbicides or pesticides will be used and only organic fertilizers may be used – if necessary.  2.  No revetment or coastal engineering structure will be allowed.  3.  The Conservation Officer shall be notified before the work begins this fall.  The motion was seconded and unanimously approved.

PUBLIC HEARING NOI SE 12 – 537; AP 31-9.3B GLENN PROVOST FOR JOSH WEISNER:  Mr. Steves opened the public hearing at 2:30 PM.  Mr. Provost summarized the site plan and comments made at the earlier site visit.  The plan is to excavate and install a driveway, bury utilities and install a well within the buffer zone of a bordering vegetated wetland.  Mr. Provost pointed out the location of a stream that he believed is intermittent and asked for the Commission’s opinion as this point must be clarified for the potential buyer of the undeveloped parcel.  After discussion the Commission reached a unanimous consensus that the stream should be classified as an intermittent stream.  Audience member Debbie Hancock mentioned the family plans to restrict the size of a new home to about 3,500 square feet as a condition in the purchase and sale agreement.

After brief discussion a motion to close the hearing was made, seconded and unanimously approved.  A subsequent motion to approve the plan as presented was made, seconded and unanimously approved.

DEBBIE HANCOCK FOLLOW UP DISCUSSION SE 12 – 533; AP 27.1 – 119, 120:  As requested, Ms. Hancock summarized the specific plan to finish the ends of the revetment that has been approved.  It was mentioned that abutter John Keene approved the plan.  After brief discussion a motion to approve the proposed plan for finishing the ends of the revetment was made, seconded and unanimously approved.

ADMINISTRATION:  The 6/6/07 minutes were reviewed.  A motion to approve the minutes as presented was made, seconded and unanimously approved.  A letter from the Massachusetts Historical Commission regarding the proposed excavation of a rock off placePlaceNameNomans PlaceTypeLand that might be linked to Leif Erickson was reviewed.  No action will be taken at this time.  The invoice for renewing the Commission’s annual membership in MACC was approved for payment.

The July 4th meeting of the Commission will be canceled.  The next meeting will take place on   July 18th.
