Conservation Commission Minutes 11/15/06
FINAL

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff, Virginia Dyer, Bruce Bartels, David Flanders, Russell Maloney, Rusty Walton and Chuck Hodgkinson.  Also attending were George Sourati (Labaree and Brandon), JB Riggs Parker, Frank Fenner and Dennis Jason (Town of Chilmark), David Handlin, Doug Hoehn (Rosemallow Farm Trust), Lawrence Brandon, Joseph W. Dick (Brandon).  Ray Kellman was absent.    

Mr. Steves opening the meeting at 1:30 PM to announce two site visits:  18 Thumb Cove (Rosemallow Farm Trust) and Old Fields Path (Brandon).

LABAREE NOI SE 12 – 503; AP 21-36:  Mr. Steves opened the continued public hearing at 2:18 PM.  The applicant requested an indefinite continuance to a future date at which time a new advertisement will be run and a new set of abutter letters will be mailed.  A motion to accept the indefinite continuance was made seconded and unanimously approved.

ROSEMALLOW FARM TRUST NOI SE 12 – 526; AP 24-36:  Mr. Steves opened the public hearing at 2:25 PM.  Mr. Handlin summarized the site plan and comments made during the site visit.  The renovations will reduce the total bedroom count on the parcel from three to one.  Mr. Steves noted that the site is slightly above the flood plain and asked if the current sealed septic tank would continue to be used.  Mr. Handlin confirmed it would and added a new well would be dug next to the existing well and pump house.  He continued by pointing out where a trench would be dug down the driveway for a new power line.  It was noted that the Commission has not yet received any comments from the Division of Fisheries.  With no comments from the audience the hearing closed at 2:32 PM.  After additional discussion a motion was made to approve the plan as presented with the following special conditions that will be added to the standard contact information conditions:  1.  Siltation barriers will be installed before beginning any work.             2.  Construction debris will be stored in a covered dumpster on a daily basis.  3.  Hay bales and snow fencing will be installed on the pond side of the site before any construction begins.  4.  The utility trench will be dug and filled in one day.  5.  The Conservation Officer will inspect the site and confirm that all conditions have been met before any construction begins.  A motion to approve the plan as presented with the conditions was made seconded and unanimously approved.  

TOWN OF CHILMARK AMENDED NOI SE 12 – 518; AP 33-59:  Mr. Steves opened the public hearing at 2:35PM.  The Commissioners discussed their site visits taken at 10:00 AM earlier in the day to inspect the site at low tide.  Mr. Fenner summarized the plan to resurface the existing blacktop from the top of the boat ramp – above the high water mark – to State Road.  This section will be approximately 16 feet wide and slope toward the gravel parking area for water drainage.  There was no comment from the audience.  The hearing closed at 2:43.  A motion to approve the amended the Notice of Intent SE 12 – 518 was made, seconded and unanimously approved.

BRANDON NOI SE 12 - ???; AP 16-7.3:  Mr. Steves opened the public hearing at 2:45 PM and informed the applicant that the Commission has not yet received a file number from the DEP.  The case will be heard but the Commission may not vote on the application without a file number.  Mr. Sourati summarized the site plan and comments made at the earlier site visit.  He added that the septic leaching area will be more than 500 feet from the pond’s edge and mentioned there will be a total of five bedrooms – four in the main house and one in the detached garage.  Mr. Sourati pointed out the footprint of both structures will be outside the 100-foot buffer zone and the house and garage will be 22 feet and 29 feet outside the 100-year flood zone respectively.  Mr. Sourati requested permission to have a cut zone that extends ten feet into the buffer zone for construction.  He added a snow fence with hay bales would be installed on the edge of this 10-foot cut zone.  With no comment from the audience the hearing closed at 2:50 PM.  After brief discussion a motion for a straw vote with the standard conditions and the proposed hay bales and silt fence was made, seconded and unanimously approved.  The Commission will confirm the vote at the next scheduled meeting—assuming a DEP file number is issued.

OTHER BUSINESS:  Mr. Walton updated the Commission on his site visits to the Callagy property (SE 12 – 522; AP 33-76.1); Dimovich site (SE 12 – 510; AP 12-42) and had an update on the Phragmites control project at Dr’s. Creek on Chilmark Pond.  The Commission thanked Mr. Walton for his diligence and thorough follow up on these projects.
