FINAL
Present for the Conservation Commission and attending the meeting were: Richard Steves, Chairman, Pam Goff, Ray Kellman, Virginia Dyer, Bruce Bartels, David Flanders and Tim Carroll. Also attending were Will Marden (Wheeler) and Chris Alley (Flanders). Absent were Russell Maloney, Rusty Walton and Chuck Hodgkinson.
Mr. Steves opening the meeting at 1:30 PM to announce two site visits: Wheeler 142 State Rd. and Flanders 25 State Rd. (These minutes are taken from Mr. Carroll’s notes).
WILL MARDEN FOR TED WHEELER; RFD AP 33-18: Mr. Steves opened the public meeting at 2:00 PM. Mr. Marden explained that the site for the detached bedroom and tool shed was moved closer to the outer edge of the 100-foot buffer zone to try and satisfy an abutting neighbor’s request. The total bedroom count on the property will remain at three. After discussion a motion for a negative determination was made and seconded with the condition that a silt fence will be installed between the main house and salt marsh prior to construction to protect the resource from the trench work in the buffer zone. The motion and condition were voted five in favor with one abstention (Ms. Dyer).
CHRIS ALLEY FOR MARTHA FLANDERS NOI SE 12 - 525; AP 30-79.3: Mr. Steves opened the public hearing at 2:15 PM. Mr. Flanders recused himself from this hearing as he is a distant relative. Mr. Alley summarized the plans to upgrade the septic system and bring it into title V compliance. The work will take place within the 200 foot Mill Brook river zone. The septic system and leach field will be within the second 50-foot section of buffer zone. The new well will be in the first 50-foot section of buffer zone. A neighbor, Allison Burger arrived and Mr. Steves explained the plans and process accordingly.
Mr. Alley continued and said he is planning to meet with the Board of Health in two weeks. He added that a silt fence would be installed from the house to State Rd. on the left (brook) side of the road. After further discussion the hearing closed at 2:25 PM. A motion to approve the plan as presented was made, seconded and voted five in favor with one abstention (Mr. Flanders).
GLENN JOHNSON FOR MARIANNE MEYERS CERTIFICATE OF COMPLIANCE NOI SE 12 – 514; AP 29-6: Mr. Johnson explained the beach stairway is finished and the lower section was rotated about 30 degrees to fit the contour of the land. After a brief discussion a motion for approve the certificate of compliance was made, seconded and voted five in favor with one abstention (Ms. Dyer).
KINGSBURY DETERMINATION OF APPLICABILITY AP 3-1: The four Commissioners that attended the public meeting on October 24th to review this application summarized the discussion for the other members. The required condition of placing a perpetual deed restriction stating the studio will not be used or rented as a house or guesthouse was reached as a compromise. The conditional negative determination of applicability and deed restriction that has already been filed with the Registry of Deeds was reviewed. A motion to approve the negative determination was made, seconded and voted four in favor with two abstentions (Commissioners Dyer and Steves).
OTHER BUSINESS: Mr. Flanders noted that the State Highway Department work has road runoff that is draining directly into brooks rather than across land. The Commission agreed and will ask the Conservation Officer to contact the State Highway Department accordingly.

MINUTES: The meeting minutes for 10/18/06 and 10/24/06 were reviewed. A motion to approve both sets of minutes as presented was made, seconded and unanimously approved.
