Conservation Commission Minutes 10/24/06

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chairman, Pam Goff, Bruce Bartels, David Flanders, and Chuck Hodgkinson.  Also attending was Russell Smith for Trina Kingsbury.  Absent were Ray Kellman, Russell Maloney, Virginia Dyer and Rusty Walton, Conservation Officer.    

Mr. Steves opening the meeting at 1:30 PM.

RUSSELL SMITH FOR TRINA KINGSBURY RFD AP 3-1:  Mr. Smith thanked the Commission for calling this meeting and said he would be representing Ms. Kingsbury.  He summarized Ms. Kingsbury’s proposed additions to the studio of the glass porch and garage.  Mr. Smith also summarized how the replaced porch on the main house would be placed on the existing footings.  He reviewed his conversations with Ms. Kingsbury.  After much discussion the Commission understood the circumstances and offered if Ms. Kingsbury would agree to place a perpetual deed restriction declaring the studio will never be used as a house or guesthouse it would consider a negative determination.  They added that it would be preferred if the garage could be moved back and be flush with the studio wall that faces the pond.  Mr. Smith agreed and said he would try to convince Ms. Kingsbury to accept the compromise.

The Commission advised Mr. Smith to follow up with Chuck H. on the final details.

After additional discussion a motion for a negative determination for the glass porch, garage on the studio and the replaced deck on the main house was made, seconded and unanimously approved if the aforementioned deed restriction for the studio would be drafted, notarized and filed with the Registry of Deeds.

With no further business to conduct the meeting adjourned at 2:00 PM.
