Present for the Conservation Commission and attending the meeting were: Richard Steves, Chair, Bruce Bartels, Pam Goff, David Flanders, Pam White, Ray Kellman, Rusty Walton, Conservation Officer and Chuck Hodgkinson. Also attending: George Sourati, Louis Dimovich, Ellen Kaplan, Ella Keohane and Clarissa Allen. Absent: Russell Maloney.
DIMOVICH CONTINUED PUBLIC HEARING: NOI SE 12 – 510; AP 12-42: Mr. Steves opened the continued hearing for this Notice of Intent application at 1:30 PM. He read a letter from the NHESP stating the proposed activity would not adversely affect the actual habitat of state-listed rare wildlife species. He also summarized the revised site plan from the April 12th hearing with the curved driveway and read the meeting minutes indicating the Commission’s preference for the stone driveway surface with drainage water bars and dry wells. The driveway specifications will become special conditions for the project – if approved. Mr. Steves opened the hearing to audience comment.
Attorney Ellen Kaplan asked for an alternative analysis that is required for new single-family residence construction on lots recorded prior to 1996. Mr. Sourati summarized the various alternatives that were discussed at the April 12th hearing that included the relocated driveway with several options for surface materials and drainage designs. He added that to date there is no other legal way of accessing the site because the Hewing Field Road Association has rejected the addition of another driveway off this road. Mr. Sourati mentioned the septic design meets all Chilmark Board of Health setback requirements.
Ms. Kaplan commented she believed an additional letter from the NHESP is required that specifically addresses habitat for endangered species. She asked how the setbacks are determined from the various reference points. Mr. Sourati said he sent a letter to the NHESP and confirmed all of his surveyed measurements. He pointed out that he is a registered engineer with the Commonwealth. Mr. Walton also confirmed the high water mark on the sight plan is accurate based upon the water staining on the rocks along the riverbank.
An abutter asked if the Town’s Site Review Committee restricts tree clearing. Ms. Allen, Site Review Committee Chair responded that the Committee encourages as much tree cover and winding sight lines as possible – within safety limits.
With no further comment the hearing closed at 1:47 PM. A motion for approval with the following special conditions was made, seconded and unanimously approved: 1. The standard review of the Order of Conditions among the engineer, contractor and Conservation Officer will apply. 2. Proper siltation barriers will be installed prior to construction as determined by the Conservation Officer. 3. The Conservation Officer shall approve the final design of the driveway that includes a stone surface, water bars at various points, specific sloping and dry wells for proper water drainage. 4. If alternate access from Hewing Field is obtained before the well and utility line trenches are dug the applicant will return to the Conservation Officer or Commission with a new plan that minimizes
tree and brush disturbance.
MINUTES: The meeting minutes for 4/19/06 were reviewed. A motion to approve the minutes with a minor correction was made, seconded and unanimously approved.
ADMINISTRATION: The required signatures with notary were made for two Orders of Conditions: SE 12 – 505, AP 13-16 and SE 12 – 510, AP 12-42. Rusty W. reviewed the Iscoll Notice of Violation and immediate response along with a summary of activity on the Policastro property.
With no further business to conduct the meeting adjourned at 2:30 PM.
