Conservation Commission Minutes 03/15/06
FINAL

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chair, Bruce Bartels, Ray Kellman, Pam White, Russell Maloney, Rusty Walton, Conservation Officer and Chuck Hodgkinson.  Also attending:  Jay Lagemann, Peter Rodegast (Baker) and Kent Healy (Hastings).  Absent:  David Flanders and Pam Goff.  

Mr. Steves opened the meeting at 1:30 PM to outline two site visits – John Hastings - 8 Abel’s Neck Rd. and Baker - 19 Putnam Rd.

MINUTES:  The meeting minutes for 3/1/06 were reviewed.  A motion to approve the minutes with a minor correction was made seconded and voted unanimously in favor.

LAND BANK NOI SE 12 – 505; AP 13-16:  Mr. Steves opened the continued hearing for the Land Bank NOI application at 2:15 PM and was informed that they requested a continuance to April 19 @ 2:15 PM.  A motion to accept the request for a continuance to April 19 @ 2:15 PM was made seconded and unanimously approved.

BAKER NOI SE 12 – 506; AP 8-54, 55:  Mr. Steves opened the public hearing for the Baker NOI application at 2:20 PM.  Mr. Rodegast of South Mountain Company summarized the earlier site visit and plan for installing two underground water drainage pipes.  After brief discussion the hearing was closed at 2:25 PM.  A motion to approve the plan as presented with the standard special conditions was made seconded and unanimously approved.

JOHN HASTINGS RFD; AP 30-67:  Kent Healy reviewed the conclusions from the earlier site visit and summarized the plan to upgrade the septic system.  While on the site visit several trees were flagged for possible pruning.  The Commission advised Mr. Healy that the three trees that are within 50 feet of the wetland may not be removed.  The limbs facing the house may be pruned.  They also approved the pruning of an additional oak and two maple trees closer to the house.  After a brief discussion of the septic plan a motion for a negative determination was made seconded and unanimously approved.

MOLINARI NOI SE 12 – 502; AP 30-115, 116.1:  Mr. Steves opened the continued public hearing for the Molinari beach stairway at 2:45 PM and was informed of a request for continuance to April 5 @ 2:30 PM.  Abutter Jay Lagemann said he cannot attend the continued hearing on April 5 and informed the Commission of his conversation with the applicant Rene Molinari that indicated there may be an acceptable solution for all involved.  A motion to accept the request for a continuance to April 5 @ 2:30 PM was made seconded and unanimously approved.

ADMINISTRATION:  The required signatures with notary were made for two Certificates of Compliance (SE 12 – 301, SE 12 – 317; AP 271-206); Baker Order of Conditions (SE 12 – 506; AP 8-54, 55) Hastings Determination of Applicability (AP 30-67).

Rusty Walton summarized the information he obtained from the MACC annual conference and requested and obtained approval for his expense reimbursement.

Mr. Kellman reminded the Commission that he would be unable to attend the April 5 meeting.

With no further business to conduct the meeting adjourned at 3:20 PM.
