Conservation Commission Minutes 03/01/06
FINAL

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chair, Pam Goff, Bruce Bartels, Ray Kellman, Pam White, Associate Commissioner Russell Maloney, Rusty Walton, Conservation Officer and Chuck Hodgkinson.  Also attending:  Peter Wells for Molinari, Jay Lagemann and Tim Carroll.  Absent:  David Flanders.  

Mr. Steves opened the meeting at 1:30 PM.

MINUTES:  The meeting minutes for 2/1/06 were reviewed.  A motion to approve the minutes with a minor correction was made seconded and voted five in favor with one abstention (Ms. White).

RUSTY WALTON UPDATES:  Rusty Walton informed the Commission of a new site for the stone fire pit – Blum Trust NOI SE 12-498; AP 20-58,59.  He added that the NHESP sent a notice indicating the proposed Land Bank trial on the Goff property (NOI SE 12 – 505; AP 13-16) might encroach a habitat for a rare, water willow stem borer moth.  Mr. Walton pointed out that after making a site visit, the moth habitat is much more than 200 feet from the trail’s proposed four foot wetland crossing.  Lastly, he reminded the Commission that he would be attending the MACC annual conference.

SHEA APPEAL DISCUSSION:  Ms. Goff recommended the Commission have an independent wetland delineation performed because of the dramatic difference between the two existing lines.  A motion to hire Mario DiGregorio to prepare a third delineation was made seconded and unanimously approved.  Mr. Steves mentioned he will organize his thoughts prior to the appeal on March 21 @ 7:30 PM.

PETER WELLS FOR MOLINARI; SE 12 – 502; AP 30; 115, 116.1:  Mr. Steves opened the continued public hearing for the Molinari beach stairway down Wequobsque Cliff at 2:00 PM.  Mr. Maloney mentioned that he will not be in the real estate business at the end of March and recused himself from this hearing at Mr. Steves’ recommendation.  Peter Wells presented new, current plans dated 3/1/06 with an updated location of the cliff’s edge.  Ms. White asked for the distance to the existing Goldberg stairway.  It is two lots to the west of the Molinari property.  The Litwin lot is between the two.  Abutter Jay Lagemann reiterated his objection to the proposed stairway.  Mr. Steves read the minutes from the Garvey stairway application and reviewed the history of several other beach stairways.  Ms. White discussed the unappealing aesthetic impact of yet another set of stairs along the south shoreline—regardless of past decisions.

After further discussion Mr. Wells asked for a continuance of the hearing to March 15 @ 2:45 PM to give him time to have further discussions with his client.  A motion to accept the applicant’s request for a continuance to March 15 @ 2:45 PM was made seconded and unanimously approved.  Ms. Goff reminded the Commission that she would not be able to attend the March 15 meeting.

RFD TOWN OF CHILMARK; AP 33-119:  Mr. Steves opened the public meeting for a RFD application for selective pruning to open the public view of Clam Point Cove.  Mr. Walton outlined the specific extent of the selective clearing and precautions that would be taken to protect the isolated wetland.  A motion for a negative determination was made seconded and unanimously approved.

GRANVILLE WHITE DISCUSSION: 89 Middle Road:    Granville White distributed a summary and photos of his plans to run electric conduit; repair the bridge and remove some vegetation from the pond on his property at 89 Middle Road.  After a brief discussion Mr. White agreed to file two separate Notices of Intent for the work.

TIM CARROLL:  Tim Carroll discussed the process that will take place at the Shea appeal meeting on March 21.  He also mentioned that the Finance Committee wants to free up the funds from old warrant articles and indicated the Commission has a $3-$5000 appropriation to update the wetland by-laws.  Lastly, Mr. Carroll indicated he would like the Commission’s input on Chuck Hodgkinson’s and Rusty Walton’s performance appraisals and will contact them at a future date.

MICHAEL HALBREICH’S ASSOCIATE COMMISSIONER SEAT:  Chuck Hodgkinson indicated that Michael Halbreich has not attended a Commission meeting as an associate commissioner since July 2005.   After discussion a motion to declare his seat vacant was made seconded and unanimously approved.  

With no further business to conduct the meeting adjourned at 3:17 PM.
