Conservation Commission Minutes 11/02/05
FINAL

Present for the Conservation Commission and attending the meeting were:  Richard Steves, Chair, Pam Goff, David Flanders, Pam White, Bruce Bartels, Ray Kellman, Associate Commissioner Russell Maloney, Russell Walton Conservation Officer, and Chuck Hodgkinson.  Also attending:  Peter Wells, Kent Healy, Dennis Jason and Riggs Parker.

Site visits were conducted to the Town’s West Dock, Hancock Real Estate Office Building and Wm. Bingham’s residence at 496 North Road between 1:30 – 2:00 PM.

OCTOBER 19, 2005 MEETING MINUTES:  The minutes from the 10/19/05 meeting were reviewed.   After discussion, Ms. Goff made a motion to approve the minutes as presented.  Mr. Flanders seconded and the vote was five in favor with two abstentions (Maloney and Kellman).  

TOWN WEST FILLED DOCK NOI SE 12 – 499; MAP 271 LOTS 92, 93, 228:  Mr. Steves opened the public hearing for the proposed repairs to the Town’s west dock at 2:00PM.  Kent Healy summarized the site plan and described the repair plans and procedures.  He mentioned the steel sheathing would be 45 feet long and driven into the harbor basin in front of the existing wood dock.  The space between the steel and wood will be filled.  He added that there will be no dredging as part of the repairs and any replaced decking for the car way will use pressure treated wood that will not come in contact with the water.  The majority of the work will be done from a barge.    

Mr. Steves read a letter from the DEP dated 10/25/05 for the record.  It stated the DEP (Chapter 91 Division) views the project as an insignificant deviation from the original specifications of the contracts and license.

Mr. Parker added the Town hoped to finish the steel work this winter -- weather permitting.  The concrete docks will be added after the RFP is drafted and eventually awarded.  Mr. Walton noted that the Division of Marine Fisheries has refused permission for some projects during the winter – presumed spawning season for Winter Flounder.  He added it has been pointed out that this work is very limited in nature and location, so an exemption seems likely.  Editor’s note:  After the hearing Chuck Hodgkinson received a phone call from the Division of Marine Fisheries and received verbal approval after a brief conversation.

With no further discussion Ms. White made a motion to close the hearing at 2:08PM.  Mr. Flanders seconded and the vote was six in favor with one abstention (Maloney).  Ms. Goff made a motion to approve the plan as presented with the standard conditions for safely removing construction debris.  Mr. Bartels seconded and the vote to approve the Order of Conditions was six in favor with one abstention (Maloney).

HANCOCK REAL ESTATE FOUNDATION RFD; MAP 271 LOT 213:  Mr. Steves opened the public meeting for the RFD to repair the wood post foundation of the Hancock Real Estate office building at 2:15PM.  Kent Healy summarized the proposed work and request to remove a red maple tree that is immediately adjacent to the building as noted during the earlier site visit.  With no further discussion Mr. Kellman made a motion for a negative determination with the condition that all work will be done by hand.  Ms. White seconded and the vote for a negative determination was six in favor with one abstention (Maloney).

BINGHAM CERTIFICATE OF COMPLIANCE; NOI SE 12 – 483; MAP 271 LOT 221:  Mr. Steves opened the public meeting for the request for a Certificate of Compliance for Mr. Bingham’s septic installation at 2:30PM.  Mr. Walton summarized his observations from the site inspection and recommended the applicant have a vegetation plan for the berm.  With no further discussion Ms. Goff made a motion to approve the Certificate of Compliance with the Conservation Officer’s advice.  Mr. Bartels seconded and the vote was six in favor with one abstention (Maloney).

PETER WELLS DISCUSSION:  Peter Wells of Vineyard Land Surveying advised the Commission that he has submitted a Request for Determination for the next meeting.  It involves an archeological survey of the building envelope for Map 35 Lot 1.15 (Lot 15 Squibnocket Ridge).  He asked the Commission if the Conservation Officer would be able to visit the site with him before next meeting.  The Commission agreed and mentioned they will also visit the site on November 16 @ 1:30 PM.     

COHEN PERMITS; SE 12 – 353; MAP 32 Lot 68.1:  The Commission asked Chuck Hodgkinson to check the expiration dates of the permits issued for Mr. Cohen’s house construction at 25 East Lane.  Editor’s note:  Subsequent research indicates the recommended final decision denying the abutter’s appeal of the Order of Conditions was issued on February 16, 2001.

The following decisions were appropriately signed and notarized as needed:  Order of Conditions SE 12 – 499, AP 271, 92, 93, 228; Determinations of Applicability AP 271, 213 (-); AP 20, 58+59 (-) sod, (+) stage; Certificate of Compliance SE 12 – 483 AP 271, 221.

With no further business to conduct Ms. White made a motion to adjourn.  Mr. Kellman seconded and the meeting adjourned at 2:55 PM.
