Conservation Commission Minutes 07/06/05
FINAL

Present for the Conservation Commission and attending the meeting were:  Pam Goff, David Flanders, Ray Kellman, Alternate Michael Halbreich, Russell Walton Conservation Officer and Chuck Hodgkinson.  Also attending:  Kent Healy for D. Jason.  Absent:  Richard Steves, Bruce Bartels and Pam White.      

Ms. Goff chaired and opened the meeting at 1:36 PM with the following agenda:

-       Review June 22, 2005 Minutes
-       Notice of Intent Public Hearing wetland crossing:  Kent Healy for Dennis Jason; North Road.
-       Order of Conditions Extension:  Price, Spring Point
-       Review Agenda for July 20 Meeting

Under the rule of necessity, Mr. Halbreich was activated as a voting Commission member.

MINUTES:  The June 22, 2005 minutes were reviewed and unanimously approved with three corrections:  The Ryan hearing was closed; strike the sentence in the Jason case that referred to a suggested reasonable compromise; clarify the Cohen Enforcement Order requiring him to meet with the Commission – but not necessarily at the next meeting – and requiring mitigation and restoration.

NEW CASES

KENT HEALY FOR DENNIS JASON:  Without objection, Ms. Goff opened the public hearing on the Notice of Intent filed by Kent Healy for Dennis Jason at 1:45PM – instead of 2:00PM as originally scheduled.  Mr. Walton summarized his conclusions from his site visit with Mr. Healy.  Mr. Healy presented a revised plan that showed a combination of fill, followed by two spans of bridge totaling 56 feet followed by another section of fill.  The plan also highlighted the location and size for a required replication of wetland.  The proposed replication is designed to expand a section of existing wetland.  Mr. Healy, however, proposed the construction of only one 30-foot span of bridge with fill on both ends – instead of the solution with two sections of bridge and fill as shown on the plan submitted and recommended by the Conservation Officer.

Several alternative solutions for ingress and egress were outlined and discussed.  It was agreed the current concept, while not ideal, is probably the most prudent of the possible options.  Mr. Healy pointed out that the current proposal is less destructive to the wetland than expanding the existing access over the dam on Lot # 2.  Mr. Walton added that his recommendation that calls for two spans of bridge would further reduce the amount of required wetland replication.

The hearing was closed at 2:15PM.  Mr. Halbreich made a motion to approve the plan with two spans of bridge; fill on the north and south ends and an amount of wetland replication that is equal to the amount of wetland that is filled (about 600 sq. ft.) with the provision that the replication is contiguous to existing wetland.  Ms. Goff added that the removed vegetation must be set aside for replanting in the replicated wetland. Mr. Flanders seconded and the vote carried three in favor, one abstention (Kellman).  [SE 12 - ???, AP 20 – 98.1].  

PRICE ORDER OF CONDITIONS EXTENTION:  The Order of Conditions for the Price property in Spring Point were summarized and discussed.  The request for extension is because construction has not yet begun.  Mr. Kellman made a motion to grant the extension with the condition that the extended Order of Conditions abides by the current regulations that require larger culverts.  Mr. Flanders seconded and the vote was unanimous in favor.  [SE 12 – 362, AP 8-2].


OTHER BUSINESS

JULY 20 AGENDA DISCUSSION:  

Upon review of the July 20 meeting agenda, the following was agreed:
 
1.      The Commission must first agree to Trina Kingsbury’s wetland delineation before having a public hearing.  The Conservation Officer will postpone the hearing scheduled for July 20.  
2.      The Commission will have site visits on July 20 for Patti Lincoln’s and Allen Flanders’ applications.

The meeting was adjourned at 2:35 PM.
