  • 12:30 PM:  CONTINUED PUBLIC HEARING NOI SE 12 – 841; GEORGE SOURATI FOR SWB LIMITED PARTNERSHIP; 8 Greenhouse Lane; AP 33-30:  Eligible Voters:  Joan, Bob, Pam, Chris, Candy, Sandy, Russell.  Continued to discuss house managed retreat plan, NHESP letter and comments and conditions.  Add 170 yards of additional beach nourishment of matching river rock at the base of the coastal bank to stabilize the erosion and protect the house that is 10 feet from the edge of the bank at the deck’s closest point.  Approximately 171 yards of the same nourishment was permitted in 2013.  The rocks will increase the beach elevation to 12 feet above mean high tide.  The additional rock will add approximately 2 feet in height for a distance of 136 feet and a variable width of 8 feet.  The added rock will end approximately 22 feet from the observed mean high tide mark.  Approximately 136 linear feet of Coastal Bank; 9,000 sq. ft. of Coastal Beaches and 11,000 sq. ft. of Land Subject to Coastal Storm Flowage will be impacted.  
The eastern end of the additional rocks will end about 12 feet from the east lot line and continue to the western lot line.  A temporary 10-foot wide road from the parking area, down the bank to the beach for equipment access will be created.  All disturbed areas will be restored.  This is in response to continuing coastal bank erosion.

  • 12:40 PM:  Site Visit 7/16:  PUBLIC HEARING NOI SE 12 – 842; CHRIS ALLEY FOR STEVEN MERKEL; 17 Howell Lane; AP 27-3:  Tear down and re-build the existing single-family residence; construct a garage, build a guesthouse and a pool house, upgrade the existing cesspool and septic system and re-roof an existing shed and all the associated site work required for this work.  A corner of the new house and a portion of a retaining wall are within the 100-foot buffer zones of wetlands draining into a coastal pond.  They are 97 feet and 91 feet from the wetland edges respectively.  Approximately 2,350 sq. ft. of disturbance will take place outside a perennial stream’s 100-foot buffer zone but, within the first 100 feet of the stream’s Riverfront Area.
  • 12:50 PM:  Site Visit 7/16:  PUBLIC HEARING NOI SE 12 – 844; GEORGE SOURATI FOR ROBERT LABAREE; 78 Menemsha Inn Rd.; AP 21-36:  This is a restoration plan in response to an Enforcement Order issued on May 16, 2019 for unpermitted clearing done within resource areas and resource area buffer zones.  The restoration activity affects     30 sq. ft. of a wetland that borders a perennial stream flowing into Vineyard Sound;      674 sq. ft. of work from the top of a coastal bank, its buffer zone and within 10 feet of the wetland and within the Riverfront Area; 835 sq. ft. within the buffer zone of the stream to the wetland edge and also within the Riverfront Area.  A total of 1,502 sq. ft. and 36 sq. ft. of work is within the first and second 100 feet respectively of the Riverfront Area.    
  • 1:00 PM:  Site Visit 7/16:  PUBLIC HEARING NOI SE 12 – 843; GEORGE SOURATI FOR ROBERT LABAREE; 76 Menemsha Inn Rd.; AP 21-33:   This is a restoration plan in response to an Enforcement Order issued on May 16, 2019 for unpermitted clearing done within resource areas and resource area buffer zones.  This activity is on the neighbor’s property owned by William Cumming, Manager.  The restoration activity affects 950    sq. ft. of work from the top of a coastal bank, its buffer zone and within 8 feet of a wetland that borders a perennial stream flowing into Vineyard Sound and within the Riverfront Area; A total of 909 sq. ft. and 41 sq. ft. of work is within the first and second 100 feet respectively of the Riverfront Area.
  • CERTIFICATE OF COMPLIANCE SE 12 – 362; Helena Price; 26 Hammett Rd. (current street address); AP 8-2:  The property is being sold.  An Order was issued in 1999 to build a dwelling and driveway.  The work was never done and the Order expired.  Recommend issuing the Certificate accordingly.
  • CERTIFICATE OF COMPLIANCE SE 12 – 588; Helena Collins; 26 Hammett Rd. (current street address); AP 8-2:  The property is being sold.  An Order was issued in 2009 to build a bridge over a wetland; install a driveway, well, waterline and utilities.  The work was never done and the Order expired.  Recommend issuing the Certificate accordingly.
  • POSSIBLE CERTIFICATE OF COMPLIANCE SE 12 – 678; SWB Limited Partnership;         8 Greenhouse Lane; AP 33-30:  An Order was issued in 2013 to nourish the beach with matching river rock, create a temporary road down the coastal bank for the excavating equipment and re-vegetate the bank.  The work was successfully completed as conditioned.  Recommend issuing the Certificate with the work in full compliance.

Review Cestar Enforcement Order Plan:  For wetland clearing on Stonewall Pond (Peggy Freyberg’s house) – Carlos Montoya.

Chris Alley:  Review proposed roadway changes to SE 12 – 827; 33 Turtle Cove Rd.; AP 14-11:  An Order was issued for a driveway and well to develop a vacant lot for Aaron Brown.

NOI Reid Silva for Ocean View Farm Rd.:  Review a plan for a permanent solution for a culvert/stream crossing on Ocean View Farm Rd.  An Emergency Certification was issued in the spring for a temporary clearing of the culvert to prevent flooding and water freezing on the road.

Shall we ask LEC Consulting to attend the meeting?  To discuss the final report issued for the new firehouse project and site.
